SUMMARY:
The Bureau of Land Management (BLM), Pinedale Field Office, examined and found suitable for classification for conveyance under the provisions of the Recreation and Public Purposes (R&PP) Act, as amended, approximately 34.87 acres of public land in Sublette County, Wyoming. The Upper Green River Cemetery District Wind River Cemetery filed an application to develop the land as a cemetery that will help meet existing and future expanding needs in Sublette County. The BLM is seeking public comments as to the suitability of public lands for conveyance under the R&PP Act.

Interested parties may submit written comments regarding the proposed classification conveyance of the land until June 15, 2026.

SUPPLEMENTARY INFORMATION:
The R&PP Act allows the BLM to convey public lands to local governments for development of other public purposes if the identified lands are not needed for any Federal purpose and the conveyance is consistent with approved BLM land use plans. The subject parcel is located near the Town of Pinedale in Sublette County, Wyoming and is legally described as:

T. 33 N., R. 109 W.,
Sec. 9, lot 4.
The area described contains 34.87 acres, according to the official plats of survey of said land, on file with the BLM.
All interested parties will receive a copy of this notice once it is published in the Federal Register . A copy of this notice will also be published in the newspaper of local circulation once a week for 3 consecutive weeks.
Upon publication of this notice in the Federal Register , the land described above will be segregated from all other forms of appropriation under the public land laws, including the general mining laws, except for conveyance under the R&PP Act, leasing under the mineral leasing laws, geothermal leasing laws, and disposals under the mineral material disposal laws.
The conveyance documents, if issued, would be subject to the provisions of the R&PP Act, to all applicable regulations of the Secretary of the Interior and the following conditions:
(1) A right-of-way thereon for ditches or canals constructed by the authority of the United States, Act of August 30, 1890 (43 U.S.C. 945);
(2) All minerals shall be reserved to the United States, together with the right to prospect for, mine, and remove such deposits for the same under applicable law and such regulations as the Secretary of the Interior may prescribe;
(3) Terms or conditions required by law (including, but not limited to, any terms or conditions required by 43 CFR 2741.4 and as deemed necessary or appropriate by the Authorized Officer);
(4) An appropriate indemnification clause protecting the United States from claims arising out of the patentee's use, occupancy, or operations on the patented lands; and
(5) Subject to valid existing rights.
Interested parties may submit written comments regarding the specific use proposed in the applications, plan of development (POD), site plans, and whether the BLM followed proper administrative procedures in reaching the suitability for classification to convey under the R&PP Act. Comments may also address the suitability for classification of the lands and whether the land is physically suited for the proposal, whether the use will maximize the future use or uses of the land, whether the use is consistent with local planning and zoning, or if the use is consistent with State and Federal programs.
The proposed R&PP subsequent conveyance is consistent with the BLM Pinedale Resource Management Plan, dated November 26, 2008. The BLM prepared a parcel-specific Environmental Assessment (EA), document number DOI-BLM-WY-D010-2025-0090-EA, in connection with this realty action. It can be viewed at our online ePlanning website at https://eplanning.blm.gov/eplanning-ui/project/2040144/510. Other pertinent information related to the project such as the POD and maps will also be made available for review on the ePlanning website. Comments received during the comment period will be considered in reaching a decision regarding conveying the lands under the R&PP Act.
Before including your address, phone number, email, address, or other personal identifying information in any of your comments, you should be aware that your entire comment, including your personal identifying information, may be made publicly available at any time. While you can ask us in your comment to withhold your personal identifying information from public review, we cannot guarantee that we will be able to do so.
Any adverse comments received will be considered protests and will be reviewed by the BLM Wyoming State Director, who may sustain, vacate, or modify this realty action. In the absence of any adverse comments to the NORA, the classification of lands will become effective 60 days from the date of publication of this notice in the Federal Register . In the absence of any adverse comments to the EA, a decision will be made in response to the R&PP application and will be posted on the ePlanning website. The lands will not be available for lease and conveyance until after the decision becomes effective.

NOTICE
Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules and Regulations, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) for approval of the 2027-2029 3-year demand side management (DSM) plan and to adjust tariff Schedule 191, as more fully described below.
1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-1-101(a)(vi)(C) and 37-2-112.
2. On May 19, 2026, RMP filed an Application, pursuant to tariff Schedule 191, requesting the Commission approve: the 3-year DSM plan, effective January 1, 2027; a 1-year extension to the Commercial and Industrial Demand Response program (C&I DR program); the transition of the Battery DR program from Schedule 191 to Schedule 114; and the modifications to Schedule 191 surcharge rates to align with the proposed 3-year DSM plan. The Company states in the Application that the 3-year DSM plan is to create transparency, rate stability and certainty, and to enable the Company to manage DSM targets and budgets.
3. In its Application, RMP proposes to continue the batteries installation incentive programs for residential customers (Category 1) and non- residential small general service customers (Category 2 and 3), and to extend the C&I DR program for 1 year through 2029. RMP states this is due to the success and participation in the programs, anticipated growth, and to maintain alignment with the DSM 3-year plan. RMP notes the C&I DR program structure and offerings are to remain materially the same and no changes to the C&I DR program are anticipated.
4. RMP proposes transitioning the Battery DR program from the DSM plan to Schedule 114 to align with the C&I DR program and redesignate Category 3 costs as recoverable from all customer classes under the Schedule 191 DR rate, effective January 1, 2027, per the Stipulation and Agreement in Docket No. 20000-670-ET-24.
5. The Company also proposes revisions to Schedule 191, decreasing Category 1 and 2 rates to 0.80 percent and 1.87 percent, respectively, and to revise the rate for Category 3, including the remainder of 2026, to 3.12 percent, effective January 1, 2027. The Company estimates an over-collected balance of $9.2 million through December 2029. To remedy the over collected balance, RMP proposes to decrease the DR rate to 0.24%, effective January 1, 2027, through December 2029. The Company notes additional surcharge rate adjustments can be made to ensure Schedule 191 remains aligned with the 3-year DSM plan.

Billy Pape, Road and Bridge provided updates on departmental activities. Billy presented with Abe Pearce, Town of Pinedale and Eric Sackett, Rio Verde Engineering a project for East Lake Rd. requesting a federal grant match for $953,565. The Town of Pinedale needs support from the county to finish filing the application. Commissioner White moved to partner up with the Town of Pinedale to apply for the E. Lake CR 23-186, 80/20 grant, seconded by Commissioner Bradley. Motion carried 5-0. Commissioner Bradley moved to sign the contract between Sublette County and M&M Transfer, seconded by Commissioner Vickrey. Motion carried 5-0. Commissioner White moved to sign a primary contact authorization form, allowing for Billy Pape, Rowna Williams, Kelsi DeSchneau to be contacts for the Liquor Division, seconded by Commissioner Bradley. Motion carried 5-0. Commissioner Bradley moved to allow $250 for the cash drawer for the bar sales at the Gold Course, seconded by Commissioner White. Motion carried 5-0. Commissioner White moved to approve the lease for $800 a month between Sublette County and Mary Lou Araya for the operation of the restaurant at the Golf Course, seconded by Commissioner Stephens. Motion carried 5-0. Clayton Melinkovich and Billy presented the Rim Road easement. The board is not pleased with the language on the easement and asked Clayton to work on it and bring it back at a future meeting.
Janna Lee, Public Health Director, presented the contracts between the State of Wyoming and the county. Commissioner Bradley moved to approve the nursing contract between the State of Wyoming and the county for two years, seconded by Commissioner Vickery. Motion carried 5-0.
Shad Cooper gave an update on Fire Department activities.
Hayley Ruland, Planning and Zoning Administrator, presented the proposed fee schedule that was advertised online, in the newspaper and throughout the courthouse. Commissioner White moved to approve resolution 26-100529B adoption of new planning and zoning fees, seconded by Commissioner Stephens. Motion carried 5-0. Commissioner White moved to approve resolution 26-100526B Zone Change by Casey and Cybil Johnson, and resolution 26-100527B adopting an application by Union requesting a conditional use and variance to construct a 120-foot wireless communications tower, and resolution 26-100528B a request by Double J Family Ranch Parcel, LLC Zone Change, seconded by Commissioner Vickery. Motion carried 5-0. Hayley and Clerk Rice discussed the MRG grant and where we need to place the $149,000 in the FY27 budget. The board wants it placed under the general accounts, named Comprehensive Plan. Also discussed were the Enviremedial restricted funds and the usage for the comprehensive plan. The board will revisit this discussion after the grant has been awarded.
Clayton Melinkovich presented a records fee schedule. Commissioner White moved to approve resolution 26-100525B resolution for a public records fee schedule, seconded by Commissioner Bradley. Motion carried 5-0. Clayton Melinkovich presented the resolution for a 1% general purpose sales tax. Commissioner White moved to approve resolution 26-100530B inclusion of the sales tax question on the ballot, seconded by Commissioner Bradley. Motion carried 5-0. Chairman Bernard voiced an apology that he had shared with constituents that it would not be on the Primary. Commissioner White moved to approve resolution 26-100524B, establishing the salaries of elected official salaries, commencing Jan. 5, 2027, seconded by Commissioner Vickrey. Motion carried 5-0. Clayton presented a special event application for the vendor fair from WYDOT. Commissioner Bradley moved to approve the signature on the special event vendor fair July 8-12, seconded by Commissioner White. Motion carried 5-0. Commissioner White moved to go into executive session, seconded by Commissioner Vickrey 16-4-405(a)(ix) personnel file purposes. Commissioner White moved to allow Andrea Jean, Human Resources and Clerk Rice to use and report the Department Head salaries discussed for the FY27 budget, seconded by Commissioner Bradley. Motion carried 5-0.
Chairman Bernard gave an update on the Antelope Migration Corridor comments to be sent to the Governor. The other board members voiced their opinions on the future of the project and the board’s involvement moving forward. Commissioner White, Vickrey and Bradley would like Chairman Bernard to relay to the committee that decisions involving private land issues should be made by the Board of County Commissioners not any state agency. Public comment given by Bob Dexter who commented that wildlife adapts to their environment.
Fire Chief Cooper, along with BLM members Ross Dary, Ben Smith, Dave Richie, and Cary Swain with the Forest Service were summoned to educate the board on the fire danger for the coming season and what prevention efforts are in order since Sublette County had such a dry winter. Cary suggested that we utilize the wildlife-crossing road signs to flash fire dangers during the fire season. Ross suggested that dispatch a digital tool to use with the sign board to see where restrictions are. Ross is effort to include fire restrictions on digital tools like OnX. Dave suggested promoting educating fire danger to our youth through the schools’ public announcements. The board requested Jeness Saxton notify the schools to put out an announcement of the fire danger. The board directed Chairman Bernard to contact Emergency manager Steve Kipp to discuss putting up signage around the county. Shad presented the District 4 Annual Operating Agreement. Commissioner White moved to approve the agreement, seconded by Commissioner Bradley. Motion carried 4-1, Commissioner Vickrey opposed.
Commissioner Bradley moved to approve bonds for Marilyn Jensen, Shannon McCormick, and Skylar Wilson, seconded by Commissioner Vickrey. Motion carried 5-0.
Leanne Parks and Craig Hadfield from Proactive have secured an investor to pay $725,000 for the property at 317 Faler Ave. This includes the building and the parking lot. The investor will complete the repairs that the county maintenance determined to be $75,000. The county would need to submit a partial vacation of the plat with the town for about $5000 to move the boundary line for the remainder of the property. Commissioner Vickery and White are comfortable with moving forward with the offer. Commissioners Bernard, Stephens and Bradley would like a higher offer. Commissioner Stephens recommended $800,000, and Chairman Bernard would like Leanne and Craig to ask their investor if they are willing to accept that offer. The board directed Clayton to contact the Hospital to get repairs for the Public Health building completed.
In old business Commissioner Vickrey discussed the 4-H and Mesa lease. Commissioner Vickrey read an e-mail from John McKinley regarding the motion that the UW board of trustees passed on May 14th for the 4-H Educator’s salary. The motion states that their board approves increasing the salary of the 4-H educator by a maximum of $10,000 with a dollar-for-dollar county match. The board will have Clayton draw up an MOU with UW.
Leanne Parks returned to the meeting after speaking with their investor and they do not want to accept the $800,000 offer. Leanne needs reassurance that Proactive will be able to reside in the building while they look for a new place. The board will have Clayton draw up a new one-year contract to sign at the next meeting. Commissioner Bernard would like Proactive to consider paying rent of $64,800 towards the purchase price of $800,000, to owe the balance of $735,200, and respond within 60 days. Leanne would like to get the lease reassurance of a year and will respond to Chairman Bernard’s offer once that assurance is in place.
Public Comment given by Bob Dexter asking about the GIS payment history being only 5 years versus 20. The Treasurer assured Mr. Dexter that the records are still there under the advanced search option. Bob also would like the election to be a total hand count versus using the machines. The board would like Clerk Rice to investigate options and respond to Mr. Dexter. Commissioner White said that the WCCA will give a break on fees this year due to a drop in assessed valuation.
Commissioner Bradley moved to adjourn, seconded by Commissioner Vickery. Motion carried 5-0.

ANNOUNCEMENT
The Wyoming Water Development Commission (Commission) was awarded a Regional Conservation Partnership Program (RCPP) grant from the U.S. Department of Agriculture (USDA) Natural Resources Conservation Service (NRCS) to provide drought resiliency through enhanced water management in the Upper Colorado River Basin in Wyoming, which includes the Green River and Little Snake River watersheds. The Wyoming Water Development Office (Office) has authority to administer the RCPP grant #3207 on behalf of the Commission. The Office, NRCS, and contributing partners will assist producers and Water Management Entities (WMEs) through the RCPP process with their NRCS Conservation Practices, such as installing sprinklers, converting open canals to pipe, improving diversions, lining conveyances, bank stabilization, etc. WMEs apply directly to the Office for subawards, while producers apply to NRCS for cost- share reimbursement.
