NOTICE SETTING PUBLIC HEARING

1. Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given that a public hearing is scheduled regarding Rocky Mountain Power’s (RMP or the Company) request for authority to establish Final Low-Carbon Energy Portfolio Standards. The public hearing is set to commence on Thursday, September 19, 2024, at 9:00 a.m., in the Commission’s hearing room located at 2515 Warren Avenue, Suite 300, in Cheyenne, Wyoming.

2. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility, subject to the Commission's jurisdiction. WYO. STAT. §§ 37-l-101(a)(vi)(C) and 37-2-112.

3. On March 29, 2024, RMP filed its Application requesting the Commission authorize the Company to establish its proposed Final Low-Carbon Energy Portfolio Standards.

4. Wyoming Industrial Energy Consumers (WIEC), Powder River Basin Resource Council (PRBRC), and Jupiter Oxygen Corporation (JOC) petitioned to intervene in this matter, which the Commission granted by Order issued on April 30, May 14, and June 6, 2024. Office of Consumer Advocate is also a party under the provisions of Wyoming Statute §37-2-402(a).

5. A complete description of RMP’s Application and its supporting testimony and exhibits may be viewed at the Commission’s office during business hours or online at: https://dms.wyo.gov/external/publicusers.aspx (enter Record No. 17536).

6. All interested persons are encouraged to attend the public hearing which will be conducted in accordance with the Wyoming Administrative Procedure Act, Wyoming Public Service Commission Rules. OFFICIAL COUNTY COMMISSIONERS’ PROCEEDINGS

AUGUST 9, 2024

The Board of County Commissioners met in regular session in the Commissioners’ Meeting Room of the Sublette County Courthouse on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Dave Stephens, Mack Bradley, Jeness Saxton, Clayton Melinkovich, and Carrie Long, County Clerk, present. 

Chairman White led those present in the Pledge of Allegiance.

The agenda was amended on motion by Commissioner Noble, seconded by Commissioner Bradley to add an Executive Session (16-4-405(a)(iii) litigation.  Motion carried.

The minutes from the budget hearing on July 15th, and regular meeting on July 16th were approved and ordered filed on motion by Commissioner Noble, seconded by Commissioner Bradley. 

Billy Pape, Road & Bridge, met with the Board to update on department activities.  Pape requested direction regarding the sale of a loader to Hughes Enterprise.  Hughes bid was $2000 more than the offer from Caterpillar. The Board agreed to sell the loader to Hughes Enterprises. 

Pape also requested direction regarding the replacement of the sand shed.  Commissioner Bradley made a motion to approve the purchase in the amount of $340,500.  Commissioner Stephens seconded the motion.  Motion carried. 

Abe Pearce, Town of Pinedale, requested to purchase one of the vehicles the county would be putting in an auction.  Commissioner Stephens stated the vehicle in question would probably sell for about $3000.  The Board agreed to offer the vehicle to the Town of Pinedale for $3000.

Pape requested direction from the Board regarding reimbursing Jeremy Christensen for June payroll for Golf Course employees.  Commissioner Bradley made a motion to approve the reimbursement from the funds turned over to the county by the Golf Board.  Commissioner Noble seconded the motion.  Motion carried. 

Emily Paravicini, Treasurer, requested direction from the Board regarding a Certificate of Deposit in the Golf Board account in the amount of $25,754.29.  Commissioner Noble made a motion to turn the CD over to the Recreation Board.  Commissioner Bradley seconded the motion.  Motion carried. 

Pape informed the Board that most of the equipment at the golf course is not operational.  He presented a list of equipment necessary to maintain operation of the golf course. The total cost of equipment purchase for FY25 would be $94,900 and leased equipment would be $ 87,643.42.  Commissioner Noble made a motion to approve the proposal.  Commissioner Stephens seconded the motion.  Motion carried. 

Commissioner Noble made a motion to adjourn to Executive Session pursuant to W.S. 16-4-405(a)(iii) – litigation.  Commissioner Vickrey seconded the motion.  Motion carried. 

The Board resumed open session.  Commissioner Noble made a motion to accept the settlement agreement between Eiden Construction and Sublette County.  Commissioner Stephens seconded the motion.  Motion carried. 

Commissioner Vickrey asked Billy Pape about the gravel pit permit.  Pape stated that the permit is no longer active on any part of the Doyle Property. 

Peter Stinchcomb and Adam Hetrick from Wyoming Department of Transportation met with the Board to discuss the State Transportation Improvement Plan.

Matt Murdock and Matt Scanlon met with the Board to discuss the possibility of the purchase of land located next to the gun range for the purpose of a private enterprise converting natural gas to jet fuel.  The Board agreed they would be interested if Wyoming Business Council was also part of the project. 

Andre Irey, Maintenance, updated the Board on department activities. 

Grant Golden, Ice Arena, met with the Board to update on department activities.  He discussed in ice advertising and an advertising policy.  He also discussed adding a third-party vending machine at the ice arena.

Commissioner Noble made a motion to approve a quit claim deed for a portion of the Cora Cemetery.  Commissioner Stephens seconded the motion.  Motion carried. 

Commissioner Noble made a motion to approve the Enviremedial closing documents.  Commissioner Bradley seconded the motion.  Motion carried. 

Commissioner Bradley made a motion to approve the Aspen Grove lease between the County and Hospital District.  Commissioner Noble seconded the motion.  Motion carried. 

Commissioner Noble made a motion to approve the Telecommunications Sub-Lease Agreement #24-3-03 – White Pine Site.  Commissioner Stephens seconded the motion.  Motion carried. 

Commissioner Bradley made a motion to approve the TANF contract between the County and the Department of Family Services.  Commissioner Vickrey seconded the motion.  Motion carried.

Commissioner Bradley made a motion to approve the FAA Agreement regarding entitlement money.  Commissioner Noble seconded the motion.  Motion carried. 

Jeness Saxton, County Administrator, updated the Board on department activities.  She requested direction from the Board regarding her appointment to the Public Lands Steering Committee.  The Board was favorable with the appointment.

Commissioner Noble made a motion to appoint Roger McMannis as the Marbleton representative to the Visitor Center Board.  Commissioner Bradley seconded the motion.  Motion carried. 

Saxton requested direction from the Board regarding a scholarship deferral request from Addie Bennett.  The Board had no issue with the request. 

Commissioner Bradley thanked Saxton for her work with the Congressional Tour.   

Dennis Fornstrom, Planning & Zoning, presented a request to reclassify 33.40 acres from (A-1) Agricultural Zoning District to (RR-10) Rural Residential 10-acre District, which would allow for the creation a two lot Minor Subdivision. 

The Board members stated they had each considered the 10 findings per chapter 8, section 2 for a zoning change. 

Commissioner Noble made a motion to approve the zoning change from A1 to RR10.  Commissioner Stephens seconded the motion.  Motion carried. 

Commissioner Noble made a motion to vacate tract 9 of Bondurant Ranches and create Lots 1 & 2 of the Bray Minor Subdivision.  Commissioner Vickrey seconded the motion.  Motion carried. 

Fred Morris gave public comment. 

Commissioner Noble made a motion to approve accounts payable as presented.  Commissioner Bradley seconded the motion.  Motion carried.

Surety Bonds for Shannon Harris (Superintendent, SCSD#1), Tessa Manning (Treasurer, Silver Lake Irrigation District) and Owen Best (Treasurer, Shelter Park Improvement District), were approved on motion by Commissioner Noble, seconded by Commissioner Bradley.  Motion carried. 

Commissioner Bradley made a motion to approve a tax roll correction in the amount of $113.38 for 2023. Commissioner Noble seconded the motion.  Motion carried. 

County Assessor, Laila Illoway presented a Petition and Affidavit for Adjustment of Assessment Notice in the amount of $3,840,180,004.  Commissioner Noble made a motion to approve the corrected value.  Commissioner Stephens seconded the motion.  Motion carried.

The Town Council of the Town of Pinedale met in regular session on Monday, August 12, 2024, in the main conference room of the Pinedale Town Hall.

The meeting was called to order by Mayor Pro Tem Tyler Swafford at 5 p.m. Council members present:  Dean Loftus, Judi Boyce, and Scott Kosiba.  Those in attendance included: Max Lockett; Bill Mecham; Chad Kuhn; Jennifer Ricupero; Ed Wood, Town Attorney; Abram Pearce, Director of Public Works; Maureen Rudnick, Assistant Clerk; and Riley Wilson, Airport Manager. Attending online was Wes Werbelow, representing Ardurra Group.

Mayor Pro Tem Swafford led those present in the Pledge of Allegiance.

Motion by Councilman Loftus to accept the agenda as published. Seconded by Councilman Kosiba. Motion passed 4-0.

Jennifer Ricupero shared her safety concerns about a fence across Pine Creek.

Council discussed a request from Union Wireless to place a sign at 210 W Pine Street.

Motion by Councilman Loftus to approve the consent agenda items as published. Seconded by Councilman Kosiba. Motion passed 4-0. Consent agenda items approved were:  the transfer of extra 4th of July supplies to an open to the public lunch during STOL practice; naming Mayor Murdock as the WAM voting delegate and Tyler Swafford as alternate for the winter workshop business meeting to be held January 23, 2025; Fremont Lake water intake inspection and cleaning to be done by Fin Folk, LLC, in the amount of $8,548; water and wastewater flowmeter calibrations to be done by TDMA, in the amount of $3,000; and approval of Change Order No. 1 to the PNA SRE Procurement Project, exchanging tire chains for an extra set of 26” carbide plow cutting edges, in the amount of $530.31.

Motion by Councilman Kosiba to approve the Concurrence of Award for the S GA Apron Project, schedules 1, 4, and 5, to HK Contractors.  Seconded by Councilwoman Boyce.  Motion passed 4-0.

Council discussed a request from the Park and Tree Board to implement a requirement for subdivision developments to include green spaces within their plans.

Council reviewed the Unaudited Financial Statement for the period ending June 30, 2024.
