The Board of County Commissioners met in regular session at the Marbleton Town Hall on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Mack Bradley, Jeness Saxton, Clayton Melinkovich and Carrie Long, County Clerk, present.  Commissioner Dave Stephens was excused. 

Chairman White led those present in the Pledge of Allegiance. 

The proposed agenda was amended with the addition of a Resolution for a Special Prosecutor and approved on motion by Commissioner Noble, seconded by Commissioner Bradley. 

The prior meeting minutes of the regular Commission meeting held on August 1st and the Mill Levy meeting on August 7th were approved and ordered filed on motion by Commissioner Bradley, seconded by Commissioner Noble.

Billy Pape, Road & Bridge, updated the Board on activities.  He stated that he and Rio Verde are working with the Forest Service to try to get the Skyline project back on track.   

Eric Sackett, Rio Verde Engineering, updated on the Chip Seal project, Paradise overlay, and North Piney project. 

Commissioner Bradley stated that Keith Hughes from the Big Piney / Marbleton Airport Board would not be attending the meeting for the agenda item previously scheduled.  Clayton Melinkovich, County Attorney, reviewed options and restrictions by the FAA and BLM regarding the sale or lease of 80 acres common to the county Fairgrounds and the airport.  The consensus of the Board was to pursue the transaction as a possible purchase rather than a lease.

Clerk Long presented a Petition and Affidavit for Adjustment of Assessment Notice on behalf of Assessor Illoway.  Commissioner Noble made a motion to accept the petition as presented in the amount of -$80,751. 

Tax Roll Corrections from Hilcorp Energy Company for -$37,528.68 and -$10,696.77 were approved on motion by Commissioner Noble, seconded by Commissioner Vickrey.  Motion carried. 

Shad Cooper, Unified Fire, updated the Board on monthly activities.  He also discussed submission of a Public Notice for fire station cleaning contract services.  The county maintenance department could not meet the needs of the cleaning demands and contract services would be necessary.  The consensus of the Board was to allow the public notice.  There was no discussion. 

Andre Irey, Maintenance, updated the Board on activities.    

Commissioner Noble made a motion to adjourn as Board of County Commissioners and convene as the County Board of Equalization.  Commissioner Vickrey seconded the motion. 

Melinkovich informed the Board the individual involved in the tax protest had requested the hearing no longer occur.  It was moved by Commissioner Noble, seconded by Commissioner Vickrey to vacate the hearing scheduled for September 5.  Motion carried. 

Commissioner Noble made a motion to adjourn as County Board of Equalization and reconvene as the Board of County Commissioners.  Commissioner Vickrey seconded the motion.  Motion carried. 

Clayton Melinkovich, County Attorney, requested the Board approve a Resolution Appointing a Special Prosecutor.  Commissioner Vickrey made a motion to approve the Resolution, Commissioner Bradley seconded the motion.  Motion carried. 

Jeness Saxton, County Administrator, discussed scholarships with the Board.  The consensus of the Board was to cap individual scholarships at $1000 per semester. 

Saxton confirmed with the Board that since there had not been input regarding the proposed comments on the Rocky Mountain Power draft comments that the Board agreed with the comments.  The consensus of the Board was that the proposed comments were acceptable. 

Andrea Jean, Human Resources, and Cassie Crumpton, Treatment Court, met with the Board to request approval of a Narcan Policy (Sublette County Emergency Administration of Stock Opiate Antagonist Policy).  Treatment Court graduate, Warren, relayed his experiences with the Board.  It was moved by Commissioner Noble, seconded by Commissioner Bradley to approve the policy as presented.  Motion carried. 

Tiffany Monk, Tegeler’s Insurance, reviewed the Stop Loss Health Plan.  Commissioner Bradley made a motion to renew the Stop Loss Plan with Gerber Life.  Commissioner Vickrey seconded the motion.  Motion carried. 

Commissioners updated on Old Business.  There was no public comment.

The Wyoming Department of Environmental Quality (WDEQ) has received a request from Alder Environmental, LLC for a temporary increase in turbidity in Pine Creek in Pinedale, Wyoming. The temporary increase in turbidity is associated with bank stabilization.

Activity in cold water streams like Pine Creek is normally limited to a ten (10) NTU increase over background. Approval of this request would allow an exceedance of this limit for up to twenty-eight (28) total working days, subject to monitoring and reporting. This activity will follow the procedures in Chapter 1, Section 23(c)(ii), of the WDEQ Water Quality Rules, which allow for temporary elevated levels of turbidity in certain circumstances. The applicant has secured a U.S. Army Corps of Engineers 404 permit for the project.

The Town of Pinedale will sell the real property described as:

Lots One (1), Two (2), Three (3), Four (4) and Five (5), Block Four (4) of the Original Townsite of Pinedale, Sublette County, Wyoming as set out on the official map or that plat map recorded in the Office of the County Clerk of Sublette County, hereinafter referred to as the Property;

At public auction on the following terms:

A. The auction date and time shall be October 12, 2023, at 3  p.m. at the Pinedale Town Hall located at 205 Entertainment Lane, Pinedale, WY  82941.  The auction shall be a descending or reverse auction.  An opening price shall be set by the Town’s representative. After a period of one minute, the price shall be reduced by $10,000.  The price will continue to be lowered in steps until a Bidder accepts the current price offered or the Town declares the auction ended. The successful Bidder must tender a Cashier’s Check in the amount of $5,000 made payable to the Town within five minutes from the time the bid is announced as accepted by the Town.  This amount will be applied to the purchase price if the transaction closes or refunded to the successful Bidder if the transaction does not close as allowed by the terms of the Contract for Sale described in Section D above, otherwise the amount shall be non-refundable and retained by the Town.  If a successful Bidder does not tender the required Cashier’s Check within the required time limit, such bid shall be declared void and the bidding process shall be resumed.

F. The successful Bidder must deposit 5% of the bid amount, in addition to the $5,000 described in Section E above, with First American Title within ten (10) banking days of the auction date.  This amount shall be an earnest money deposit under the terms of the Contract for Sale described in Section D above.  If a successful Bidder does not tender the required 5% within the required time limit, the related bid shall be declared void and Town released from all obligations under the bidding process or the Contract for Sale described above.

G. Closing shall be at First American Title - Sublette County, Pinedale, Wyoming on or before 11/2/23.

H. The Town reserves the right to reject any and all bids, to disregard any irregularities in the bidding or sale process, to cancel the proposed sale prior to the sale date and time, to set a reserve minimum price, to terminate the auction at any time once the auction commences, and to resolve all questions of procedure or irregularity at its sole discretion.

I. The Property shall be conveyed subject to various deed restrictions on use.  These restrictions are included in the Informational Sale Packet described in Section B above.
