MAD NO. 2 PROCLAMATION

MOSQUITO ABATEMENT DISTRICT NO. 2 BOARD ELECTION

In Accordance with Wyoming statutes 22-29, the board of directors of Mosquito Abatement District No. 2 has directed that there shall be a mail-ballot election for one MAD No. 2 Board of Directors position on the Tuesday after the first Monday in May, (May 7, 2024).

Only members of MAD No. 2 are eligible to run for the board and to vote in the election.

One Board Member position will be open for a three (3) year term.

One Board Member position will be open for a one (1) year term.

Between 60 and 30 days prior to the election (between March 6 and April 12, 2024), interested parties must file for the positions using a format that substantially conforms to the form set forth in W.S. 22-29-110(b). Copies of that form may also be obtained by contacting the Election Filing Officer (Board Clerk Linda Morton) at (307)780-6073, or by writing to the MAD No. 2 Board at P.O. Box 154, Big Piney, Wyoming, 83113-0154.

A list of candidates will be published in the newspaper no less than 10 days prior to the election and voters may write in votes.

Between 25 and 15 days prior to the election (between April 12 and April 22, 2024), the election filing officer will mail a mail-ballot packet to each MAD No. 2 member complete with instructions for completing and returning the ballot.

Ballots must be received by the election filing officer no later than 5 p.m. on Election Day.

Ballots may be mailed to the election filing officer, or dropped off on Election Day at a polling place and time to be laid out in the mail-ballot package.

TO ADMINISTER TRUST

You are hereby notified that on December 26, 2023, Gene Harmon Pfisterer, also sometimes known as G. Harmon Pfisterer, and Harmon Pfisterer died in Bonneville County, Idaho, a resident of Sublette County, Wyoming.  Gene Harmon Pfisterer was the Trustor /Settlor of the Harmon Pfisterer 1985 Family Trust dated July 31, 1985, as amended (the “Trust”).  The Trust, by its terms, became irrevocable upon the death of Gene Harmon Pfisterer. 

Notice is hereby given that Sandra Marie Pfisterer, the named Successor Trustee of the Trust, intends to administer the Trust and to have the property of the Trust and the Settlor distributed as permitted under the terms of the Trust.  Claims against the assets of the Trust must be filed with the Successor Trustee, at 1273 North 15th Street, Suite 101, Laramie, WY 82072.

A creditor may file a claim against the assets of the Trust or commence a proper judicial proceeding to contest the validity of the Trust within one hundred twenty (120) days immediately after the first date of publication of this notice, as provided by Wyo. Stat. §4-10-507.  A creditor failing to file a timely claim or to timely commence a judicial proceeding to contest the validity of the Trust within the time provided herein is forever prohibited and barred from making any claim against the assets of the Trust or from commencing and judicial proceedings against the Settlor, the Successor Trustee or against the assets of the Trust.

Town of Marbleton, WY

The Town of Marbleton is seeking sealed bids for the sale and removal of surplus equipment & property.  All bids must be received by 12 p.m. on May 10, 2024 in the Clerk’s Office, 10700 Hwy 189, Marbleton, WY 83113.  Bids received after this date and time will be returned unopened to the bidder.  Bid opening will be held at 2pm at the Marbleton Town Hall on Friday, May 10, 2024.  Bids will be awarded at the Town Council meeting at 5pm on Monday, May 13, 2024. 

Please contact the Town Hall to obtain a bid sheet to be used for this sale.  Bid sheets can also be emailed when requested.

Each submitted bid should be in a sealed envelope marked, Town of Marbleton, Sale of Surplus Property.  If mailed, the bid submission should be in a similarly marked separate sealed envelope to protect against the bid being opened in error. 

Items offered for sale, unless otherwise noted, may be viewed during business hours or upon request at the Marbleton Maintenance Shop at 601 Taylor Avenue in Marbleton.

AN ORDINANCE OF THE TOWN OF PINEDALE, STATE OF WYOMING, AMENDING SUBSECTION 475-149.11 DEFINITIONS TO ADD A DEFINITION OF MOTORCOACH RESORTS.

NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING, THAT SUBSECTION 475-149.11 OF CHAPTER 475 OF THE PINEDALE MUNICIPAL CODE IS HEREBY AMENDED TO READ AS FOLLOWS:

§ 475-149.11  Definitions.

As used in this article, the following terms shall have the meanings indicated:

RECREATIONAL FACILITY

Includes buildings, structures or areas built or developed for purposes of entertaining, exercising, or observing various activities participated in either actively or passively by individuals or organized groups.

RESORT

Includes a building or group of associated buildings containing accommodation units for visitors consisting of individual guest rooms, suites, or separate dwelling units, with related dining facilities and other types of accessory facilities including private recreation facilities, operated under a single management which provides the occupants thereof with customary hotel services and facilities.

MOTORCOACH RESORT

Includes Class A or Super C Motorcoaches only.  Includes a building or group of associated buildings containing accommodation units for visitors consisting of individual guest rooms, suites, or separate dwelling units with related dining facilities and other types of accessory facilities including private recreation facilities, operated under a single management which provides the occupants thereof with customary hotel services and facilities.  These lots may be sold and owned individually, however, may only be used when an occupied Class A or Super C Motorcoach is present on the individually owned lot.

ORDINANCE NO. 714

AN ORDINANCE OF THE TOWN OF PINEDALE, STATE OF WYOMING, AMENDING SECTION 440-21 OF CHAPTER 440 OF THE PINEDALE MUNICIPAL CODE TITLED VEHICLES AND TRAFFIC.

NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, STATE OF WYOMING, THAT SECTION 440-21 OF CHAPTER 440 OF THE PINEDALE MUNICIPAL CODE IS HEREBY AMENDED TO READ AS FOLLOWS:

§ 440-21  Removal of violating vehicles.

A. Any law enforcement officer or municipal officer is empowered and authorized to remove from the streets and alleys of the Town, all vehicles found to be parked or stored in violation of §395-4, §440-18 (A) and §440-19, by towing or otherwise, as set out in Section B below.

B. When notice has been duly issued to remove such vehicle, by placing said notice prominently upon the vehicle where it may be readily detected, and if there is a failure to remove such vehicle within 24 hours thereafter, such vehicle shall be deemed a nuisance and subject to removal by the Town and impounded in a place of safekeeping. In the alternative, a citation may be issued for violation of Town ordinance.

C. Upon actual notice having been given to the operator of any such vehicle pursuant to §440-18C, and the owner or operator of such vehicle having failed to move the same to a different location, such vehicle shall be deemed a nuisance and subject to removal by the Town and impounded in a place of safekeeping. In the alternative, a citation may be issued for violation of Town ordinance.

D. All costs of towing and storage shall be the responsibility of the vehicle owner and shall be paid in full before such vehicle is released to the owner/operator.  The cost of storage on Town property shall be set by Resolution.

The Town Council of the Town of Pinedale met in regular session on Monday, March 25, 2024, in the conference room of the Pinedale Town Hall.

The meeting was called to order by Mayor Matt Murdock at 5 p.m. Council members present:  Tyler Swafford, Judi Boyce and Dean Loftus.  Scott Kosiba, absent; excused.  Those in attendance included:  Jim Mitchell, representing Sublette County Emergency Management; Richard & Terry Strahorn; Tony Kelly; Max Lockett; Tom Healy; Bob & Karen Hollar; Michele Doyle; Matt Harber; Leslie Nate; Debbie Vickrey; Paul Rock; Ryan Grove; Adam Herron; Jessup Wyman; Casey Fairbanks; Erica McCarroll; and Shari Morris. Attending online were Wes Werbelow, representing Ardurra Group; Brian Gray, representing Jorgensen Associates; Cali O'Hare, representing the Pinedale Roundup; Tesa Manning, Abram Pearce and Michele Smith.

Mayor Murdock led those present in the Pledge of Allegiance.

Motion by Councilman Swafford to accept the agenda as presented.  Seconded by Councilman Loftus.  Motion passed 4-0.

Motion by Councilwoman Boyce to approve the March 11, 2024, regular Town Council meeting minutes.  Seconded by Councilman Swafford.  Motion passed 4-0.

Casey Fairbanks and Erica McCarroll presented municipal code enforcement concerns.

Council reviewed Sheriff's Department calls for service for February 2024.

Wes Werbelow presented conceptual design plans for the Pinedale Pathway Connectivity Project.

Mayor Murdock called a 5 minute recess at 6:33 p.m.

Motion by Councilman Loftus to approve the consent agenda items as published.  Seconded by Councilwoman Boyce.  Motion passed 4-0.  Consent agenda items approved were a 5-year lease extension for the hangar ground lease agreement between the Town of Pinedale and Biffle Properties for Lot No. 30 at Ralph Wenz Field, effective November 1, 2023 through October 31, 2028; and the submission of a CWSRF loan application to the Wyoming State Land and Investment Board for the Pinedale Shallow Water Main Sewer Repair Project, in the amount of $294,834.

Council reviewed monthly department reports from Animal Control & Municipal Code, Projects, Public Works, Water & Wastewater, Planning & Zoning, the Airport and Travel & Tourism.

Motion by Councilman Loftus to approve Ordinances 709, on second read, an Ordinance of the Town of Pinedale, State of Wyoming, amending subsection 475-149.11 Definitions, to add a definition of Motorcoach Resorts.  Seconded by Councilman Swafford.  Motion passed 4-0.

Motion by Councilman Swafford to approve Ordinance 710, on second read, an Ordinance of the Town of Pinedale, State of Wyoming, amending subsection 475-149.13 to add M, defining permitted accessory uses to motorcoach resort development sites.  Seconded by Councilwoman Boyce.  Motion passed 4-0.

Motion by Councilwoman Boyce to approve Ordinance 711, on second read, an Ordinance of the Town of Pinedale, State of Wyoming, amending subsection 475-149.13 to add N, defining prohibited uses to motorcoach resort development sites.  Seconded by Councilman Loftus.  Motion passed 4-0.

Motion by Councilman Loftus to approve Ordinance 712, on second read, an Ordinance of the Town of Pinedale, State of Wyoming, amending subsection 475-149.16 C to correct the numerical reference from 475-149.19 to 475-149.18.  Seconded by Councilman Swafford.  Motion passed 4-0.

Motion by Councilman Swafford to approve Ordinance 713, on second read, an Ordinance of the Town of Pinedale, State of Wyoming, amending subsection 475-149.19 A to limit the location of units on recreational vehicle lots and spaces.  Seconded by Councilwoman Boyce.  Motion passed 4-0.

Motion by Councilwoman Boyce to approve Ordinance 714, on second read, an Ordinance of the Town of Pinedale, State of Wyoming, amending section 440-21 of Chapter 440 of the Pinedale Municipal Code titled Vehicles and Traffic.  Seconded by Councilman Loftus.  Motion passed 4-0.

Motion by Councilwoman Boyce to approve payroll and benefits for March 31, 2024.  Seconded by Councilman Swafford.  Motion passed 4-0.

Motion by Councilman Swafford to enter Executive Session to discuss Real Estate at 6:56 p.m.  Seconded by Councilwoman Boyce.  Motion passed 4-0.

Motion by Councilman Swafford to exit Executive Session at 8:05 p.m.  Seconded by Councilman Loftus.  Motion passed 4-0.

Motion by Councilman Swafford to re-enter regular session at 8:05 p.m.  Seconded by Councilwoman Boyce.  Motion passed 4-0.

Motion by Councilwoman Boyce to adjourn the meeting. Seconded by Councilman Swafford. Motion passed 4-0. The meeting adjourned at 8:06 p.m.

CHAPTER 6, SECTION 2 CONSRUCTION/MODIFICATION PERMIT - Department of Environmental Quality, Division of Air Quality PUBLIC NOTICE:  In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by PureWest Resources, Inc. (CMP100826) to construct and operate a new natural gas and condensate production facility, known as the Stewart Point 7-33 SimOps PAD (F031318), consisting of the Stewart Point 12C2-27D, 15D1-28D, 16B1-28D and 16B2-28D wells, with one reboiler overheads condenser and one smokeless combustion device to control volatile organic compound and hazardous air pollutant emissions associated with the dehydration unit, located in the SW1/4NE1/4 of Section 33, T33N, R109W, approximately five (5) miles south of Pinedale, in Sublette County, Wyoming.  A Chapter 6, Section 2(c)(ii) demonstration in accordance with the Division’s Interim Policy has been conducted.  Emission offset requirements, if applicable, have been applied to this permitting action at a ratio of 1.5:1.0 for VOCs and 1.1:1.0 for NOx.  Permitting actions to date have resulted in a decrease in actual VOC emissions of 865.7 tpy and a decrease in actual NOx emissions of 720.3 tpy.  Therefore, PureWest Resources, Inc. has met the offset requirements for VOCs and NOx.

For the duration of the public comment period, the permit application, the agency’s analysis, and the public notice are available for public inspection online at https://openair.wyo.gov, utilizing facility ID F031318 and permit number P0037508 under permits.  This material may also be viewed online, at the above URL, utilizing a public computer at the Sublette County Library, Pinedale, Wyoming.  Additionally, for the duration of the public comment period a copy of this public notice is available for public inspection at the Sublette County Clerk’s Office, Pinedale, Wyoming.
