The Town Council of the Town of Pinedale met in regular session on Monday, August 14, 2023, in the Lovatt Room of the Sublette County Library.

The meeting was called to order by Mayor Matt Murdock at 5 p.m. Council members pre-sent:  Dean Loftus, Tyler Swafford, Judi Boyce and Scott Kosiba.  Those in attendance included: Robert Galbreath, representing the Pinedale Roundup; Mike Jackson, representing Rio Verde En-gineering; John and Angela Douglas, representing Emblem Aviation, LLC.; Casey Dauwen; Max Lockett; Tesa Manning; Stephanie Sprenger; Ed Wood, Town Attorney; Abram Pearce, Director of Public Works; and Chad Mitchell, Planning & Zoning Administrator. Attending online were Wes Werbelow, representing Ardurra Group, Inc., Ryan Wells; Lindsey Gooch; and Michele Smith.

Mayor Murdock led those present in the Pledge of Allegiance.

Motion by Councilman Swafford to accept the agenda as published.  Seconded by Councilwoman Boyce.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve the July 24, 2023, regular Town Council meeting minutes.  Seconded by Councilman Swafford.  Motion passed 3-0-2; Councilmen Loftus and Kosiba abstained.

Councilman Loftus has been asked about Town Code versus homeowner association rules regard-ing noise enforcement.

Mayor Murdock opened the public hearing regarding Crosswinds Lot Division Preliminary Plat proposal for the Crosswinds Lot Division, First Amendment to the Town of Pinedale at 5:08 p.m.  The project was presented by Town staff and the Applicant.  Discussion was held between Coun-cil, staff and the Applicant on the individual variance requests and the project as a whole.  Individ-ual variance descriptions were referenced in detail in the Staff Report addressing the Crosswinds Lot Division, First Amendment to the Town of Pinedale.

Motion by Councilman Swafford to approve a variance request as submitted to §400-88 Street-lights; to omit the planning and installation of streetlights along Wilson Street.  Based on the pro-posed lot layout, street lighting is not necessary at this time given that there are no major street in-tersections within the portion of Wilson Street that transects the property and no street lighting connectivity would be achieved to the east and west of the subject property.  Seconded by Coun-cilman Loftus.  Motion passed 5-0.

Motion by Councilman Swafford to approve a variance request as submitted to §400-89 Water supply; due to unknown development locations and unknown future water demands, it is proposed that water services will be installed into Lot 3 and Lot 4 simultaneously within a common corri-dor/trench across Wilson Street to reduce road closures and minimize road surface disturbance.  Prior to issuing a building permit on any individual lot within the Crosswinds Lot Division First Amendment, the Town of Pinedale will require adequate water service plans for that specific de-velopment where all water systems, equipment and connections shall be subject to the inspection and approval of the Town Engineer or other person designated by Town Council for that purpose and shall be in accordance with the minimum construction standards of the Town of Pinedale.  Wilson Street shall be limited to two distinct areas whereby the water service lines into Lot 3 and Lot 4 shall be installed simultaneously in conjunction with sewer service installation.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilman Swafford to deny a variance request as submitted to §400-90 Fire hy-drants; to omit requirements to provide fire hydrant coverage for each lot within the subdivision area prior to final plat and instead require the applicant to submit adequate hydrant layout and con-struction plans for the specific lot development where all water systems, equipment and connec-tions shall be subject to the inspection and approval of the Town Engineer or other person as des-ignated by Town Council for that purpose and shall be in accordance with the minimum construc-tion standards of the Town of Pinedale.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilman Swafford to approve a variance request as submitted to §400-91 Sanitary sewers; to omit requirements to provide connection to the public sanitary sewer for each lot within the subdivision area prior to final plat. Prior to issuing a building permit on any individual lot with-in the Crosswinds Lot Division First Amendment, the Town of Pinedale will require that the appli-cant submits adequate sewer service plans for that specific development where all sanitary sewer systems, equipment and connections shall be subject to the inspections and approval of the Town Engineer or other person designated by Town Council for that purpose and shall be in accordance with the minimum construction standards of the Town of Pinedale.  Wilson Street shall be limited to two distinct areas whereby the sewer service lines into Lot 3 and Lot 4 shall be installed simulta-neously in conjunction with water service installation.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilman Swafford to approve a waiver request as submitted to §400-86 Sidewalks; the addition of a sidewalk along Pine Street/US Highway 191 is impracticable as there are no exist-ing sidewalks in the vicinity that currently serve this corridor.  Seconded by Councilman Loftus.  Motion passed 5-0.

Mayor Murdock closed the Public Hearing at 5:43 p.m.

Motion by Councilman Swafford to approve the preliminary plat of Crosswinds Lot Division, First Amendment to the Town of Pinedale.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve the consent agenda items as published.  Seconded by Councilman Kosiba.  Motion passed 5-0.  Consent agenda items approved were a Temporary Use permit application for Emblem Aviation; a Temporary Use permit application for Sublette County Hospital District; a Park Use permit application for the Pinedale Aquatic Center Zombie Dash; a Temporary Use permit application for the Pinedale Aquatic Center Frosty 5K; and membership in the Corporate Aircraft Association (CAA).

Motion by Councilwoman Boyce to approve the Mayor’s appointment of Tesa Manning to the Planning and Zoning Commission.  Seconded by Councilman Kosiba.  Motion passed 5-0.

Motion by Councilman Swafford to approve a fence permit application for Matt and Stephanie Sprenger, to combine Trails Creek Subdivision Lots 57 and 54, making Lot 54 an extension of their backyard to maintain safety and allowing the fence height of 72 inches on the condition of the lots being joined.  Seconded by Councilman Kosiba.  Motion passed 5-0.

Motion by Councilman Loftus to approve a Professional Services Agreement with Rio Verde En-gineering for the Pinedale Inflow & Infiltration Reduction Project, in an amount not to exceed $94,000.  Seconded by Councilman Swafford.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve a Professional Services Agreement with Ardurra Group, Inc., for the Town of Pinedale Pathway Connectivity Project, including the scope of work amendment to add park lighting, in an amount not to exceed $327,307.70.  Seconded by Council-man Swafford.  Motion passed 5-0.

Council discussed the means of sale for the property located at 210 West Pine Street; Town Attor-ney, Ed Wood, will draft a resolution.

Motion by Councilman Swafford to approve Ordinance 706, on second read, an Ordinance of the Town of Pinedale, State of Wyoming, amending subsection 160-26 (C) (3) of Chapter 160 of the Pinedale Municipal Code.  Seconded by Councilwoman Boyce.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve Resolution 2023-13, a Resolution setting rates and fees for use of the airport, Ralph Wenz Field, for the Town of Pinedale.  Seconded by Councilman Kosiba.  Motion passed 5-0.

Department of Environmental Quality, Division of Air Quality PUBLIC NOTICE:  In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Ultra Resources, Inc. (CMP000768) to modify and operate the Warbonnet 13-24 PAD (F015001) by updating the equipment list, with two reboiler overheads condensers and one smokeless combustion device to control volatile organic compound and hazardous air pollutant emissions associated with the dehydration units and pneumatic pump, located in the SW1/4SW1/4 of Section 24, T30N, R108W, approximately twelve (12) miles west-southwest of Big Sandy, in Sublette County, Wyoming.  Ultra Resources, Inc. has met the demonstration requirements under Chapter 6, Section 2(c)(ii) for this permitting action since current emissions are less than emissions during the baseline period.  VOC emissions have decreased 0.4 TPY from the baseline period and NOx emissions have decreased 0.5 TPY from the baseline period.  These reductions have been added to Ultra Resources, Inc.’s offset bank to use for future permitting actions.

CHAPTER 6, SECTION 2 CONSRUCTION/MODIFICATION PERMIT - Department of Environmental Quality, Division of Air Quality PUBLIC NOTICE:  In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Jonah Energy LLC (CMP100053) to modify and operate the Stud Horse Butte 01-02 Central Facility (F029854) with the addition of production and equipment associated with two new wells, the Falcon 01-500H and Cirque 02-500H, with three reboiler overheads condensers, three TEG flash tank separators and two common smokeless combustion devices to control volatile organic compound and hazardous air pollutant emissions associated with the dehydration units, condensate tanks, active produced water tanks and pneumatic pumps, located in the NE1/4NE1/4 of Section 2, T29N, R108W, approximately thirteen (13) miles southwest of Big Sandy, in Sublette County, Wyoming.  A Chapter 6, Section 2(c)(ii) demonstration in accordance with the Division’s Interim Policy has been conducted.  Emission offset requirements, if applicable, have been applied to this permitting action at a ratio of 1.5:1.0 for VOCs and 1.1:1.0 for NOx.  Permitting actions to date have resulted in a decrease in actual VOC emissions of 4245.5 tpy and a decrease in actual NOx emissions of 391.3 tpy. Therefore, Jonah Energy has met the offset requirements for VOCs and NOx.

AN ORDINANCE OF THE TOWN OF PINEDALE, STATE OF WYOMING, AMENDING SUBSECTION 160-26 (C) (3) TO PROVIDE THAT VARIANCE FINDINGS ARE TO BE MADE BY TOWN COUNCIL RATHER THAN THE PLANNING AND ZONING COMMISSION.

NOW, THEREFORE BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING THAT SUB-SECTION 160-26 (C) (3) OF CHAPTER 160 OF THE PINEDALE MUNICIPAL CODE IS HEREBY AMENDED TO READ AS FOLLOWS:

§ 160-23.  Variances.

3.  Each variance authorized shall not be personal to the applicant but shall apply to a specific use or structure and shall run with the land. No variance shall be authorized unless Town Council finds that all of the following conditions exist:

(a) That the variance will not authorize a permitted use other than those specifically enumerated in the zoning district in which the variance is sought;

(b) That, owing to extraordinary circumstances, literal enforcement of the provisions of this chapter will result in unnecessary hardship;

(c) That the extraordinary circumstances were not created by the owner of the property and do not represent a general condition of the district in which the property is located;

(d) That the variance, if granted, will not substantially or permanently injure any adjacent, conforming property;

(e) That the variance will not alter the character of the district in which it is located;

(f) That the variance, if granted, is the minimum variance and the least modification that will afford the relief sought;

(g) That the variance will be in harmony with the spirit of the Town Code chapter and will not adversely affect the public health, safety or welfare.

This Ordinance shall be in full force and effect from and after passage on three readings and publication according to law.
