NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) for authority to revise Rules 5 and 10 to protect the integrity of the Company’s service territory, as more fully described below:

1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility subject to the Commission's jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.

2. On January 5, 2024, the Company filed an Application requesting the Commission approve revisions to Rule 5, regarding Customer Installation, and Rule 10, regarding Disconnection of Service. RMP states the revisions address the consumption of electricity purchased from the Company and transmitted beyond the tariffed service territory by way of customer owned infrastructure located behind the meter. The Company states these revisions will preserve its service territory integrity as well as that of other adjacent utilities.

3. Previous settlements and allocation agreements resolved similar situations in the past. However, RMP is concerned about the potential recurrence of the same situation with no explicit authority to address such instances in the approved tariffs. Accordingly, the Company requests the proposed revisions to address such occurrences.

4. The proposed revision to Rule 5 allows RMP to address customer owned electrical infrastructure that transmits electricity purchased from RMP beyond the Company’s authorized service territory. Specifically, the proposed tariff requires the customer to remedy the issue, enter into a Customer Allocation Agreement, or pay a Service Territory Extension Fee.

5. The proposed revision to Rule 10 allows RMP to disconnect service, after notice, if the customer fails to remedy the issue as required in Rule 5.

6. This is not a complete description of RMP’s Application. The Board of County Commissioners met in regular session in the Commissioners’ Meeting Room of the Sublette County Courthouse on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Dave Stephens, Mack Bradley, Jeness Saxton, Clayton Melinkovich, Joy Ufford, representing the Pinedale Roundup (via Teams Meeting) and Carrie Long, County Clerk, present. 

Chairman White led those present in the Pledge of Allegiance.

Commissioner Noble made a motion to approve the agenda with the addition of an Executive Session during the County Attorney portion of the meeting.  Commissioner Bradley seconded the motion.  Motion carried. 

In accordance with W.S. 8-4-101, the following holidays were adopted for 2024:  Monday, January 15, Martin Luther King, Jr. Birthday and Wyoming Equality Day; Monday, February 19, President’s Day; Monday, May 27, Memorial Day; Thursday, July 4, Independence Day; Monday, September 2, Labor Day; Monday, October 14, Columbus Day; Monday, November 11, Veteran’s Day; Thursday and Friday, November 28 & 29, Thanksgiving; Tuesday & Wednesday, December 24 & 25, Christmas Eve and Christmas; Wednesday, January 1, 2025, New Year’s Day; on motion by Commissioner Bradley, seconded by Commissioner Noble.  Motion carried. 

The minutes of the previous meeting on December 19, 2023, were approved and ordered filed, on motion by Commissioner Noble, seconded by Commissioner Bradley. 

The Board approved the meeting schedule of 2024 on motion by Commissioner Bradley, seconded by Commissioner Noble, with meetings being the 1st and 3rd Tuesday of the month except for the first meeting in February to be held on Friday, February 2; meetings in August to be held on the 9th and August 23rd, and the first meeting in November to be held on November 8.  Budget workshops will be held June 5 through June 7, with the June 5th meeting in Marbleton.  The meetings of March 19, August 23, and October 15 are to be held in Marbleton. 

In accordance with W.S. 18-3-517, Commissioner Noble made a motion to designate the Pinedale Roundup as the official newspaper.  Commissioner Vickrey seconded the motion.  Motion carried.

In accordance with W.S. 18-3-516(f), Commissioner Noble made a motion to notice county information on the county website at www.sublettecountywy.gov.  Commissioner Bradley seconded the motion.  Motion carried. 

Billy Pape, Road & Bridge, updated the Board on department activities.  He requested a signature from Chairman White on grants for striping and delineators.  Commissioner Noble made a motion to approve the grant applications.  Commissioner Bradley seconded the motion.  Motion carried.   

The Board reviewed the petition for the Daniel Mosquito Abatement District.  The 30-day protest period ended on December 21, 2023, with no protests or modifications filed.  In accordance with W.S. 22-29-109(f), it was moved by Commissioner Bradley, seconded by Commissioner Stephens to approve the petition, declaring the formation of the Daniel Mosquito Abatement District, and directing the question of formation of the district be submitted to the electors, by mail ballot, on May 7, 2023.  Motion carried. 

Andre Irey, Maintenance, updated the Board on department activities. 

Chris Lacinak met with the Board to discuss the Strategic Planning process.  He was invited by Commissioner Bradley to participate in the meetings and offer his input. 

Mike Vickrey, Green River Valley Cattlemen’s Association — updated the Board on meetings he attended regarding the Colorado River Compact.  He was asked to give an update along with members of the water committee at a March meeting. 

Gary Hayward was appointed to a 5-year term to the Fair Board on motion by Commissioner Noble, seconded by Commissioner Bradley.  Motion carried.

Todd Stevie was appointed to a 3-year term to the Ag Center Board on motion by Commissioner Noble, seconded by Commissioner Vickrey.

Carmel Kail was appointed to a 3-year term to the Historic Preservation Board on motion by Commissioner Noble, seconded by Commissioner Vickrey.  Motion carried. 

Roger Weber and Terry Cain were appointed to 5-year terms on motion by Commissioner Noble, seconded by Commissioner Bradley.  Motion carried. 

Alex Truluck was appointed to a 3-year term on the Predator Board on motion by Commissioner Noble, seconded by Commissioner Bradley.  Motion carried 4 to 1 with Commissioner Vickrey voting nay. 

The Board directed Jeness Saxton, County Administrator, to schedule board member training as required by the Department of Audit. 

Clayton Melinkovich, County Attorney, presented two applications for an exemption of monthly Ad Valorem payments by Exxon and XTO, both of which attached bonds.  Commissioner Bradley made a motion to approve the XTO application.  Commissioner Noble seconded the motion.  Motion carried.  Commissioner Noble made a motion to approve the Exxon application, Commissioner Bradley seconded the motion.  Motion carried.

Commissioner Noble made a motion to approve the MOU with Wyoming Health Fairs and to approve the Workforce Development Grant as presented by Public Health.  Commissioner Stephens seconded the motion.  Motion carried. 

Commissioner Noble made a motion to adjourn to Executive Session pursuant to W.S. 16-4-404(a)(iii) — litigation.  Commissioner Stephens seconded the motion.  Motion carried. 

Open session resumed with no action from the Executive Session. 

Andrea Jean, Human Resources, updated the Board on department activities and requested direction on performance reviews of the 11 employees the Board oversees.  An afternoon Executive Session for February 20th was chosen as the time to conduct the reviews. Jean also requested that all performance reviews be completed by the end of March.   

Jeness Saxton updated the Board on department activities. 

Accounts payable was approved as presented on motion by Commissioner Noble, seconded by Commissioner Vickrey.  Motion carried.

Laila Illoway, County Assessor, presented two Tax Corrections.  An adjustment for -$4,505.27 for Hilcorp Energy and an adjustment for a special district fee improperly assessed were approved on motion by Commissioner Vickrey, seconded by Commissioner Bradley.  Motion carried. 

Surety Bonds for Deborah Vickrey (Treasurer, Boulder Irrigation District); Rand Rhodes, Jr. (Treasurer, High Meadow Ranch Water District); and Cat Urbigkit (Secretary/Treasurer, Sublette Predatory Board) were approved on motion by Commissioner Noble, seconded by Commissioner Vickrey.  Motion carried. 

Commissioners updated on old business.  Chairmen White requested Clerk Long schedule a time to discuss the Mill Street parking issue with the parties involved at the next Commissioner meeting.

The Wyoming Public Service Commission (Commission) approved the Application of Questar Gas Company, d/b/a Dominion Energy Wyoming (Dominion) to amortize the Energy Efficiency Services deferred account balance, resulting in a decrease of $0.01642 per Dth, effective for usage on and after January 1, 2024. The proposed change is based on customer participation in several energy efficiency programs offered by the Company.

Dominion’s proposal results in an annual decrease of $1.32 or 0.12% before taxes, for a typical residential customer using 80 Dth. However, when combined with other proposed rate changes taking effect on January 1, 2024, the net result is an increase of $10.65 or 0.98% before taxes, for a typical residential customer using 80 Dth annually. Actual bills will vary with usage.

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) for a Deferred Accounting Order to record a regulatory asset associated with incremental costs related to third-party liability in excess of $10 million dollars, as more fully described below:

1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility subject to the Commission's jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.

2. On December 18, 2023, pursuant to Wyoming Statutes §§ 37-2-112 and 37-2-115, the Company filed an Application requesting the Commission issue a Deferred Accounting Order to record and defer a regulatory asset associated with incremental costs from increased premiums for third-party liability insurance, specifically wildfires. The deferral is for possible future recovery of costs.

3. RMP states wildfire liability risk, like that associated with the third party claims from the September 2020 Oregon wildfires, are impacting the commercial insurance markets resulting in increased premiums. RMP additionally states that insurance is a required and prudent business expense. The costs identified, accounted for, and tracked are the total-Company insurance coverage costs that exceed the Company’s $10 million allocated costs included in the approved rate tariff.

4. RMP is not currently seeking recovery of these costs from customers. The requested Deferred Accounting Order, if approved, will enable the Company to seek recovery in the future. If approved, deferred costs will be recorded in Federal Energy Regulatory Commission (FERC) Account 182.3. Concurrent dockets, related to or in support of this filing, are pending review by the Commission.

5. The total amount of the potential deferral is unknown. Current liabilities are estimated at approximately $122.4 million. Deferred accounting permits the Company to track the expenses resulting from increased excess liability related insurance premiums for potential future recovery.
