Notice is hereby given that the Wyoming Department of Transportation has accepted as completed according to plans, specifications and rules governing the same work performed under that certain contract between the State of Wyoming and Kilgore Companies, LLC dba Lewis & Lewis, Inc., The Contractor, on Highway Project Number 1800015 in Sublette County, consisting of grading, profile milling plant mix, bituminous pavement surfacing, reclaimed asphalt pavement and miscellaneous work, and the Contractor is entitled to final settlement therefore; that the Director of the Department of Transportation will cause said Contractor to be paid the full amount due him under said contract on August 21, 2024.

PUBLIC RELEASE FOR FREE AND REDUCED PRICE MEALS

Dear Parents/Guardians,

Sublette County School District #1 today announced its policy for free and reduced price meals for children unable to pay the full price of meals served under the National School Lunch and Breakfast Program. Each school and the administration office have a copy of the policy, which may be reviewed by any interested party.

The following household size and income criteria will be used for determining eligibility. Children from households whose income is at or below the levels shown are eligible for free or reduced price meals.

Students are determined to be homeless or runaway by the school will receive free lunch and breakfast. Contact the school for more information.

Households not receiving SNAP, POWER or FDPIR benefits

Students can be eligible for free or reduced lunches and breakfasts by completing a meal benefit income application. It must include all members of the household and their income, the last four digits of the primary adult’s social security number and signature. Forms can be obtained through the school.

Information provided on the application will be used for the purpose of determining eligibility and may be verified at any time during the school year by school or other program officials. Applications may be submitted at any time during the year.

Under the provisions of the free and reduced price policy, Director of Operations will review applications and determine eligibility. Parents or guardians dissatisfied with the ruling of the official may wish to discuss the decision with the determining official on an informal basis. Parents wishing to make a formal appeal may make a request either orally or in writing to Shannon Harris Po Box 549 Pinedale, WY 82941, 307-367-2139 for a hearing on the decision.

If a household member becomes unemployed or if the household size increases, the household should contact the school. The household may now be eligible for benefits if the household’s income is at or below the levels shown.

The information provided by the household is confidential and will be used only for purposes of determining eligibility and verifying data unless specific written consent is given.

NOTICE OF FINAL PAYMENT

Pursuant to W.S. § 16-6-116, notice is hereby given that the Town of Pinedale has accepted the delivery of equipment on Tri-State Truck & Equipment, Inc.- Procurement of Wheel Loader with Attachments for Airport Snow Removal, State No. APNA009A, as substantially completed as to all bid schedules for the Procurement of Wheel Loader with Attachments for Airport Snow Removal according to the plans and specifications and rules set forth in the Contract. Tri-State Truck & Equipment, Inc. is entitled to final settlement for that portion of the contract substantially completed.  Upon the 41st day, August 28th, 2024, after the first publication of this notice, that the Town of Pinedale, under whose direction of supervision the work has been carried out will pay to Tri-State Truck & Equipment, Inc. the full amount due under the Contract as to the portion of the Contract deemed substantially completed.  All persons, firms, or corporations who have any claims for work done or materials furnished on said public work are hereby notified that final payment will be made to Tri-State Truck & Equipment, Inc. in accordance with the terms of the Contract on September 1st, 2023 for that portion of the Contract deemed substantially completed.  This section does not relieve Tri-State Truck & Equipment, Inc. and the sureties on his bond from any claims of work or labor done or materials or supplies furnished in the execution of the Contract.

PUBLIC NOTICE

Evans Construction of Jackson, Wyoming has applied for a small mining permit from the Land Quality Division of the Department of Environmental Quality for the State of Wyoming.  The mining permit area for the mining of sand and gravel will be located in: Sections 20 and 29, T38N, R113W, Sublette County, Wyoming. The proposed gravel operation is located approximately 0.40 miles east of U.S. Highway 191, approximately 2 miles northwest of Bondurant, Wyoming. The proposed operation is an existing gravel operation which will continue until 2045.   

Information regarding this application may be reviewed in the Office of the Land Quality Division of the Department of Environmental Quality in Cheyenne and Lander, Wyoming, or the Sublette County Clerk’s Office Pinedale, Wyoming.  Written objections to the proposed mining operation must be received by the Administrator of the Land Quality Division of the Department of Environmental Quality, 200 W. 17th Street, Suite 10, Cheyenne, WY  82002, before the close of business September 7, 2024. Objections may also be submitted by the same deadline via the Land Quality Division’s electronic comment portal at http://lq.wyomingdeq.commentinput.com/.  The Director shall issue a final written decision on the application within thirty days after the deadline to file objections. The applicant or objector may appeal the Director’s written decision to the Environmental Quality Council (EQC). If a hearing is held, the EQC shall issue findings of fact and a decision within sixty days after the final hearing.  The hearing shall be conducted as a contested case in accordance with the Wyoming Administrative Procedure Act (W.S. §16-3-101 through §16-3-115), and the right of judicial review shall be afforded as provided in that Act.  All parties as given in W.S. §35-11-406(j) will be mailed a copy of this notice. The Wyoming Oil and Gas Conservation Commission will be mailed a copy of the application mine plan map as required in W.S. §35-11-406(j).

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, the Commission hereby gives notice of the Application of Rocky Mountain Power (RMP or the Company) for authority to update tariff Schedule 37, the Standard Rates for Avoided Cost Purchases of Power from Qualifying Facilities (Schedule 37), as more fully described below.

1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility subject to the Commission's jurisdiction. Wyo. Stat. §§ 37-l- 101(a)(vi)(C) and 37-2-112.

2. On June 25, 2024, RMP filed its Application, requesting authority to update tariff Schedule 37, to revise the costs of power purchased from qualifying cogeneration and small power production facilities (QFs) under the Public Utilities Regulatory Policies Act (PURPA).

3. Schedule 37 rates were last approved by the Commission in Docket No. 20000- 545-ET-18. The proposed avoided cost rates are based on RMP’s most recent official forward price curve and the 2023 IRP Update, and result in a proposed avoided cost rate of $47.12 per MWh, an increase of $9.15 per MWh for base load QFs. Proposed avoided costs rates for wind, fixed solar, and tracking solar QFs are $20.32 per MWh, $37.60 per MWh, and $37.54 per MWh, respectively. The Application states the higher avoided costs are primarily due to higher power prices the first few years. The addition of renewable resources to the 2023 IRP Update is projected to help suppress power prices and avoided energy costs.

The Town Council of the Town of Pinedale met in regular session on Monday, May 13, 2024, in the main conference room of the Pinedale Town Hall.

The meeting was called to order by Mayor Matt Murdock at 5 p.m. Council members present:  Tyler Swafford, Dean Loftus and Scott Kosiba.  Councilwoman Judi Boyce, absent; excused. Those in attendance included: Representative Albert Sommers; Tressa Barnes and David Ricley, representing Union Telephone; Josh and Cara Rose, representing Western Wyoming Aviation; Paige Harrell and Caitlyn Mansur, representing Green River Rendezvous Pageant Association; Kathy Bright; Tony Keys; Max Lockett; Peg Weber; Ed Wood, Town Attorney; Abram Pearce, Director of Public Works; Spencer Hartman, Water-Wastewater Supervisor; and Chad Mitchell, Planning & Zoning Administrator. Mayor Murdock led those present in the Pledge of Allegiance.

Motion by Councilman Swafford to amend the agenda to add E-1 Rendezvous Parade.  Seconded by Councilman Kosiba.  Motion passed 4-0.

Motion by Councilman Kosiba to approve the April 8, 2024, public meeting minutes.  Seconded by Councilman Swafford.  Motion passed 4-0.

Motion by Councilman Loftus to approve the April 12, 2024 Special Town Council meeting minutes.  Seconded by Councilman Kosiba.  Motion passed 3-0-1; Councilman Swafford abstained.

Motion by Councilman Swafford to approve the April 22, 2024, regular Town Council meeting minutes.  Seconded by Councilman Loftus.  Motion passed 3-0-1; Mayor Murdock abstained.

Peg Weber commended Town Staff for dealing with recent issues and reported that there is a big dip in the street on Quartz Avenue.  Abram Pearce responded that Public Works was aware of the situation and it would be dealt with in the upcoming weeks.

Josh and Cara Rose, of Western Wyoming Aviation, proposed a flight school at Ralph Wenz Field.

Mayor Murdock declared the Public Hearing regarding a new restaurant liquor license and a retail license transfer open at 5:11 p.m.  No complaints had been received by the office of the Town Clerk.  Hearing no comments from the public, and pending final approval from the Wyoming Liquor Division,; motion by Councilman Swafford to approve the following liquor licenses for the period ending March 31, 2025.  Seconded by Councilman Kosiba.  Motion passed 3-0-1; Councilman Loftus abstained.  The  public hearing closed at 5:13 p.m.

Paige Harrell approached the council about the Green River Rendezvous Pageant Association taking on the Rendezvous Parade.

Representative Albert Sommers presented a legislative update.

Tressa Barnes and David Ricley presented an update on the Union fiber installation and will continue their quarterly progress reports to Town Council.

Motion by Councilman Swafford to approve the consent agenda items as published.  Seconded by Councilman Kosiba.  Motion passed 4-0.  Consent agenda items approved were Airport Operator's Liability Proposal from Avsurance Corporation, effective May 23, 2024 to May 23, 2025, in the amount of $4,727; renewal of the annual WAM-JPIC benefit contract, effective July 1, 2024 to June 30, 2025; the purchase of precast concrete manholes and storm grates from Oldcastle Precast, Inc., in an amount not to exceed $5,500; approval of the rejection of bids for the Reconstruct S GA Apron Project; a waiver from §160-15 A, sections 5, 6, and 7, for the construction of a new tri-plex on an existing foundation located at 385, 387, and 389 South Colter Avenue, including the conditions documented in the staff report dated May 10, 2024.

Council and Town Staff discussed the wastewater treatment facility DEQ Letter of Violation.

Council and Town Staff discussed proposed changes to water and sewer rates.

Council reviewed the unaudited quarterly financial report.

Mr. Pearce reported that there will be a kid's fishing day sponsored by Wyoming Game & Fish, Bridger-Teton National Forest and the BLM, at the Dudley Key Sports Complex pond on Saturday, June 1.

Sheriff Lehr reported on calls for service for April 2024, and expressed his gratitude to the Pinedale Aquatic Center for allowing undergraduate students to attend the senior graduation party.

Amber Anderson presented the annual PAC Joint Powers Board budget report.

Motion by Councilwoman Boyce to approve the recommendation of a zone language change per §475 Article XXXIV to the Planning and Zoning Commission for §475 Article XLI Short-Term Rental for adjustments to §475-342 regarding the number of STR permits that may be issued per deeded property or lot, and §475-343 adjusting the penalty to reflect zoning violations as documented in §475 Article XXXV.  Seconded by Councilman Swafford.  Motion passed 5-0.

Motion by Councilman Swafford to approve the Memorandum of Understanding between the Town of Pinedale and the Sublette County for the 2024 Chip Seal Project. Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilman Kosiba to approve Change Order No. 1 for the Ralph Wenz Field 20,000 Gallon Jet A Tank Installation Project Contract between the Town of Pinedale and Bassco Services, Inc., in the amount of $9,854.12, for a total contract price of $407,570.69.  Seconded by Councilwoman Boyce.  Motion passed 5-0.

Motion by Councilman Swafford to approve the Option and Land Lease Agreement between the Town of Pinedale and Sublette County School District No. 1 for the leased premises to construct and operate a macro-cell tower.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilman Loftus to approve the variance request from pipe material to HDPE water main lines and fittings over 4” in size in the construction of water facilities for Pronghorn Crossing Subdivision.  Seconded by Councilwoman Boyce.  Motion passed 5-0.

The variance request from pipe material to HDPE Water Service Lines and Fittings Under 3” in the construction of the water facilities for Pronghorn Crossing Subdivision was withdrawn.

Motion by Councilman Swafford to approve a construction standard variance request for HDPE pipe material for sewer mains and services in the construction of the sewer facilities for Pronghorn Crossing Subdivision.  Seconded by Councilman Loftus.  Motion passed 5-0.

The construction standard variance request for Fire Hydrants of AVK Series 27 in the construction of Pronghorn Crossing Subdivision was withdrawn.

Motion by Councilman Kosiba to approve a construction standard variance request for water valves to AVK Series 66 in DR 11 for the construction of water facilities for Pronghorn Crossing Subdivision.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilman Swafford to approve the General Service Contract for a new electrical service connection to Rocky Mountain Power for a macro cell tower, in the amount of $22,475.  Seconded by Councilman Kosiba.  Motion passed 5-0.

Motion by Councilman Kosiba to approve the South GA Apron Project Amendment No. 1 to Work Order 2023-03 between the Town of Pinedale and Ardurra Group, Inc., dated February 15, 2022, in the amount of $11,710, bringing the total contract price to $358,503.38.  Seconded by Councilwoman Boyce.  Motion passed 5-0.

The meeting was called to order by Mayor Matt Murdock at 5 p.m. Council members present:  Judi Boyce and Scott Kosiba.  Those in attendance included:  KC Lehr, Sublette County Sheriff; Cat Urbigkit; Brian Gray, representing Jorgensen Associates; Josh Hattan, representing Wind River Sport Fishing, LLC.; Owen Best, representing Acme Pest Control, LLC.; McKinley Boulter, representing Sip Fizz; Peg Weber; Jessup Wyman; Ed Wood, Town Attorney; and Abram Pearce, Director of Public Works.  Attending online were Councilman Tyler Swafford; Councilman Dean Loftus;  Kirk Farrelly, representing Dollar General; and Maureen Rudnick, Assistant Clerk-Treasurer.

Mayor Murdock led those present in the Pledge of Allegiance.

Motion by Councilwoman Boyce to allow Councilman Swafford and Councilman Loftus to participate in the meeting virtually.  Seconded by Councilman Kosiba.  Motion passed 3-0.

Motion by Councilwoman Boyce to amend the agenda to add J-2 Executive Session to Discuss Real Estate.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve the June 10, 2024, regular Town Council meeting minutes.  Seconded by Councilman Kosiba.  Motion passed 5-0.

Jessup Wyman reported that the bulb-outs are great and asked why the Planning and Zoning Commission met at noon and not at 5 p.m. or after.

Mayor Murdock stated that the bulb-outs are on a temporary trial, and the Planning and Zoning Commission does meet at 5 p.m. or after when there is a public hearing scheduled.

Peg Weber thanked staff for putting up the senior banners and the wildlife banners.

Sheriff Lehr reported on calls for service for May 2024, and commended Town Staff for their visibility during the bulb-out trial set-up.

Cat Urbigkit introduced herself to the Council and stated she was running for State House District 20.

Motion by Councilman Loftus to approve the consent agenda items as amended.  Seconded by Councilman Swafford.  Motion passed 5-0.  Consent agenda items approved were Main Street Pinedale's Temporary Use application for the Rendezvous Artist's Row at Trapper's Park, effective July 12-13, 2024, and waive the fees;  Main Street Pinedale's Temporary Use permit application to use 210 W Pine Street for the Rendezvous Rodeo Zone on July 11-14, 2024, and waive the fees; the renewal of all current insurance policies as quoted from Tegeler & Associates, effective July 1, 2024-June 30, 2025, in the amount of $120,719; the award of park mosquito fogging to Acme Pest Control for the summer of 2024, in the amount of $919 per application; the waiver of bulk water fees for Sage and Snow Garden Club from the bulk water station for the purpose of providing water for the Pine Street flower barrels; the Mayor's reappointments of Jim Hamilton to the Pinedale Travel & Tourism Commission, Chad Kuhn to the Pinedale Airport Board, and Michael Lutz to the Planning & Zoning Commission; payment of $29,820 to Ben Davis Painting at the completion of work at 205 Entertainment Lane; the purchase of bark mulch from Miller Companies, Inc., in the amount of $5,400; the purchase of dry soda ash from Brenntag Pacific, in the amount of $17,316.90; the purchase of liquid soda ash 10% from Brenntag Pacific, in the amount of $6,106; and the purchase of picnic tables, amended from three to four, from Belson Outdoors, not to exceed $5,000.

Motion by Councilman Kosiba to approve a permissive use/encroachment agreement at 709 W Pine Street for the conditional use of the public right-of-way for Sip Fizz, LLC.  Seconded by Councilwoman Boyce. Motion passed 5-0.

Motion by Councilwoman Boyce to approve the proposed lease of office 1-East, located in Town Hall, to the Wyoming Department of Health Public Health Nursing, effective 7/1/2024-6/30/2026, in the amount of $8,400 per year, contingent upon approval by both parties.  Seconded by Councilman Kosiba.  Motion passed 5-0.

No action was taken on the pathway lighting fixtures.

Motion by Councilwoman Boyce to approve the Professional Services Agreement Amendment No. 2 to the Town of Pinedale Pedestrian Safety Project, in the amount of $10,000 for ground water monitoring per WYDOT requirements, for a total revised contract amount of $220,150, and amending the contract completion date to December 31, 2024.  Seconded by Councilman Kosiba.  Motion passed 5-0.

Motion by Councilman Kosiba to approve the Commercial Building Permit Application for Dollar General #30390, to be located at 486 South Pine Street, pursuant to §160-10.C.2 of the Pinedale Town Code with the requirement that all improvements within the right-of-way be covered under a Right-of-Way Excavation Permit and bonded appropriately.  Seconded by Councilwoman Boyce.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve a Commercial Proposal and Sales Agreement between the Town of Pinedale and Everon, LLC., to upgrade the access controls in Town  of Pinedale facilities, in the amount of $40,999 and a 12-month service charge of $326 per month.  Seconded by Councilman Kosiba.  Motion passed 5-0.

Council reviewed monthly department reports from Municipal Court, Animal Control & Municipal Code, Projects, Public Works, Water & Wastewater, Planning & Zoning, the Airport and Travel & Tourism.

Motion by Councilman Kosiba to approve Ordinance 715, on third read, an Ordinance of the Town of Pinedale, State of Wyoming, an amended Appropriation Ordinance for fiscal year ending June 30, 2024.  Seconded by Councilwoman Boyce.  Motion passed 5-0.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, the Commission hereby gives notice of the Application of Rocky Mountain Power (RMP or the Company) for authority to implement a five-year commercial and industrial Demand Response Pilot Program and Recovery Mechanism, as more fully described below.

1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility subject to the Commission's jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.

2. On July 8, 2024, RMP filed its Application requesting approval of a new Schedule 114 with the addition of the voluntary Commercial and Industrial Demand Response (C&I DR) Pilot Program, effective for the five-year period of May 1, 2025 to December 31, 2029. The Company proposes a $5.8 million (0.8% of base revenue) increase to Schedule 91 through a new 0.69% surcharge rate for Demand Response. The Company also proposed to add a Customer Efficiency Service Charge to the Schedule 191 balancing account to recover costs associated with the new C&I DR program, which are estimated at $20,088,750. RMP further proposes eliminating Schedule 30, the Interruptible Service Pilot Program due to lack of participation.

3. Per the Application, the initial C&I DR Pilot Program is intended to provide financial incentives to large commercial and industrial customers with curtailable or reduceable loads greater than 500 kilowatts under Category 3. The program may be utilized to provide peak load reduction, contingency reserves, frequency response, and other services to assist with managing the electric grid, and requires customer curtailment and real time response with limited to no advance notice to Company initiated events. Participating customers will receive annual compensation based on verifiable dispatchable loads adjusted by capacity factor and event participation percentage.

PRICING PROGRAM

PUBLIC RELEASE FOR FREE AND REDUCED PRICE MEALS

July 16, 2024

Sublette County School District #9 today announced its policy for free and reduced price meals for children unable to pay the full price of meals served under the National School Lunch Program, and the National School Breakfast Program.  Each school and the superintendent’s office have a copy of the policy, which may be reviewed by any interested party.

The following household size and income criteria will be used for determining eligibility.  Children from households whose income is at or below the levels shown are eligible for free or reduced price meals.

SNAP Benefits and Foster Children

Students that are in these two categories can be directly certified for free lunch and breakfast without completing a meal benefit income application.  Contact the school to check on student’s direct certification status.

POWER and FDPIR Power (non custodial)

Students that are in these two categories can be certified for free lunch and breakfast, after a meal benefit income application is completed by the adult. The adult must include the adult household member’s signature and the appropriate case number.

Homeless and Runaway

Students are determined to be homeless or runaway by the school homeless liaison will receive free lunch and breakfast.  Contact Melissa Mitchell at 276-3322 for more information.

Households not receiving SNAP, POWER or FDPIR benefits

Students can be eligible for free or reduced lunches and breakfasts by completing a meal benefit income application.  It must include all members of the household and their income, the last four digits of the primary adult’s social security number and signature.  Applications may be submitted online after August 1, 2024.  If requested, paper forms can be obtained through the school.

Information provided on the application will be used for the purpose of determining eligibility and may be verified at any time during the school year by school or other program officials.  Applications may be submitted at any time during the school year.

Under the provisions of the free and reduced price policy, the Food Service Director will review applications and determine eligibility.  Parents or guardians dissatisfied with the ruling of the official may wish to discuss the decision with the determining official on an informal basis.  Parents wishing to make a formal appeal may make a request either orally or in writing to Angie Clifford, Food Service Director 307-276-3322 ext. 4142 aclifford@sublette9.org, for a hearing on the decision.

If a household member becomes unemployed or if the household size increases, the household should contact the school.  The household may now be eligible for benefits if the household’s income is at or below the levels shown.

The information provided by the household is confidential and will be used only for purposes of determining eligibility and verifying data unless specific written consent is given.

OFFICIAL COUNTY COMMISSIONERS’ PROCEEDINGS

JULY 2, 2024

The Board of County Commissioners met in regular session in the Commissioners’ Meeting Room of the Sublette County Courthouse on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Dave Stephens, Mack Bradley, Jeness Saxton, Clayton Melinkovich and Cali O’Hare (via Teams) representing The Pinedale Roundup, and Carrie Long, County Clerk, present. 

Chairman White led those present in the Pledge of Allegiance. 

The agenda was approved on motion by Commissioner Noble, seconded by Commissioner Vickrey. Motion carried. 

The minutes of the previous meeting held on June 18, 2024, were approved and ordered filed on motion by Commissioner Bradley, seconded by Commissioner Stephens. 

Billy Pape, Road & Bridge, updated on department activities. Eric Sackett, Rio Verde Engineering, updated the Board on the North Piney project.  Mike Jackson, Rio Verde Engineering, discussed the replacement of the bike path next to North Piney with the current construction project. Adding a change order to add the bike path would result in a change of $940,552.35.  Commissioner Noble made a motion to approve the change order to include the bike path.  Commissioner Stephens seconded the motion.  Motion carried.

Jackson requested direction from the Board regarding repairs to other bike paths.  The Board requested that the discussion be postponed until the start of the next budget in 2025. 

Jackson requested direction regarding plans to place piping in the Colorado ditch and / or drilling wells at the golf course.  The Board instructed Jackson to move forward with plans to drill the wells.

The Board discussed capital projects with Pape. After discussion, the Board decided to table the Ehman Lane project for one year. 

Commissioner Noble made a motion to adjourn to Executive Session pursuant to W.S. 16-4-405(a)(iii) - Litigation.  Commissioner Bradley seconded the motion.  Motion carried. 

The Board resumed the open session with no action from the Executive Session.

Andre Irey, Maintenance, updated on department activities. 

Billie Hamby, Veteran Services, presented the current year budget request to the Board in the amount of $134,263.00, an increase of $55,313.00.  Hamby will soon be retiring, and the increase reflects possible medical benefits for a new employee as well as a 3% cost of living adjustment. 

Dagan Montgomery and Bridger Feuz (via Teams) met with the Board to discuss the responsibility of the county to provide a vehicle for the Agriculture & Natural Resources Extension Educator as well as the 4H Coordinator. 

Montgomery also presented the Compensation Agreement for the 4H Coordinator.  Commissioner Noble made a motion to approve the agreement.  Commissioner Vickrey seconded the motion.  Motion carried.

In accordance with public notice published in the Pinedale Roundup on June 27, 2024, public hearing was held for the transfer of funds in the amount of $1,965,466.26 from the following account: Depreciation Reserve-Budget Reserve to supplement the following accounts:  Capital Projects – Land Purchase, $1,697,466.26; Golf Course Manager Salary, $25,000; Law Enforcement Salaries, $225,000; and Ice Arena Salaries, $18,000.  It was moved by moved by Commissioner Noble, seconded by Commissioner Bradley to approve Resolution 23-100483W. 

Commissioner Noble made a motion to appoint Bill Lehr and Tim Thompson to renew the 2 full 3-year terms and Ron Wilson to finish the remainder of the partial term through 6/30/26 on the Museum Board.  Commissioner Bradley seconded the motion.  Motion carried. 

Commissioner Bradley made a motion to appoint Maureen Dempsey and Stephen Nelson to 2 – 3-year terms on the Library Board.  Commissioner Noble seconded the motion.  Motion carried.   

Commissioner Noble made a motion to re-appoint Holly Roberts to a 3-year term on the Planning and Zoning Board.  Commissioner Bradley seconded the motion.  Motion carried. 

Commissioner Bradley made a motion to appoint Cara Olson to the remainder term (through 12/31/27) on the Recreation Board.  Commissioner Noble seconded the motion.  Motion carried.

Commissioner Noble made a motion to appoint Scott Kosiba, per the request of the Town of Pinedale, to the Visitor Center Board.  Commissioner Bradley seconded the motion.  Motion carried. 

Janna Lee, Public Health, presented a two-year contract for public health nursing.  Commissioner Noble made a motion to approve the contract.  Commissioner Vickrey seconded the motion.  Motion carried.

Clayton Melinkovich, County Attorney, presented an Opioid Settlement agreement for approval.  Commissioner Noble made a motion to approve the agreement.  Commissioner Bradley seconded the motion.  Motion carried. 

Melinkovich also presented a Resolution to dissolve the Golf Board.  Commissioner Bradley seconded the motion.  Motion carried. Melinkovich said he would get the members of the Golf Board to sign as well and then record the document in the Clerk’s office. 

Dennis Fornstrom, Planning & Zoning, presented an application from JCM Estates, LLC, requesting a Partial Vacation of a Subdivision and Plat Amendment to the Blackburn Subdivision pursuant to Chapter XII, Subchapter IV, Section 4, Vacation/Modifications to Filed Plats, of the Sublette County Zoning & Development Regulations. The request would amend the lot line between Lots 4 & 5 of the Blackburn Subdivision.  The proposal is located at 20 & 22 Blackburn Lane.  Commissioner Bradley made a motion to approve the request.  Commissioner Stephens seconded the motion.  Motion carried. 

Fornstrom also presented an application from Pinedale Self Storage, LLC, requesting a Change of Zoning District Boundary pursuant to Chapter VIII, Section 2, of the Sublette County Zoning and Development Regulations.  The proposal would reclassify 3.12 acres from (A-1) Agricultural Zoning to (C-1) Commercial Zoning.  The property is located at 9708 US Hwy 9708 US Hwy 191.

Chairman White asked the members of the Board if they had considered all 10 findings of the application.  All stated they had.  Commissioner Noble made a motion to approve the application.  Commissioner Bradley seconded the motion.  Motion carried. 

Fornstrom presented a letter to the Board Danielle Dover, owner of Mountain Meadow Creek, LLC, requesting an extension of 9 months to complete the subdivision application requirements and approvals. Commissioner Noble made a motion to approve the extension.  Commissioner Vickrey seconded the motion.  Motion carried. 

Jeness Saxton, County Administrator, updated the Board on department activities.

Accounts Payable was approved as presented with the removal of a voucher to Adams Concrete in the amount of $12,700 on motion by Commissioner Noble, seconded by Commissioner Bradley.  Motion carried.

SUBJECT TO reservations and restrictions contained in the United States patents, to easements and rights-of-way of record or in use, to prior mineral reservations of record and to all other matters of public record.

The Wyoming Department of Environmental Quality (WDEQ) has received a request from Wild Waters Restoration LLC, for a temporary increase in turbidity in Prairie Creek near Daniel, Wyoming. The temporary increase in turbidity is associated with continued channel restoration.

Activity in cold water streams like Prairie Creek is normally limited to a ten (10) NTU increase over background. Approval of this request would allow an exceedance of this limit for up to twenty (20) total working days, subject to monitoring and reporting. This activity will follow the procedures in Chapter 1, Section 23(c)(ii), of the WDEQ Water Quality Rules, which allow for temporary elevated levels of turbidity in certain circumstances. The applicant has applied for a U.S. Army Corps of Engineer 404 permit for the project.

Requests for information about the proposed temporary turbidity increase should be directed to Eric Hargett by email (eric.hargett@wyo.gov) or phone (307-777-6701). Pursuant to Chapter 5, Section 12 of the Wyoming Oil & Gas Conservation Commission Rules & Regulations, the written protest must state the grounds of the protest and include information and evidence to demonstrate that: (a) the protestant is a party entitled to notice or relief under Wyo. Stat. Ann. §§ 30-5-101 through 30-5-410; (b) the protestant seeks a remedy that is within the jurisdiction and authority of the Commission. No action shall be taken on an objection or protest that is not timely filed.
