Big Piney man pleads ‘not guilty’ to DWUI during fundraiser

PINEDALE — The motorcyclist who crashed his Harley Davidson trike, went over the edge of Paradise Road and delayed the Boulder Roll ride for suicide awareness by 90 minutes on Saturday, June 10, pleaded “not guilty” in Sublette County Circuit Court to the charge of driving while under the influence.

Terry L. Mahaffey, of Big Piney, entered his plea through his attorney, Dale Aronson, and waived his appearance upon arraignment on June 23, choosing not to appear before Circuit Court Judge John LaBuda at the courthouse in Pinedale.

The results of Mahaffey’s blood alcohol concentration test performed by medical personnel are still pending as of July 25, according to Wyoming Highway Patrol Capt. and District Three Commander Klief Guenther. Guenther told the Roundup on June 19 that, “Blood results from the state are taking on average about two months (to come back).”

Guenther also said Mahaffey “had a helmet but wasn’t wearing it.”

The rider suffered minor injuries.

Mahaffey was transported from the scene of the crash near Highway 191 to a medical facility and later cited by WHP troopers.

“Between the odor of alcohol, failure to negotiate the curve and his admittance of drinking, we’re pretty sure he was over the legal limit,” Guenther said on June 12.

Mahaffey will face a six-person jury trial beginning on Nov. 28.

Discovery obligations must be completed by Mahaffey’s legal counsel as well as the prosecution by Aug. 22. A pretrial conference is scheduled for Oct. 30.

According to the criminal case management order, any change of plea occurring after the pretrial conference must occur at least 10 days prior to the trial date unless “extraordinary circumstances require otherwise.”
