Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) for authority to maintain the tariff Schedule 198, Carbon Capture Compliance Charge, at 0.3 percent per month, as more fully described below:

1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers in its service territory consisting of parts of six states, including Wyoming. RMP is a public utility, subject to the Commission's jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.

2. On September 27, 2023, the Company filed its Application requesting authority to maintain the tariff Schedule 198, Carbon Capture Compliance Charge, at 0.3 percent per month to recover costs incurred to comply with Wyoming Statute §§ 37-18-101 and 37-18-102 and Commission Rule Chapter 3, Section 38, the HB200 low-carbon energy standards. The Company has incurred approximately $700,000 in planning, consulting, and reviewing expenses to meet HB 200 requirements.

3. The Application states no harm to customers comes from maintaining the current surcharge, and that RMP requests the Commission defer a prudency review of the incremental costs associated with the surcharge until a final 2024 plan is submitted via a separate Application in the future as actual costs versus estimated costs or Commission review may alter the final plan.

4. This is not a complete description of RMP’s Application. 3. The reports are required to be filed with the Commission for approval for RMP to establish baseline standards for electric reliability pursuant to Commission Rule, Chapter 3, Section 38(e) and Wyoming Statute §§ 37-18-101 and 102 (HB200, 2020).

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules and Special Regulations, notice is hereby given of the joint Application of Questar Gas Company dba Dominion Energy Wyoming (DEW or the Company) and Enbridge Quail Holding, LLC (Enbridge) for approval of the reorganization and sale of Fall West Holdco, LLC (Fall West) to Enbridge Quail Holdings, LLC.

1. DEW is currently a wholly owned subsidiary of Dominion Energy Questar Corporation, which itself is a wholly owned subsidiary of the parent company, Dominion Energy, Inc. The parent company, Dominion Energy Inc., is a Virginia corporation engaged in the business of supplying energy services in 16 states, including natural gas services in Utah, Wyoming, and Idaho. DEW serves approximately 28,000 customers in southwestern Wyoming, including customers in Rock Springs, Green River, Kemmerer, Diamondville, and Evanston. DEW is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-1-101(a)(vi)(C) and 37-2-112.

2. On September 5, 2023, DEW’s parent company, Dominion Energy, Inc., announced its intention to sell DEW, Wexpro Company, and other related entities to Enbridge, Inc. On September 8, DEW filed a joint Application for the partial reorganization and transfer of ownership of DEW to Fall West under Docket Nos. 30010-217-GA-23 and 30027-1-GA-23. On October 20, 2023, DEW filed a joint Application with Enbridge for approval of the sale and corporate reorganization of Fall West to Enbridge. DEW will remain under the regulatory jurisdiction of the Commission.

3. The Company states that the reorganization will not adversely affect DEW’s operations and ability to provide the public with safe and reliable utility service. Per the Application, no costs associated with reorganization will be allocated to Wyoming customers and the reorganization will not impact Wyoming customers’ rates.

4. This is not a complete description of the Application. Interested persons may inspect it at the Commission’s office in Cheyenne, Wyoming, during regular business hours. The Application may also be viewed online at: https://dms.wyo.gov/external/publicusers.aspx (Enter Record No. 17432).

The Board of County Commissioners met in regular session at the Marbleton Town Hall on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Dave Stephens, Mack Bradley, Jeness Saxton, Clayton Melinkovich, Joy Ufford via Teams Meetings representing the Pinedale Roundup, and Tanya McNeal, Deputy Clerk, present.

Chairman White led those present in the Pledge of Allegiance.

The agenda was amended on motion by Commissioner White to add a presentation to the Big Piney Library and special session pursuant to W.S. 16-4-405(a)(ix). 

The minutes of the previous regular Commissioner meeting held on October 3 were approved and ordered filed on motion by Commissioner Vickrey, seconded by Commissioner Noble.

Michelle Humbler from the Sublette County Library, presented a special recognition to the staff of the Big Piney Library as well as the library foundation and board for receiving outstanding Library of the Year. 

Billy Pape, Road & Bridge, updated the Board on activities. He has been working on the condition of the bike paths, compiling a list of the areas that require repair within the total 29.6 miles within the county. He asked the board to work with Mike Jackson, Rio Verde Engineering, using a GPS system to document what it might take to repair these bike paths in the county. Estimated cost for the engineering of this would be between $7500-9000,  to be completed by November 30. Commissioner Noble would like Billy to find out what the town might be responsible for with the bike paths. Commissioner Noble makes a motion to move forward with bike path engineering, with Rio Verde Engineering, not to exceed $9,000. Commissioner Vickery seconds, motion carried.

Commissioner White’s signature to the contract with HK Contractors for the North Piney project for $5,710,769.00 as approved from Commission meeting on September 5, 2023, presented by Mike Jackson, Rio Verde Engineering.

Dezi Saathoff, SAFV, reads the resolution to declare October 2023 as Domestic Violence Awareness Month. Motion to approve the resolution made by Commissioner Noble, seconded by Commissioner Bradley. Motion carried.

KC Lehr, Sheriff, was to present the update on the Facility Committee Discussion for the new justice center. In his absence, Jeness Saxton, County Administrator, presented the meeting minutes. The outcome of the meeting was that the new justice building would only include the justice departments, including Sheriff, jail, courts, etc. Discussion on several locations on where the location might be. Projected sites would need to be zoned into the town of Pinedale, and the justice center would need to be in the county seat. They are looking at Riley Johnston Architecture, who gave a proposal on scope of work. This scope of work would cost $10,000. Motion to move forward with the $10,000 to provide the scope of work by RJA to plan out the justice building, from Commissioner Vickery, Commissioner Bradley seconds, motion carried.

Shad Cooper, Fire Warden, updated the board on activities for September

Andre Irey, Maintenance, updated the board on projects and activities.

Commissioner Noble made a motion to adjourn to Executive Session pursuant to W.S. 16-4-405(a)(iii).  Litigation. Commissioner Vickrey seconded the motion.  Motion carried. 

The Board reconvened open session with no action from the Executive Session.  Commissioner Noble made a motion to adjourn to an Executive Session pursuant to W.S. 16-4-405(a)(ix).  Commissioner Bradley seconded the motion.  Motion carried.

Clayton Melinkovich, County Attorney, brought to the commissioners the Ad Valorem discussion. Emily Paravicini states that Jonah Energy would like to go to the monthly pay option, beginning in January 2024. The board of commissioners would like Paul with Jonah to come up with 3 different pay options and come back to the next meeting.

Ashley Wolicki from Jonah jointed in by Zoom for the NOVC discussion. Jonah owes the county $1,030,898.60 in Ad Valorem taxes due from 2015 and 2016. They are requesting the interest be levied based on the dates that Jonah was underpaid. Motion to change interest owed from Jonah from $1,181,951.27 to $741,971.53 by Commissioner Noble, seconded by Commissioner Bradley, motion carried.

Tonia Hoffman, Hospital District, with an update on activities. There has been a change in leadership. Lindsay Bond, former assistant to the administrator, is now acting interim administrator. Tonia had questions on the vouchers to be submitted for payment. Commissioner White states the vouchers are to be reviewed by County Clerk, Carrie Long, whom will then present to the Commission board for approval, before paying. Commissioner White addressed the change in leadership and concerns with the USDA with Tonia Hoffman, she assures they have been addressed. Karl Lueschow on the construction project, states the project is on schedule.

Accounts Payable in the amount of $3,941,578.80 was approved on motion by Commissioner Noble, seconded by Commissioner Vickery.  Motion carried.  Commissioner Bradley removed himself from the motion, due to an invoice from a family member.

Notice is hereby given that the Wyoming Game and Fish Department, has accepted as complete, according to plans, specifications, and rules governing the same, the work performed under that certain Service Contract 040CM0090892 between the Wyoming Game and Fish Department, whose address is: 5400 Bishop Blvd., Cheyenne, WY 82006 and Lyle Young Welding, whose address is:  PO Box 173, Gunnison, UT 84634 for the work performed, materials, equipment, or tools furnished or used and services rendered for the substantial completion of the Black Butte Hayshed Project located on the Black Butte Wildlife Habitat Management Area and the contractor is entitled to final settlement therefore; that the Wyoming Game and Fish Department will cause said Contractor to be paid the full amount due him under said contract on December 29, 2023.  The date of the first publication is November 17, 2023.
