Construction Manager at Risk Services for the Sublette County School District No. 1

New Career & Technical Education Facility

Sublette County School District No. 1 is seeking proposals from qualified construction companies to participate in a Construction Manager at Risk delivery method for a new facility. The work consists of, but is not limited to, site clearing, site prep, utility installations; footings & foundations, exterior envelope of an engineered structure; interior build out of technical spaces such as Culinary, Health/Wellness, Welding, Construction, Transportation, and Flex. The construction site, located south of 191 as you drive through town, is approximately 4 acres and adjoins the School Districts existing Bus Maintenance and Storage Facility. The new facility is currently planned to be approximately 20,000 square feet.

Proposals will be received at the office of the Director of Operations, Jeryl Fluckiger, Sublette County School District No. 1, 665 North Tyler Avenue, Pinedale, WY 82941 until 3:00 PM, on October 25th, 2024. Submittals will not be accepted after this date and time under any circumstances. Sublette County School District No. 1 reserves the right to reject any and all proposals at its sole discretion. Project Description:

Sublette County School District No. 1 has retained the services of Plan One/Architects and HDR, to plan and design a new Career & Technical Education Facility to provide greater opportunities to students residing within Sublette County.

Proposals will be accepted until 3:00 PM, October 25th, 2024; (5) hard copies and one (1) electronic copy of the proposal are required.

The Owner will review the submitted proposals and either select from the proposals or invite a short list of prospective CMAR’s to an interview process. If necessary, interviews may take place on November 5, 2024.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules and Regulations, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) for authority to reduce the Carbon Capture Compliance Charge (Schedule 198) from 0.30% to 0.12% per month, and find that the costs incurred from 2022 through August 2024, pursuant to Wyoming Statutes §§ 37-18-101 and 37-18-102, and the Commission’s rules regarding low-carbon portfolio standards (collectively, HB 200 requirements) were prudently incurred.

1. RMP is a division of PacifiCorp, an Oregon Corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§37-1- 101(a)(vi)(C) and 37-2-112.

2. On October 1, 2024, RMP filed an Application to reduce the Schedule 198 rate from 0.30% to 0.12% per month on an interim basis, beginning January 1, 2025. Schedule 198 is a balancing account mechanism that tracks incremental costs to comply with HB 200 requirements, and revenues collected through a monthly carbon capture compliance surcharge that is based on forecasted costs. RMP requests the decrease as the projected approximate $1.0 million in annual revenue, in addition to the proposed Schedule 198 ending balance, would provide adequate revenue for future investigations into the economic and technical feasibility of carbon capture at Jim Bridger Units 3 and 4.

3. RMP states in its Application that Schedule 198 has collected $3.139 million in revenue and $556,103.33 in deferred costs, an over collection of $2.68 million. RMP requests that costs incurred from January 2022 through August 2024 to comply with the HB 200 requirements, totaling approximately $556,103.33, be found to be prudently incurred. These costs include consultant fees and internal travel expenses for developing and submitting the initial plan, the first update to the initial plan, and the final plan; conducting the Request for Proposals (RFP), and Request for Information (RFI) processes, review of the RFP results; and developing the Jim Bridger FEED study scope of work.

The Town Council of the Town of Pinedale met in regular session on Monday, September 23, 2024, in the conference room of the Pinedale Town Hall.

The meeting was called to order by Mayor Matt Murdock at 5 p.m. Council members present:  Tyler Swafford, Judi Boyce, and Scott Kosiba.  Councilman Dean Loftus, absent; excused. Those in attendance included: Sheriff KC Lehr; Ed Wood, Town Attorney; Spencer Hartman, Water-Wastewater Supervisor and Gracy Carpenter, Microbiology Lab Analyst. 

Mayor Murdock led those present in the Pledge of Allegiance.

Motion by Councilman Swafford to accept the agenda as published.  Seconded by Councilman Kosiba.  Motion passed 4-0.

Motion by Councilwoman Boyce to approve the minutes of the September 9, 2024, regular Town Council meeting as presented. Seconded by Councilman Kosiba. Motion passed 4-0.

Sheriff KC Lehr reported on calls for service for August 2024, and thanked Town Staff for their assistance with the homecoming parade.

Motion by Councilman Swafford to approve the consent agenda items as published.  Seconded by Councilwoman Boyce.  Motion passed 4-0.  Consent agenda items approved were an Encroachment Agreement for 104 North Lake Avenue, allowing the installation of a concrete parking area to be constructed in the Town of Pinedale right-of-way; an Encroachment Agreement for 800 River Bend Street, allowing the installation of a concrete driveway to be constructed in the Town of Pinedale right-of-way; Amendment No. 1 to CD22308 with the State of Wyoming, extending the Grant Agreement and Performance Period from December 31, 2024 to December 31, 2025; as-need technology support from Sweetwater Technology to aid the network improvements necessary to facilitate the Access Control Upgrade Project, in the amount of $3, 047.91; and the purchase of liquid soda ash for water treatment from Brenntag Pacific, in an amount not to exceed $8,000. 

Motion by Councilman Kosiba to approve the request from Pinedale DG, LLC, seeking a waiver from §160-15.7 requiring the installation of all new water meters in an exterior pit and to allow the installation of a water meter inside of the newly constructed commercial store with the following conditions: 1. That the AMR wire be installed within an electrical conduit to an exterior wall location at a serviceable location on the outside of the building; 2. A map be filed of the final location of the water meter and metering equipment; 3. The owner agrees to provide access to the Town of Pinedale for servicing, monitoring, reading or any other purpose regarding water and sewer operations upon request during normal business hours; and 4. The final installation is fully inspected and approved by Town Staff prior to operations.  Seconded by Councilwoman Boyce.  Motion passed 4-0.

Motion by Councilwoman Boyce to approve the inclusion of 8” solid white striping on South Tyler Avenue and North Jackson Avenue pathways, and centerline striping on Fremont Lake Road and South Tyler Avenue into the 2024 Chipseal Project contract under Force Account, not to exceed $10,000.  Seconded by Councilman Kosiba.  Motion passed 4-0.

Spencer Hartman and Gracy Carpenter gave an update on the EPA Lead and Copper Inventory.

Council reviewed monthly department reports from Municipal Court, Animal Control & Municipal Code Enforcement, Public Works, Water and Wastewater, Planning and Zoning, the Airport, and Travel & Tourism.

Motion by Councilman Kosiba to approve Ordinance 717, on second read, an Ordinance of the Town of Pinedale, State of Wyoming, amending Section 475-342 of Article XLI of Chapter 475 of the Pinedale Municipal Code to modify general requirements regarding the number of short-term rental units allowed per deeded lot.  Seconded by Councilwoman Boyce.  Motion passed 4-0.

Motion by Councilman Swafford to approve Ordinance 718, on second read, an Ordinance of the Town of Pinedale, State of Wyoming, amending Section 343 of Article XLI of Chapter 475 of the Pinedale Municipal Code to modify nuisances, violations, and penalties; termination in its entirety.  Seconded by Councilwoman Boyce.  Motion passed 4-0.

ORDINANCE NO. 717

AN ORDINANCE OF THE TOWN OF PINEDALE, STATE OF WYOMING, AMENDING SECTION 475-342 OF ARTICLE XLI OF CHAPTER 475 OF THE PINEDALE MUNICIPAL CODE TO MODIFY GENERAL REQUIREMENTS OF SHORT-TERM RENTALS.

NOW THEREFORE, BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, STATE OF WYOMING, THAT SECTION 475-342 OF ARTICLE XLI OF CHAPTER 475 OF THE PINEDALE MUNICIPAL CODE IS HEREBY AMENDED IN ITS ENTIRETY:

§ 475-342 General Requirements

A. Short-term rentals are not permitted outdoors, in tents, campers, recreational vehicles or unattached accessory structures (e.g., sheds, garages, etc.) Short-term rentals in properly conforming accessory dwelling units (ADU) are permitted.

B. Each STR may only be rented to one group at any one time (i.e., a single booking.)

C. Occupancy of a dwelling used for an STR is limited to a total of 10 guests.

D. Parking for the STR must utilize parking on the property of the STR or parking in the right-of-way immediately adjacent to the STR property.

E. Short-term rentals are classified as lodging facilities by the state and must be registered with the Wyoming Department of Revenue and collect all applicable room, occupancy and sales taxes required by law.

F. The following must be posted in a visible area in the rental structure:

1) Inside of front door:

a) Contact information for responsible party;

b) STR permit;

c) Address of property; and

d) Emergency response contact information (i.e., 911).

2) Bedroom: Floor plan of structure indicating fire escape routes.

G. Any advertising or description of an STR on any website must display the permit number or an image of the permit.

H. Signs, advertising, or any other display on the property indicating that the dwelling unit is being utilized, in whole or in part, as an STR is prohibited. The STR shall outwardly appear as a residential dwelling.

I. Within the following zone districts, written notice shall be provided by the owner to neighbors adjacent to the STR property: A, R-S, R-1, R-2 and R-2A. Each notice shall include the STR address, name and contact information of the owner. Proof of notification (i.e., copy of the mailing receipt) shall be provided to the Planning and Zoning Department during the application process.

J. Short-term rental permits shall not be transferred or assigned to another individual, person, entity, or address. Further, a permit does not authorize any person, other than the person named therein, to operate an STR on the property.

K. Within the following zone districts, both hosted and non-hosted (non-owner occupied) short-term rentals shall be permissible. Only two short-term rental permits will be issued per deeded property or lot. An excess of two (2) units shall be defined as a hotel/motel and shall meet zoning requirements as required for such use: C-1 and C-2.

L. Within the following zone districts, one permit is allowed per owner: A, R-S, R-1, R-2 and R-2A Hosted (owner-occupied) short-term rentals shall be permissible in said zone districts. Parcels of 2+ acres are allowed a second permit subject to staff review.

M. STRs are not allowed in multifamily dwellings in the A, R-S, R-1, R-2 and R-2A Zone Districts.

N. Within the following zone districts, short-term rentals shall not be permissible: I-1, I-2, UT, R-4, and MH.

This Ordinance shall be in full force and effect from and after passage on three readings and publication according to law.

AN ORDINANCE OF THE TOWN OF PINEDALE, STATE OF WYOMING, AMENDING SECTION 343 OF ARTICLE XLI OF CHAPTER 475 OF THE PINEDALE MUNICIPAL CODE TO MODIFY NUISANCES, VIOLATIONS AND PENALTIES; TERMINATION IN ITS ENTIRETY.

NOW THEREFORE, BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, STATE OF WYOMING, THAT SECTION 343 OF ARTICLE XLI OF CHAPTER 475 OF THE PINEDALE MUNICIPAL CODE IS HEREBY TO READ AS FOLLOWS:

§ 475-343. Nuisances, violations, and penalties; termination.

A. Violation of the provisions of this article is punishable pursuant to  §475 Article XXXV Violations, and revocation of the violator’s STR Permit.

B. Advertising that offers a property as an STR shall constitute prima facie evidence of the operation of an STR.

C. Other evidence of the operation of an STR without a valid permit may include, but is not limited to, guest testimony, rental agreements, advertisements, and receipts or bank statements showing payments to the owner by a guest.

D.  Each day during which a person operates an STR without a required permit constitutes a separate violation thereof.

E. Town staff shall maintain a log of nuisances and complaints lodged against a property operating as an STR. If three separate complaints are logged against a property in a two-year period, the Mayor will review the STR permit for possible suspension or revocation. A suspension or revocation may be appealed to the Town Council by the holder of the STR permit.

This Ordinance shall be in full force and effect from and after passage on three readings and publication according to law.

OFFICIAL COUNTY COMMISSIONERS’ PROCEEDINGS

OCTOBER 1, 2024

The Board of County Commissioners met in regular session in the Commissioners’ Meeting Room of the Sublette County Courthouse on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Dave Stephens, Mack Bradley, Clayton Melinkovich, Jeness Saxton, and Carrie Long, County Clerk, present. 

Chairman White led those present in the Pledge of Allegiance.

Commissioner Noble made a motion to approve the agenda with the addition of the Domestic Violence Proclamation. Commissioner Vickrey seconded the motion.  Motion carried. 

The minutes of the previous meeting held on September 17, 2024, were approved and ordered filed on motion by Commissioner Bradley, seconded by Commissioner Noble.

Tracy Pitlock with SAFV, read the Domestic Violence Awareness Month proclamation.  Commissioner Noble made a motion to designate October as D.V. Awareness Month.  Commissioner Vickrey seconded the motion.  Motion carried. 

Kara Beech, Board Member (HDHRA) presented Andrea Jean, Human Resources, with a Public Sector Excellence Award. 

Billy Pape, Road & Bridge, updated the Board on department activities.  Also presenting were Eric Sackett and Aaron Seehafer from Rio Verde Engineering.  Pape presented an Amendment to the Mule Deer Aspen and Riparian Enhancement Project – Soda Lake.  Commissioner Vickrey made a motion to approve signature on the document by Chairman White.  Commissioner Noble seconded the motion.  Motion carried. 

Sackett updated the Board on the North Piney project.  Seehafer updated the Board on the Chip Seal Project.  They also discussed Skyline Drive.  It was the agreement of the Board that a letter should be submitted to Federal stakeholders regarding issues with the completed product. 

Pape also updated on the Golf Course and Waste Management. 

David Fellows, Treasurer of Hoback Ranches Improvement District, was present to discuss the process of the County taking over the first three miles of Rim Road. Pape explained that he had not submitted the application to the Forest Service for the 100-foot easement because submitting the application would commit that the county will take all responsibility for the road.  Pape said he did not have direction from the Board that they were willing to take that responsibility.  Commissioner Vickrey made a motion to submit the application with the guarantee the County would take responsibility for the road.  Commissioner Stephens seconded the motion.  Motion failed with Commissioners Vickrey and Stephens voting yes and Commissioners Noble, White and Bradley voting no. 

Andre Irey, Maintenance, updated the Board on department activities. 

Dennis Fornstrom, Planning & Zoning, met with the Board to discuss several matters:

An application from Charles Ross and Gary Stenoien requesting a Partial Vacation and Replat of the Packer Creek Ranch, Large Tract Development, pursuant to Chapter XII, Subchapter IV, Section 4, Vacation/Modifications to Filed Plats, of the Sublette County zoning & Development Regulations.  The request would reconfigure the westerly boundary line between Tracts 5 & 11 of the Packer Creek Ranch, Large Tract Development.  With the request, Tract 5 would be enlarged to the west to include 6.75 acres of Tract 11.  Increasing the size of Tract 5 to 50.73 acres and decreasing the size of Tract 11 to 41.62 acres.  The request would create the Packer Creek Ranch II.  Commissioner Noble made a motion to approve the request, Commissioner Vickrey seconded the motion.  Motion carried. 

An application from Don Dabel requesting a Partial Vacation and Replat to an existing Subdivision Plat, pursuant to Chapter XII, Subchapter IV, Section 4, of the Sublette County Zoning & Development Regulations.  The request would reconfigure the boundary line between Lots 68 & 69 of the Green River Ranch Unit B.  The purpose of the reconfiguration is to address the overlap of existing infrastructure and the differences between the platted property lines and the discrepancies of how the lots were originally stake and have been maintained and used, while maintaining the approximate size of the existing lots. Commissioner Noble made a motion to approve the application.  Commissioner Bradley seconded the motion.  Motion carried. 

An application from Christian & Austin Smith proposing a Minor Subdivision pursuant to Chapter XII, Subchapter V of the Sublette County Zoning and Development Regulations.  The proposal would create two 3.6-acre Lots +- from a 7.19-acre parcel.  The parcel was rezoned in November 2023 to RR, Rural Residential for the purpose of creating the Minor Subdivision.  The property is located at US Hwy 189 & 191, Bondurant, WY.  Commissioner Noble made a motion to approve the application, Commissioner Vickrey seconded the motion.  Motion carried.

An application from Union Telephone Company & CL Bar Properties, Inc., requesting a Conditional Use Permit pursuant to Chapter II, Section 3.b.6.g and Variance to the allowed height of Chapter III, Section 9.b of the Sublette County Zoning & Development Regulations, to construct a new 100 ft. tall, Fixed Telecommunication Tower located on the Cora Butte, within the SENE4, Section 18, T34N, R110W, within the Agricultural Zoning District.  Chairman White asked the Board if they had considered criteria for Conditional Use.  All members indicated they had.  Commissioner Noble made a motion to approve the application.  Commissioner Vickrey seconded the motion.  Commissioner Noble made a motion to approve the variance, from 60 feet to 100 feet.  Commissioner Vickrey seconded the motion.  Motion carried.    

Dagan Montgomery and Tiera Bevilacqua, Extension Office, updated the Board on activities and gave a recap of the Fair. 

Clayton Melinkovich, County Attorney, presented contracts for the Board to review.  He stated he had touched base with the stakeholders for G.I.S services and all were favorable for the services to remain the same in the transition to the new owners from Greenwood Mapping, Inc.  Commissioner Noble made a motion to approve the contract, Commissioner Bradley seconded the motion.  Motion carried. 

Melinkovich also informed the Board that the Hospital District is favorable to the proposed Aspen Grove lease with one modification, that they would like to have control over the lease amounts and have the authority to raise rents if necessary.  The Board was not in favor of the modification

Emily Paravicini, Treasurer, presented the Board with a proposed property tax refund in the amount of $46,511.70.  Commissioner Noble made a motion to approve the proposal.  Commissioner Vickrey seconded the motion.  Motion carried. 

Shad Cooper, Fire Warden, requested direction from the Board regarding requesting quotes for a new Water Tender.  The Board was favorable with the release of an RFP. 

Commissioner Vickrey made a motion to approve the Abstract of Direct Expenditures as presented by Clerk Long.  Commissioner Bradley seconded the motion.  Motion carried. 

Payroll, in the amount of $1,276,577.37 was approved on motion by Commissioner Noble, seconded by Commissioner Vickrey.  Motion carried. 

Accounts Payable (without the White Mountain Operating) invoice was approved as presented on motion by Commissioner Noble, seconded by Commissioner Vickrey.  The White Mountain Operating invoice was approved on motion by Commissioner Noble, seconded by Commissioner Vickrey.  Motion carried with Chairman White recusing himself from the vote.
