Notice is hereby given that Sublette County, Wyoming, has accepted work as completed according to the plans and specifications set forth in the Agreement between Sublette County and All Star Striping, LLC pursuant to the Project Manual for the 2024 Sublette County Striping Project and All Star Striping, LLC is entitled to final settlement thereof.  On September 18, 2024, being the forty-first day after the first publication of this Notice, Sublette County will pay to All Star Striping, LLC. all amounts and balances due under said Agreement.

The Town Council of the Town of Pinedale met in special session on Wednesday, July 31, 2024, in the conference room of the Pinedale Town Hall.

The meeting was called to order by Mayor Matt Murdock at 12 p.m. Council members present:  Tyler Swafford, Dean Loftus, Judi Boyce, and Scott Kosiba.  Those in attendance included Ed Wood, Town Attorney, Abram Pearce, Director of Public Works; and Wes Werbelow, representing Ardurra Group, joined the meeting virtually.

Mayor Murdock led those present in the Pledge of Allegiance.

Motion by Councilman Swafford to approve the agenda as presented. Seconded by Councilman Loftus. Motion passed 5-0.

Motion by Councilman Loftus to approve the BIL Terminal Funding Grant application to the FAA for 2 million dollars.  Seconded by Councilman Swafford.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve the SPURR Brownfields Access Agreements for 21 N Franklin, 204 S Jackson, Parcel 34093420499400, and the old town dump site, to be signed by the Mayor.  Seconded by Councilman Kosiba.  Motion passed 5-0.

Motion by Councilman Swafford to enter Executive Session to discuss Real Estate at 12:31 p.m.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilwoman Boyce to exit Executive Session at 1:04 p.m.  Seconded by Councilman Swafford.  Motion passed 5-0.

The Town Council of the Town of Pinedale met in regular session on Monday, July 22, 2024, in the main conference room of the Pinedale Town Hall.

The meeting was called to order by Mayor Matt Murdock at 5 p.m. Council members present:  Tyler Swafford, Judi Boyce and Scott Kosiba.  Those in attendance included: KC Lehr, Sublette County Sheriff; Shad Cooper, Sublette County Unified Fire Chief, Max Lockett; Peg Weber; Jessup Wyman; Ed Wood, Town Attorney; and Abram Pearce, Director of Public Works. Attending online was Councilman Dean Loftus.

Mayor Murdock led those present in the Pledge of Allegiance.

Motion by Councilman Swafford to allow Councilman Loftus to participate virtually. Seconded by Councilwoman Boyce. Motion passed 4-0.

Motion by Councilman Kosiba to accept the agenda. Seconded by Councilwoman Boyce. Motion passed 5-0.

Motion by Councilwoman Boyce to approve the July 8, 2024, regular Town Council meeting minutes. Seconded by Councilman Swafford. Motion passed 5-0.

Motion by Councilman Kosiba to approve the June 24, 2024, regular Town Council meeting minutes as corrected. Seconded by Councilwoman Boyce. Motion passed 5-0.

Peg Weber and Max Lockett both requested a bike rack at Town Hall, 205 Entertainment Lane.

Peg Weber noted a request from the Highland Irrigation District for water through September.

Councilman Swafford has received complaints regarding lack of notice when mosquito spraying was conducted. Abram Pearce was asked to follow up on the complaints.

Sheriff Lehr presented the Sheriff’s report for June.

Chief Cooper presented the Sublette County Unified Fire Annual Report.

Motion by Councilman Loftus to approve the consent agenda items as published. Seconded by Councilman Swafford. Motion passed 5-0. Consent agenda items approved were: the annual lease payment to SCSD No. 1 of $1,000 for the Ground Lease for the Macro Cell Tower, effective July 1, 2024 – June 30, 2025; a lease between the Town of Pinedale and Sublette County Hospital District for the area north of the current Hospital, encompassing approximately five acres through July 31, 2025; a Specialized Aviation Service Operations (SASO) Agreement with Western Wyoming Aviation, Inc. to conduct aircraft rentals and flight instruction at Ralph Wenz Field; a lease between the Town of Pinedale and Western Wyoming Aviation, Inc. for certain real property owned by the Town of Pinedale to complete SASO operations effective July 9, 2024 – June 30, 2024; the purchase of reflective pedestrian crosswalk signs from Safety Supply & Sign Company, Inc. in an amount not to exceed $5,000; the purchase of a four-inch Sensus Cordonel water meter and appurtenances from Ferguson Waterworks, in an amount not to exceed $6,000 for a new meter at the Sublette County Hospital; the annual RNI Hosting Fee of $15,828.49 to Ferguson Waterworks for continued Sensus Hosting for the water metering system; the Mayor’s appointment of Clint Gilchrist to the Pinedale Travel & Tourism Commission until 06/30/2027;  the Mayor’s re-appointment of Emily Lucas to the Park and Tree Board until 06/30/2026; a Temporary Use Permit Application from Turner Fountain for use of the parking lot and power load box across from American Legion Park to operate a food truck July 25, 2024, from approximately 10 a.m. until 6 p.m.

Motion by Councilman Swafford to approve the Notice of Award to Teletractors, Incorporated, for the Pinedale I&I Reduction and Conveyance Project in the amount of $358,605. Seconded by Councilwoman Boyce. Motion passed 5-0.

Council discussed the impact and issues of a Change of Zoning request submitted to Sublette County enabling the construction and operation of an RV Park at 62 Runway Lane. The property is less than 600 feet from the center of the runway. Multiple issues were identified and reported to Sublette County with a recommendation that the request be rejected.

Council reviewed department reports from Animal Control and Municipal Code Enforcement, Public Works and its departments, and PTTC.

OFFICIAL COUNTY COMMISSIONERS’ PROCEEDINGS

JULY 16,2024

The Board of County Commissioners met in regular session in the Commissioners’ Meeting Room of the Sublette County Courthouse on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Dave Stephens, Mack Bradley, Clayton Melinkovich, and Carrie Long, County Clerk, pre-sent. 

Chairman White led those present in the Pledge of Allegiance. 

The agenda was approved on motion by Commissioner Bradley with the addition of Kate Olsen dur-ing Unified Fire update and the addition of a request for special prosecutor by the County Attorney.  Commissioner Noble seconded the motion.   

The minutes of the previous meeting held on July 2, 2024, were approved and ordered filed on mo-tion by Commissioner Noble, seconded by Commissioner Bradley.

Chairman White reviewed the Resolution to Provide Income Necessary to Finance Budget.  Com-missioner Vickrey made a motion to approve the Resolution, Commissioner Bradley seconded the motion.  Motion carried.   The Resolution was signed. 

Chairman White reviewed the Appropriation Resolution.  Commissioner Bradley made a motion to approve the Resolution.  Commissioner Noble seconded the motion.  Motion carried.  The Resolu-tion was signed. 

Billy Pape, Road & Bridge, updated the Board on department activities.  Eric Sackett, Rio Verde En-gineering, informed the Board that two bids had been received for the East Green River Road pro-ject.  Sackett recommended the Board accept the bid from Teletractors in the amount of $461,225.00.  Commissioner Bradley made a motion to accept the bid from Teletractors.  Commis-sioner Vickrey seconded the motion.  Motion carried.  Commissioner Noble abstained from voting.

Mike Jackson, Rio Verde Engineering, met with the Board to discuss the installation of utilities on the property purchased across from the Ice Arena.  Matt Murdock, Matt Bowers, and Abe Pearce from the Town of Pinedale also participated in the discussion.  Mayor Murdock requested the Board grant an Easement through the property to facilitate connectivity to future development of neighbor-ing properties.  Commissioner Noble made a motion to move forward with an Easement, as present-ed by Rio Verde, with the condition of the installation of utilities be considered before moving for-ward.  Commissioner Bradley seconded the motion.  Motion carried 3 to 2 with Commissioners Vickrey and Stephens voting nay.   

Billy Pape presented the Lease with Mallard’s at the Golf Course.  Commissioner Noble made a mo-tion to update the Lease.  Commissioner Bradley seconded the motion.  Motion carried. 

Commissioner Noble made a motion to adjourn to Executive Session.  Commissioner Vickrey se-conded the motion.  Motion carried. 

Open session resumed with no action from the Executive Session. 

Andre Irey, Maintenance, updated on department activities. 

Shad Cooper, Unified Fire, reviewed the monthly fire report.  Kate Olsen, Forest Service, updated the Board on the Horse Creek fire. 

Dennis Fornstrom, Planning & Zoning, presented a request for an extension of one calendar year from Jason Moyes for the substantial development of property regarding PIDN 35112140001500 referenced in Resolution 22-100450B. 

Members of the public who commented were Dan Bailey and Carol Ann Ardis.

Commissioner Noble made a motion that Planning & Zoning does not move forward with the vaca-tion of the zoning change for another 12 months.  Commissioner Bradley seconded the motion.  Motion carried 3 to 2 with Commissioners Vickrey and Stephens voting nay.

Clayton Melinkovich, County Attorney, met with the Board to request an appointment of a Special Prosecutor.  Commissioner Noble made a motion to appoint Fremont County Attorney Patrick LaBrun,and any Deputy Attorneys as Special Prosecutor.  Commissioner Bradley seconded the mo-tion.  Motion carried.

Laila Illoway, County Assessor, presented 3 tax roll corrections:  Hillcorp Energy in the amount of -$2,914.33; Jonah Energy in the amount of -$30,648.92; Jonah Energy in the amount of -$11,224.92.  She also presented a Notice of Valuation Change for Jonah Energy in the total amount of $15,951,914.  Commissioner Noble made a motion to approve the corrections and valuation change.  Commissioner Bradley seconded the motion.  Motion carried. 

Commissioner Bradley made a motion to approve a Surety Bond for Jana Bloxham (Chairman, Up-per Green River Cemetery District).  Commissioner Stephens seconded the motion.  Motion carried.

PROPOSED CONSTITUTIONAL AMENDMENT A & SPECIAL LODGING TAX:

CONSTITUTIONAL AMENDMENT A WILL APPEAR AS FOLLOWS:  THE ADOPTION OF THIS AMENDMENT WOULD SEPARATE RESIDENTIAL REAL PROPERTY INTO ITS OWN CLASS OF PROPERTY FOR PURPOSES OF PROPERTY TAX ASSESSMENTS.  THE AMENDMENT WOULD AUTHORIZE THE LEGISLATURE TO CREATE A SUBCLASS OF OWNER OCCUPIED PRIMARY RESIDENCES. 

SPECIAL LODGING TAX

SHALL THE TOWN OF PINEDALE BE AUTHORIZED TO IMPOSE A TWO PERCENT (2%) LODGING TAX ON HOTEL, MOTEL, TOURIST COURTS, TRAILER PARKS, CAMPGROUNDS, SHORT TERM RENTALS AND SIMILAR ESTABLISHMENTS PROVIDING SLEEPING ACCOMMODATIONS TO TRANSIENT GUESTS AS PERMITTED BY WYOMING STATUTE 39-15-204(a)(ii)?

CAMPAIGN FILING REQUIREMENTS

Every Candidate, Candidate’s Campaign Committee and Political Action Committee shall file a Statement of Contributions and Expenditures Report between October 15, 2024 and October 29, 2024.  Amendments must be filed by November 15, 2024.

CHAPTER 6, SECTION 2 CONSTRUCTION/MODIFICATION PERMIT - Department of Environmental Quality, Division of Air Quality PUBLIC NOTICE:  In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Williams Field Services Company to modify one (1) existing pig launcher (BVC003) with the addition of a spool piece to accommodate a smart pig design at the Big Piney Compressor Station. The Big Piney Compressor Station is located in the E½ of Section 20, T28N, R113W, approximately eight (8) miles north-northwest of Calpet, in Sublette County, Wyoming. A Chapter 6, Section 2(c)(ii) demonstration in accordance with the Division’s Interim Policy has been conducted.  Emission offset requirements, if applicable, have been applied to this permitting action at a ratio of 1.5:1.0 for VOCs and 1.1:1.0 for NOx. As shown, permitting actions to date, including this application, have resulted in a decrease in NOx emissions of 82.5 tpy and a decrease in VOC emissions of 104.9 tpy. Therefore, Williams Field Services Company has met the offset requirements for NOx and VOC.

For the duration of the public comment period, the permit application, the agency’s analysis, and the public notice are available for public inspection online at https://openair.wyo.gov, utilizing facility ID F000930 and permit number P0038402 under permits. This material may also be viewed online, at the above URL, utilizing a public computer at the Sublette County Library, Pinedale, Wyoming.  Additionally, for the duration of the public comment period a copy of this public notice is available for public inspection at the Sublette County Clerk’s Office, Pinedale, Wyoming.  In accordance with the Americans with Disabilities Act, special assistance or alternate formats will be made available upon request for individuals with disabilities.
