Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given that a public hearing is scheduled regarding Rocky Mountain Power’s (RMP or the Company) request for authority to increase rates to recover deferred Net Power Costs (NPC) under Tariff Schedule 95; and to increase rates pursuant to Tariff Schedule 93, Renewable Energy Credits (RECs) and Sulfur Dioxide (SO2) emission allowances. The public hearing is set to commence on Tuesday, December 3, 2024, at 9:00 a.m., in the Commission’s hearing room located at 2515 Warren Avenue, Suite 300, in Cheyenne, Wyoming.
2. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility, subject to the Commission's jurisdiction. WYO. STAT. §§ 37-l-101(a)(vi)(C) and 37-2-112.
3. On April 15, 2024, RMP filed an Application requesting authority to revise rates pursuant to two different rate schedules. The Company proposes to increase its Tariff Schedule 95 Energy Cost Adjustment Mechanism (ECAM) rates by approximately $84.3 million to recover deferred NPC. On June 19, 2024, the Company filed an Errata Application which lowered the requested increase of Tariff Schedule 95 to $81.8 million. The Company also proposes to increase its Tariff Schedule 93 REC and SO2 Revenue Adjustment Mechanism (RRA) rates by approximately $2.1 million to account for sales of RECs and SO2 emission allowances.
4. Wyoming Industrial Energy Consumers (WIEC) and Office of Consumer Advocate (OCA) intervened and requested a hearing. On June 25, 2024, the Commission granted interim approval of the proposed rates in the Errata Application, effective for usage on and after July 1, 2024, subject to further review, refund and hearing.

The Board of County Commissioners met in regular session at the Marbleton Town Hall on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Dave Stephens, Mack Bradley, Jeness Saxton, Clayton Melinkovich (via Teams), and Carrie Long, County Clerk, present.
Chairman White led those present in the Pledge of Allegiance.
The agenda was amended by Commissioner Vickrey to change the wording on the Bondurant Fire Hall Discussion from discussion of ‘public accesses’ to that of ‘county entities’. He also requested to add Public Discussion at the end of the agenda and to add a Fire Ban Discussion. Commissioner Bradley seconded the motion. Motion carried.
The minutes from the previous meeting held on October 1, 2024, were approved and ordered filed on motion by Commissioner Vickrey, seconded by Commissioner Stephens.
Billy Pape, Road & Bridge, updated the Board on activities for Road & Bridge, Waste Management and Golf Course. He stated that he had hired a greens person for the golf course who will be starting November 1st.
Eric Sackett updated the Board on projects. He stated the East Green River project will be delayed until next Spring.
Andre Irey, Maintenance, updated the Board on department activities.
Shad Cooper, Fire Warden, met with the Board via Teams to give the monthly update. He stated the county had received reimbursement funds for 5 of the federal fires they had assisted with.
Commissioner Bradley stated that regarding access to the Bondurant Fire Department by county entities, he had discussed the issue with the Sheriff’s department and Road & Bridge and neither department had an issue with contacting Unified Fire if they needed access to the building. Commissioners Vickrey and Stephens disagreed. Chairman White and Commissioner Noble stated the departments should be able to work it out between themselves. The consensus was that the matter is closed.
Cooper also discussed the process for declaring a fire ban which involves State and Federal agencies who have the resources and scientists qualified to make the decision on declaring a fire ban. Cooper stated that as Fire Warden, he would follow the recommendation of the agencies involved.
Commissioner Vickrey made a motion to put a fire ban on private lands in Sublette County until significant moisture occurs. Commissioner Stephens seconded the motion. County Attorney, Clayton Melinkovich, informed the Board they did not have the authority to impose a fire ban, that a recommendation for a fire ban could only come from the county fire warden.
After discussion, Commissioner Vickrey amended his motion to change the ban to a proclamation discouraging outdoor fires. Commissioner Stephens seconded. Motion carried.
Jim Robinson, Mayor – Town of Marbleton, met with the Board to discuss proposed expansion of camping facilities at the Fair Grounds. He stated that when the expansion occurs, the Town of Marbleton will need to reflect increased fees in sewage usage.
Dennis Fornstrom, Planning & Zoning, met with the Board to discuss proposed changes to the Planning & Zoning Regulations. After discussion on whether Fornstrom should move forward with the changes to the regulations or go back to the Comprehensive Plan, the consensus of the Board was to move forward with the changes to the Planning & Zoning Regulations.
Janna Lee, Public Health, met with the Board to discuss funding and opportunities for health care for uninsured or underinsured women in Sublette County. The Board was favorable to the proposal.
Clint Gilchrist, Museum of the Mountain Man, met with the Board to discuss the museum’s capital funding activities and options for county involvement in the fundraising efforts. Commissioner Noble made a motion to allocate $1 million dollars to the Museum Board by moving the money from the Museum Reserve Depreciation Account and transfer to the Museum. Commissioner Bradley seconded the motion. Motion carried.
Clayton Melinkovich, County Attorney, met with the Board to discuss an application from the Manning family to enlarge a portion of the Colorado Ditch. Tesa Manning was present via Teams. After discussion, Commissioner Vickrey made a motion to file a protest regarding the expansion in order to conduct more research into the repercussions of water flow to the golf course. Commissioner Stephens seconded the motion. Motion carried 4 to 1 with Commissioner Bradley voting nay.
Jeness Saxton, County Administrator, updated the Board on activities. Commissioner Noble made a motion to approve a letter written by Rio Verde regarding the Skyline Drive project. Commissioner Vickrey seconded the motion. Motion carried.
Morgan Faber and Sue Holtz, representing Foundation 23, updated the Board on the foundation’s fundraising efforts and the history and goals of the organization.
