The Board of County Commissioners met in regular session in the Commissioners’ Meeting Room of the Sublette County Courthouse on this date at 9:00 a.m. with Joel Bousman, Tom Noble, Doug Vickrey, Sam White, Dave Stephens, Matt Gaffney, and Carrie Long, County Clerk, present.

Chairman Bousman led those present in the Pledge of Allegiance.

The agenda was amended to substitute Dagan Montgomery in the Extension portion.  Approval on motion by Commissioner Noble, seconded by Commissioner Vickrey.  Motion carried. 

The minutes of the previous meeting on 8/23/22 were approved and ordered filed on motion by Commissioner Vickrey, seconded by Commissioner Stephens.  Motion carried. 

Billy Pape, Road & Bridge, updated the Board on current activities.  Eric Sackett, Rio Verde Engineering updated the Board with the Horse Creek Box Culvert Installation Project and obtained signature from Chairman Bousman on the approved agreement. 

Pape and Sackett also presented the mining plan for the Doyle Pit. 

Matt Gaffney, County Administrator, presented the award letter for the FNRPA grant in the amount of $16,000 for active forest management with the forest service. 

Dagen Montgomery, Agriculture & Natural Resources Extension Educator, met with the Board to introduce himself.

Andre Irey, Maintenance Superintendent, met with the Board to update on projects.  It was moved by Commissioner White, seconded by Commissioner Noble to raise Irey’s salary from $87,000 to $99,500 to match the elected officials and department heads.  Motion carried. 

Carrie Long, County Clerk, along with Jeness Saxton and Andrea Jean, Deputy Clerks discussed with the Board the need for additional office staff due to the increase in population of Sublette County resulting in an increase of traffic in the Clerk’s office.  It was moved by Commissioner Noble, seconded by Commissioner Stephens to add an additional full-time position.  Motion carried.

Jen Matosky, Extension Office, introduced Amy Calhoun to the Board as new administration in her office.  Matosky also updated the Board on the fair. 

A motion was made by Commissioner White, seconded by Commissioner Noble to approve Resolution No. 22-100450B, Moyes change of zoning district boundary.  Motion carried 4 to 1 with Commissioner Vickrey voting nay. 

Dennis Fornstrom, Planning and Zoning Administrator, presented the Board with a final draft of zoning amendments for their review. 

Dan Jones, along with other citizens (Sharon Ziegler, Pat Jones, and Ann McNerney) spoke to the Board about concerns regarding the Doyle Gravel Pit. 

Tonia Hoffman and Dave Doorn, representing the Hospital District, along with Marilyn Jensen and Kerry Majhanovich, representing the Sublette Center, met with the Board to discuss the merger status between the two.  Jensen explained the intent of the Sublette Center Board was to merge with the Hospital District, but the process had been slowed due to a variety of factors, one of which was a change in legal counsel. 

Commissioner Noble made a motion to approve the transfer agreement with section 1 (a) removed from the document and the phrase “following commencement of the merger process as provided herein above” removed from item #2.  Commissioner White seconded the motion.  Motion carried 4 to 1 with Commissioner Vickrey voting nay. 

Commissioner White made a motion to sign the deed as presented by Clayton Melinkovich, Deputy County Attorney.  Commissioner Noble seconded the motion.  Motion carried 4 to 1 with Commissioner Vickrey voting nay. 

Melinkovich met with the Board requesting approval of a Resolution appointing a Special Prosecutor for a case involving a law enforcement officer who previously worked in Sublette County.  Commissioner Noble made a motion to approve a special prosecutor, Commissioner Vickrey seconded the motion.  Motion carried.

A Facility Use Agreement with SCSD #9 and the Big Piney Library was approved on motion by Commissioner White, seconded by Commissioner Noble.

Contracts with the Towns of Marbleton, Big Piney, and Pinedale for fire protection were approved on motion by Commissioner Noble, seconded by Commissioner Vickrey.

Adrian Kowalski, Deputy County Attorney, advised the Board that Black Diamond Energy had filed Chapter 11 Bankruptcy and explained future process and possible deadlines. 

Commissioner White made a motion to approve payroll and accounts payable.  Commissioner Noble seconded the motion.  Motion carried.

Commissioner Noble made a motion to approve a Surety Bond for Tonia Hoffman, Chairman, Sublette County Hospital District.  Commissioner Stephens seconded the motion.  Motion carried. 

Catering permits for Boulder Bar & Grill for an event on 9/10/22 at the Boulder Community Center and the Silver Spur Bar for an event on 9/25/2022 at the Fairgrounds were approved on motion by Commissioner Noble, seconded by Commissioner Stephens.  Motion carried. 

Emily Paravicini, County Treasurer, advised the Board the nine companies who had been granted an exemption on the monthly payment of Ad Valorem Taxes had applied for an extension.  Commissioner Noble made a motion to approve the application acknowledgment but with the stipulation a discussion occurs regarding a sunset clause.  Commission Stephens seconded the motion. Motion carried. 

Commissioners updated on old business.

Construction Company pursuant to the Project Manual for the Cottonwood Ryegrass (CR 23-117) Phase II Culvert Project and that Searle Bros. Construction Company is entitled to final settlement thereof.  On November 11, 2022, being the forty-first day after the first publication of this Notice, Sublette County will pay to Searle Bros. Construction Company all amounts and balances due under said Agreement.

The Town Council of the Town of Pinedale met in regular session on Monday, September 12, 2022, at 5 p.m. in the Lovatt Room of the Sublette County Library.

The meeting was called to order by Mayor Pro Tem Tyler Swafford at 5 p.m. Council members present: Judi Boyce, and Scott Kosiba. Council member Dean Loftus attended online. Those in attendance included: Robert Galbreath, representing the Pinedale Roundup; Ed Wood, Town Attorney; and Abram Pearce, Town Director of Public Works; Brian Gray, representing Jorgensen Associates, and Max Lockett.

Mayor Pro Tem Swafford led those present in the Pledge of Allegiance.

Motion by Councilwoman Boyce to accept the agenda after adding F5, LED Street Lighting. Seconded by Councilman Kosiba. Motion passed 4-0.

Motion by Councilwoman Boyce to approve the minutes of the August 22, 2022, regular Town Council meeting as presented. Seconded by Councilman Loftus. Motion passed 4-0.

Aaron LeBeau asked the Town Council for support of a mural on the side of a building.

Mayor Murdock joined the meeting.

Motion by Councilman Swafford to approve all Consent Agenda items. Seconded by Councilman Loftus. Motion passed 5-0. Consent Agenda items:  Approve the Temporary Use permit application to close Pine Street from Lincoln Avenue to Bridger Avenue for the Pinedale High School Homecoming Parade on September 30, 2022, from 10 to 11 a.m.; approve in arrears the Temporary Use permit application to use 30 ft of parking adjacent to the Cowboy Shop on North Franklin for the 75th Anniversary party on September 10, 2022, from 7 a.m. to 4 p.m.; approve the MOU with the Sublette County Library Board for the Story Walk in Boyd Skinner Park; approve the purchase of soda ash from Brenntag Pacific in the amount of $7,310; and approve the contract for Aviation Support & Maintenance Services from DBT Transportation Services in the amount of $27,657 effective 10/1/2022 through 09/30/2025.

Motion by Councilman Swafford to approve the MOU for property owners for installation of water filtration and sampling systems. Seconded by Councilwoman Boyce. Motion passed 5-0.

Motion by Councilman Swafford to approve the purchase and installation of six water filtration systems from Benchmark Plumbing and Heating, not to exceed $3,450. Seconded by Councilman Loftus. Motion passed 5-0.

Motion by Councilman Swafford to approve the scope of work and fee schedule provided by Davis and Cannon, LLP, dated 08/31/2022 for representing the Town, Pine Creek Ditch Association, and the Highland Ditch Association, in setting up a new entity for the purpose of managing the storage and release of water stored in Fremont Lake. Seconded by Councilman Kosiba. Motion passed 5-0.

Director of Public Works, Abram Pearce, updated the council on plans for the 2022-2023 Pine Street Beautification Project.

Motion by Councilwoman Boyce to approve replacing existing streetlights with new LED streetlights by Rocky Mountain Power for approximately $45,310. Seconded by Councilman Kosiba. Motion passed 5-0. The cost may vary slightly dependent upon lamp size in certain places.
