WHEREAS, default in the payment of principal and interest has occurred under the terms of a Promissory Note (the "Note") dated December 20, 2021, executed and delivered by Don A. Urquhart and Ellna S. WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part thereof, nor has any such suit or proceeding been instituted and the same discontinued; and

HEARING

1. Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given that a public hearing is scheduled regarding Rocky Mountain Power’s (RMP or the Company) request for authority to increase its retail electric service rates by approximately $140.2 million per year or an average of 21.6 percent with rates effective January 1, 2024, and to revise the Energy Cost Adjustment Mechanism (ECAM). The public hearing is set to commence on Wednesday, October 25, 2023, at 9:00 a.m., in the Commission’s hearing room located at 2515 Warren Avenue, Suite 300, in Cheyenne, Wyoming.

2. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility, subject to the Commission's jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.

3. On March 1, 2023, RMP submitted an Application, together with supporting testimony, exhibits and revised tariff sheets, requesting the Commission approve the Company’s proposal to implement an increase in its retail electric utility service rates in Wyoming of $140.2 million per annum or an average overall increase of 21.6 percent and to eliminate the existing 80/20 sharing band and recover 100 percent of prudently-incurred, Wyoming-allocated net power costs using the existing ECAM in tariff Schedule 95, effective on and after January 1, 2024.

4. Wyoming Office of Consumer Advocate (OCA), Wyoming Industrial Energy Consumers (WIEC), Walmart Inc., Sierra Club, and Cale Case, PhD filed notice or petitioned to intervene in this matter, which the Commission granted via Order(s) issued on April 6th and 10th, 2023.

5. The Commission has held or scheduled Public Comment hearings in Rock Springs, Casper, Riverton, Laramie and Casper on July 17, August 24, September 18, September 25 and October 12, 2023 respectively.

NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules and Special Regulations, notice is hereby given of the joint Application of Questar Gas Company dba Dominion Energy Wyoming (DEW or the Company) and Fall West Holdco LLC (Fall West) for approval of a partial corporate reorganization.

1. DEW is currently a wholly owned subsidiary of Dominion Energy Questar Corporation, which itself is a wholly owned subsidiary of the parent company, Dominion Energy, Inc. The parent company, Dominion Energy Inc., is a Virginia corporation engaged in the business of supplying energy services in 16 states, including natural gas services in Utah, Wyoming, and Idaho. DEW serves approximately 28,000 customers in southwestern Wyoming, including customers in Rock Springs, Green River, Kemmerer, Diamondville, and Evanston. DEW is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-1-101(a)(vi)(C) and 37-2-112.

2. On September 5, 2023, DEW’s parent company, Dominion Energy, Inc., announced its intention to sell DEW, Wexpro Company, and other related entities to Enbridge, Inc. On September 8, 2023, Dominion Energy filed a joint Application with Fall West for approval of a partial corporate reorganization. In order to facilitate and streamline the sale of DEW and other entities, DEW will be transferred to Fall West, in preparation to be sold to Enbridge, Inc., which, if successful, will take place in a separate Application for Commission review to be filed at a later date.

3. The reorganization will not adversely affect DEW’s operations and ability to provide the public with safe and reliable utility service. Per the Application, no costs associated with reorganization will be allocated to Wyoming customers and the reorganization will not impact Wyoming customers’ rates. 

4. This is not a complete description of the Application. Interested persons may inspect it at the Commission’s office in Cheyenne, Wyoming, during regular business hours. The Application may also be viewed online at: https://dms.wyo.gov/external/publicusers.aspx (Enter Record No. 17413).

All persons, firms or corporations who have claims for work done or material furnished on such work are hereby notified that final payment will be made to said Contractor.

Payment will be made following the 41 st day of publication of this Notice if all requirements of the Contract Documents have been fulfilled. The Owner will pay the Contractor the full amount due under said contract after November 15, 2023.

CHAPTER 6, SECTION 2 OPERATING PERMIT - Department of Environmental Quality, Division of Air Quality PUBLIC NOTICE:  In accordance with Chapter 6, Section 2(g) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Williams Field Services Company to operate existing and future pigging facilities, not to be located at compressor stations or gas plants, with total emissions less than four (4) tpy of VOC, where each individual pig trap emits less than one (1) tpy of VOC, within the Big Piney Gathering Field of Sublette County, Wyoming. Williams Field Services Company requested that this proposed permit be issued for pigging activities in Sublette County only.  Therefore, this proposed permit will only apply to operations in Sublette County.  In the event Williams Field Services Company expands their operations outside Sublette County, a new pigging application shall be submitted at that time.

For the duration of the public notice period, the permit application, the agency’s analysis, and the public notice are available for public inspection online at https://openair.wyo.gov, utilizing facility ID F031017 and permit number P0036835 under permits. The Board of County Commissioners met in regular session in the Commissioners’ Meeting Room of the Sublette County Courthouse on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Dave Stephens, Mack Bradley, Jeness Saxton, Joy Ufford representing the Pinedale Roundup, and Carrie Long, County Clerk, present.

Chairman White led those present in the Pledge of Allegiance. 

The agenda was approved on motion by Commissioner Noble, seconded by Commissioner Bradley.

The minutes of the previous regular Commissioner meeting held on September 5 were approved and ordered filed on motion by Commissioner Vickrey, seconded by Commissioner Stephens.  Commissioner Noble abstained from voting. 

Billy Pape, Road & Bridge, updated the Board on activities.  Resolutions No. 23-100475W and 23-100474W were approved on motion by Commissioner Noble, seconded by Commissioner Vickrey.  Motion carried.

Commissioners discussed maintenance of existing bike paths and instructed Clerk Long to include further discussion on the next agenda for October 3.  Chairman White requested the Recreation Board and Towns be invited to the discussion. 

Jim Mitchell, Emergency Management, informed the Board that tree debris was lodged in the bridge on the Green River leading to the Upper Green River Improvement District and requested assistance from Road & Bridge in removing the debris.  The Board declined to assist in the removal of the debris due to liability concerns.   

Mike Jackson, Eric Sackett and Mark Eatinger, Rio Verde Engineering, updated on projects.

Maura Guthrie met with the Board with a request to purchase county property.  The Commissioners declined to sell the property in question. 

Shad Cooper, Fire Warden, updated on department activities.  He also presented the bids for the cleaning contract for some of the fire halls. Commissioner Noble made a motion to accept the bid from Karli Christensen with Peace of Mind, LLC.  Commissioner Vickrey seconded the motion.  Motion carried. 

Cooper also discussed a proposal from Amundsen Associates, LLC regarding timeline and research regarding the options for the Boulder Fire Station.  The proposal was in the amount of $39,000.  The consensus of the Board was to move forward with the proposal and review options. 

Andre Irey, Maintenance, updated on department activities.  Chairman White instructed Irey to move forward with bids for the Golf Course Building. 

Grant Golden, Ice Arena, updated on activities.  He requested directions on giving used equipment to other entities.  The Board instructed Golden to work with the County Attorney’s office in securing a contract for disposal of equipment. 

County Clerk, Carrie Long, presented the statement of receipts and expenditures in accordance with W.S. 18-3-515.  Commissioner Noble made motion to approve the Chairman signing the letter.  Commissioner Vickrey seconded the motion.  Motion carried. 

Dave Doorn, Hospital District, and Karl Lueschow updated the Board on construction progress. 

Linda Baker, Western Wyoming Community College, reviewed the Governor’s Proclamation that September 18-22, 2023 is National Adult Education and Family Literacy Week.

Dagan Mongomery, Extension Office, met with the Board to update on the Fair and activities. 

Andrea Jean, Human Resources, advised the Board she had renewed the annual medical and health benefits: BCBS, Standard, and Delta Denta.  She also updated on department activities. 

Accounts Payable was approved on motion by Commissioner Bradley, seconded by Commissioner Stephens.  Motion carried.

The Board adjourned for lunch at 12:15 p.m. and reconvened at 12:45 p.m. for Public Comment. Dan Smitherman, Mary O’Neal, Pat Burroughs, Marilyn Filkins, John Carter, Dan Bailey, Lisa Krawl, Gloria Thomas, Bill Conley, and Joy Ufford commented on notice of special meeting of the Planning & Zoning Board.

1. Dominion Energy is a division of Dominion Energy, Inc., a Virginia corporation engaged in the business of supplying energy services in 16 states, including natural gas services in Utah, Wyoming and Idaho. Dominion Energy is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37- 1-101(a)(vi)(D) and 37-2-112. Dominion Energy currently has approximately 28,110 customers in southwestern Wyoming, including customers residing in the cities of Rock Springs, Green River, Kemmerer, Diamondville and Evanston.

2. On March 1, 2023, Dominion Energy filed its Application requesting the Commission authorize the Company’s request to increase its distribution rates and charges for natural gas services by $2.1 million per annum, a return on equity of 10.3%, an overall rate of return of 7.28% and associated tariff amendments, effective January 1, 2024.

3. Wyoming Office of Consumer Advocate (OCA) filed a notice to intervene in this matter on March 2, 2023.

4. The effect of the proposed rate increase on typical Dominion Energy General Service customers who use 80 dekatherms per year will be an increase of $67 per year, or 6.5%.
