The Upper Colorado River Commission (UCRC) hereby issues this Request for Proposals (RFP) Number 2025-02-DTWG-UCRC to enhance diversion measurement and telemetry in the Upper Colorado River Basin in Wyoming. This work will involve the Wyoming State Engineer’s Office, known hereafter as Projects Manager, and UCRC staff, and will contribute to technical efforts being undertaken by the Upper Division States of Colorado, New Mexico, Utah, and Wyoming.

II. CONTRACT OBJECTIVES
The Upper Colorado River Commission (UCRC) is an interstate water administrative agency established by action of five state legislatures and Congress with the enactment of the 1948 Upper Colorado River Basin Compact. The UCRC’s role is to ensure the appropriate allocation of water from the Colorado River to the Upper Division States (UDS) of Wyoming, Colorado, Utah, and New Mexico and to ensure compliance with the 1922 Colorado River Compact. The UCRC seeks to promote interstate comity, remove causes of present and future controversies, and to assure the storage of water and agricultural and industrial development of the Upper Basin.
On November 15, 2021, President Biden signed the Infrastructure Investment and Jobs Act (IIJA), sometimes referred to as the Bipartisan Infrastructure Law or BIL. The IIJA allocates $8.3 billion through Fiscal Year 2026 for the United States Bureau of Reclamation (Reclamation) to fund western water infrastructure Projectss. Specifically, $50 million is authorized to implement the Upper Colorado River Basin Drought Contingency Plan (DCP).
In support of the activities contemplated under the DCP, the UCRC and the UDS identified priority infrastructure and Projects needs and have directed funds to increase measurement and monitoring capabilities throughout the Upper Basin. Specifically, at the UCRC’s 309th Special Meeting on October 28th, 2024, the UDS Commissioners directed $16 million of IIJA funding towards enhancing diversion measurement and telemetry throughout the Upper Basin. This initiative supports an improved understanding of water supply, uses, shortages, efficiencies, and conveyance in the Upper Colorado River Basin mainstem and tributaries (DCP Implementation Needs #2, #7).
The UCRC, as Contract Manager, and the Wyoming State Engineer’s Office, as Projects Manager, jointly referred to as the UCRC Program Team, wish to contract professional services to enhance diversion measurement and telemetry in the Upper Colorado River Basin in Wyoming (the Program). The Projects will provide technical and administrative support to implement diversion and telemetry improvements in Wyoming using IIJA funding. The contractor will work under the direction of the UCRC Program Team. The Projects Manager will coordinate input and guidance from the UCRC to the contractor.
The UCRC Program Team has identified six Contract Objectives for the Projects:
1. Provide program development support for the UCRC Diversion Measurement and Telemetry Program (Diversion Measurement Program) in Wyoming;
2. Development and deployment of outreach efforts to water users in the Green River and Little Snake River basins, in coordination with the Projects Manager;
3. Manage and administer the Diversion Measurement Program in Wyoming;
4. Provide contracting support to the Diversion Measurement Program in Wyoming;
5. Support installation of telemetry in Wyoming through the duration of the Program period;
6. Verify and report on the outcomes of the Diversion Measurement Program in Wyoming.
More details on each of these Contract Objectives and potential tasks associated with achieving them are outlined in Appendix A.
The winning Offeror will be selected based upon an evaluation of the proposed approach, demonstrated competence, professional qualifications necessary for the satisfactory performance of the Contract Objectives, availability, and the proposed budget. The Projects may include up to 2100 Wyoming participants applying for measuring devices, 50 automated headgates, and 50 telemetry recording devices. The UCRC may, in coordination with the Projects Manager, make multiple awards under this solicitation if/when two or more Offerors are necessary for performance of the tasks described in this RFP, or may choose not to implement all tasks described in this RFP. The work will commence from the UCRC’s award of the contract to the selected Offeror (Contractor) and potentially continue through September 30, 2029.1

PUBLIC NOTICE
Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, the Commission hereby gives notice of the Application of Rocky Mountain Power (RMP or the Company) for authority to revise tariff Schedule 37, the Standard Rates for Avoided Cost Purchases of Power from Qualifying Facilities (Schedule 37), and Schedule 38, the Avoided Cost Purchases from Non-Standard Qualifying Facilities (Schedule 38), as more fully described below.
1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility subject to the Commission's jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.
2. On June 30, 2025, RMP filed its Application requesting authority to revise the methodology used in tariff Schedule 37 and Schedule 38 to align with the Federal Energy Regulatory Commission’s (FERC) 2020 Public Utilities Regulatory Policies Act (PURPA) revisions, which address the risks of forecasted avoided energy and capacity costs. Specifically, RMP seeks to require locational marginal pricing (LMP) using Wyoming WEIM nodal information for non-firm energy purchases, to modify the current Partial Displacement Differential Revenue Requirement (PDDRR) methodology for firm energy purchases to incorporate the 2025 IRP, to reflect third-party ownership of proxy resources, and conform clerical and formatting edits to Schedule 37. No clerical edits are proposed to Schedule 38.
3. Under the proposed PDDRR methodology, pricing for non-firm energy purchases, is based on relevant WEIM Fifteen Minute Market (FMM) pricing at the Qualifying Facility’s (QF) delivery point, or a nearby resource if the QF is not modeled by CAISO. To reduce administrative complexity, RMP proposes prices be based on hourly deliveries and simple average of the four FMM prices. Under the proposal, published integration costs for Schedule 37 will be subtracted from WEIM pricing results for wind and solar QF’s for non-firm pricing for Schedules 37 and 38.
4. Pricing for firm purchases under Schedule 37 for baseload, wind, fixed-tilt and tracking solar resource QFs, over a fifteen year contract starting in 2027 are shown in Table 1. No LMP pricing for firm energy purchases under Schedule 37 or 38 is proposed at this time.

5. The Company states that the PDDRR updates are driven by portfolio changes including reductions in the number of retirements of coal-fired resources, as well as significant increases in wind, solar and energy storage resources since the prior PDDRR update. Additionally, the Company states wind and solar QF prices are lower primarily as a result of proxy resource characteristics, specifically lower construction costs, higher tax credit eligibility and higher tax credit eligibility than was assumed in current rates.
