2023 SUBLETTE COUNTY NORTH PARADISE (CR 23-136) ROAD OVERLAY PROJECT

Sealed BIDS are requested for work described in the Project Manual for the 2023 Sublette County North Paradise (CR 23-136) Road Overlay Project, dated February 24, 2023, prepared by Rio Verde Engineering, 804 Hoback Street, P.O. Box 642, Pinedale, Wyoming 82941, 307-367-2826.

BIDS will be received by Rio Verde Engineering until 2 pm local time on March 30, 2023, at which time said BIDS will be opened and read aloud.

The work consists of 14,000 ton of asphalt, 122,000 LF striping, and miscellaneous appurtenances.

CONTRACTORS shall be required to accompany each BID with a BID Bond with sufficient surety, or a certified check, cashier’s check or bank draft upon some reputable bank payable to Sublette County for at least ten (10) percent of the total amount of the BID.  The bond, check or bank draft shall be forfeited as liquidated damages, if the CONTRACTOR, upon the letting of the contract to him, fails to enter into the contract within ten (10) days after it is presented to him for that purpose or fails to proceed with the performance of the contract.  The BID Bond, draft or check shall be retained by Sublette County until proper bond to secure performance of the contract has been filed and approved.  All the above is to be in accordance with 15-1-113 and 16-6-101 to 121, Wyoming Statutes, 2023.

The right is reserved by Sublette County to reject any and all BIDS, and to waive any irregularity or informality in the BID process.  BIDS may not be withdrawn for thirty days after the date of opening.

The Board of County Commissioners met in regular session in the Commissioners’ Meeting Room of the Sublette County Courthouse on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Dave Stephens, Mack Bradley, Clayton Melinkovich, Cali O’Hare, representing the Pinedale Roundup (via Zoom) and Carrie Long, County Clerk, present. 

Chairman White led those present in the Pledge of Allegiance. 

The agenda was approved with the addition of Shad Cooper at 12:30 p.m. on motion by Commissioner Noble, seconded by Commissioner Vickrey. 

The minutes of the previous meeting on January 17, 2023 were approved and ordered filed, on motion by Commissioner Vickrey, seconded by Commissioner Noble. 

Billy Pape, Road & Bridge, updated the Board on activities.  He also requested direction on pre-ordering a multi-purpose truck for the next budget cycle.  Pape stated that if he didn’t get on the list, he wouldn’t be able to purchase one until the following budget cycle.  The Board instructed Pape to order the truck as well as an additional one if he gets a second spot on the list. 

Pape also asked direction on maintenance on the Wardell / Swain Class 1 road.  He said some of the residents associated with the road are requesting more maintenance than what Road & Bridge equipment is capable of due to the condition of the road.  He stated the road is not located where it should be, and repairs and relocating would be extremely costly.  The Board instructed Pape to plow to a convenient turn around spot in the vicinity of Swain’s property. 

Eric Sacket, Rio Verde Engineering, informed the Board the plans are ready for the North Piney project and requested confirmation the Board wanted to use County Road Funds for the project.  The Board confirmed that it did. 

Mike Jackson, Rio Verde Engineering, and Sandy Wright, representing the Redstone Upper Green River Special Improvement District met with the Board to discuss options for replacing the bridge that spans the Green River. 

Andre Irey, Maintenance, updated the Board on maintenance activities.  He requested direction from the Board regarding the purchase of boilers for the Big Piney Library.  It was moved by Commissioner Noble, seconded by Commissioner Bradley to approve the purchase of boilers, not to exceed $100,000.  Motion carried. 

Monte Bolgiano and Betty Cheeney, representing the Recreation Board, advised that Tami Crosson had submitted a letter of resignation and Craig Smith had submitted a letter of interest.  Commissioner Noble made a motion to accept the resignation and approve the appointment of Craig Smith.  Commissioner Stephens seconded the motion.  Motion carried. 

Janna Lee, Public Health, requested approval of an MOU between the county and Wyoming Health Fairs.  Commissioner Noble made a motion to approve the MOU, Commissioner Vickrey seconded the motion.  Motion carried. 

Lee also requested the Board acknowledge she had created an internal cash handling policy.  Commissioner Noble made a motion to acknowledge the policy, Commissioner Vickrey seconded the motion.  Motion carried.

Cassie Crumpton, Treatment Court, along with Janna Lee, discussed Opioid funds with the Board and reviewed a plan to form a committee to oversee the use of the funds. 

Commissioner Noble made a motion to adjourn to Executive Session pursuant to W.S. 16-4-405(a)(ii) (personnel).  Commissioner Vickrey seconded the motion.  Motion carried. 

Open Session resumed.  Commissioner Noble made a motion to offer the County Administrator position to Jeness Saxton with an annual salary of $80,000 and a start date of March 1, 2023.  Commissioner Vickrey seconded the motion.  Commissioner Noble amended the motion to include having the County Clerk, Carrie Long, communicate the offer to Saxton.  Motion carried. 

Dave Doorn, Tonia Hoffman, and Dawn Walker, along with others representing the Hospital Board, met with the Board to request an additional 9.2 million in funding for the new hospital. After discussion, Chairman White requested Doorn and Hoffman come to the next meeting to give the BCC time to consider the request. 

Shad Cooper, Unified Fire; Mike Henn, Soil Conservation; and Ivan Geroy, Forest Service, met with the Board to update on the progress of the collaborative and forester discussion.

Ed Wood, Morgan Fischer, and John Graham, representing the Jackson Fork Ranch, met with the Board to request an appeal of the interpretation of Planning and Zoning regulations made by Planning Administrator, Dennis Fornstrom.  After discussion, Commissioner Bradley made a motion to interpret that the underlying right of recreational purposes of Agriculture zoning district is not forfeited upon a Conditional Use Permit designation for a guest ranch.  Commissioner Noble seconded the motion.  Motion carried 4 to 1 with Commissioner Vickrey voting nay. 

Commissioner Noble made a motion to approve the Cooperative Law Enforcement Operating & Financial Plan with the USDA, Forest Service and the county for forest patrol.  Commissioner Vickrey seconded the motion.  Motion carried.   

Commissioner Bradley made a motion to approve the MOU between the Sublette County and the Wyoming County Commissioners Association as a cooperating agency in the Bureau of Land Management’s effort to revise the greater sage grouse plan.  Commissioner Noble seconded the motion.  Motion carried. 

Surety Bonds for Elizabeth N. Cheeney (Bookkeeper, Recreation Board), Dave Bell (Treasurer, Hospital Board) and Kristi L. Gray (Town Clerk, Big Piney) were approved on motion by Commissioner Noble, seconded by Commissioner Stephens.  Motion carried.

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules, the Commission hereby gives notice of the Application of Rocky Mountain Power (RMP or the Company) for a non-situs Certificate of Public Convenience and Necessity (CPCN) to construct its Boardman-to-Hemingway transmission line as more fully described below:

1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility, as defined by Wyoming Statute § 37-l-101(a)(vi)(C), subject to the Commission's jurisdiction pursuant to Wyoming Statute § 37-2-112.

2. On February 6, 2023, the Company filed an Application, together with supporting testimony and exhibits, requesting the Commission grant a non-situs CPCN to construct the Boardman-to-Hemingway transmission line (segment H of the Energy Gateway Project) (B2H). The Company included a Petition for Confidential Treatment and Protective Order with its Application.

3. The Company’s proposed Boardman-to-Hemingway is an approximately 300-mile-long, 500-kV transmission line that will extend from a proposed switching station near Boardman, Oregon to the existing Hemingway Substation located in Owyhee County, Idaho. Approximately 274 miles of the transmission line is located in five Oregon counties: Malheur, Baker, Union, Umatilla, and Morrow Counties. A 24-mile segment of the Project will be in Owyhee County in Idaho. The project also consists of a newly constructed switching station near Boardman, Oregon, ten communication stations within the right-of-way of the transmission line, and construction of the Midline Series Capacitor substation.

4. The Company has partnered with Idaho Power Company (IPC) and the Bonneville Power Administration (BPA) to develop the Project. IPC is the overall project manager, responsible for permitting, design, procurement, and construction. IPC will fund and own 45.45 percent and the Company will fund and own 54.55 percent.

5. The Company states the proposed project is necessary for the following reasons: 1) it increases the ability to move resources across and between both of the Company’s balancing authority areas and will allow the Company to export 818 megawatts (MW) of additional generation capacity from Wyoming, Utah, and Idaho generators to Oregon, Washington, and California customers; 2) it enables the Company to avoid higher cost transmission and generation investments to serve the system, including Wyoming, that would be required absent B2H; and 3) it reduces the cost of third-party transmission service included in the net power costs allocated to Wyoming retail customers. The Company states that construction of B2H is expected to produce total-system cost savings of $1.7 billion. The Company states that IPC must begin construction in July 2023 to have the project come into service by 2026.

6. The Company expects its share of the estimated total cost of the project to be between $800 and $900 million, which is estimated to increase Wyoming customer rates by an estimated 1.95 percent once the Company proposes to include the costs of the project in a future general rate case. The Company intends to finance the project through its normal internal and external sources of capital.

Department of Environmental Quality, Division of Air Quality PUBLIC NOTICE:  In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Jonah Energy LLC (CMP100053) to modify and operate the Stud Horse Butte 122-10 Central Facility (F018639) with the removal of wells and production equipment, with one reboiler overheads condenser, one TEG flash tank separator and one common smokeless combustion device to control volatile organic compound and hazardous air pollutant emissions associated with the dehydration unit, condensate tanks, active produced water tanks and pneumatic pumps, located in the SW1/4SW1/4 of Section 10, T29N, R108W, approximately sixteen (16) miles southwest of Big Sandy, in Sublette County, Wyoming.  Jonah Energy LLC has met the demonstration requirements under Chapter 6, Section 2(c)(ii) for this permitting action since current emissions are less than emissions during the baseline period.  VOC emissions have decreased 4.9 TPY from the baseline period and NOx emissions have decreased 3.2 TPY from the baseline period.  These reductions have been added to Jonah Energy LLC’s offset bank to use for future permitting actions.

Therefore, Jonah Energy has met the offset requirements for VOCs and NOx.

NORTH PINEY COTTONWOOD CR 23-143 ROAD RECONSTRUCTION PROJECT

for SUBLETTE COUNTY, WYOMING

Sealed BIDS are requested for work described in the Project Manual for the North Piney Cottonwood CR 23-143 Road Reconstruction Project, dated February 20, 2023, prepared by Rio Verde Engineering, 804 Hoback Street, P.O. Box 642, Pinedale, Wyoming 82941, 307-367-2826.

BIDS will be received by Rio Verde Engineering until 2 pm local time on Monday, April 3, 2023, at which time said BIDS will be opened and read aloud.

The work consists of approximately 5 miles of road reconstruction; including milling the existing asphalt, culvert replacements, placement of 71,000 CY of Pitrun, 41,500 TN of Crushed Base a 22,100 TN of Asphalt and miscellaneous appurtenances.

CONTRACTORS shall be required to accompany each bid with a BID Bond with sufficient surety, or a certified check, cashier’s check or bank draft upon some reputable bank payable to Sublette County for at least ten (10) percent of the total amount of the BID.  The bond, check or bank draft shall be forfeited as liquidated damages, if the CONTRACTOR, upon the letting of the contract to him, fails to enter into the contract within ten (10) days after it is presented to him for that purpose or fails to proceed with the performance of the contract.  The BID Bond, draft or check shall be retained by Sublette County until proper bond to secure performance of the contract has been filed and approved.  All the above is to be in accordance with 15-1-113 and 16-6-101 to 121, Wyoming Statutes, 2023.

The right is reserved by Sublette County to reject any and all BIDS, and to waive any irregularity or informality in the BID process.  BIDS may not be withdrawn for thirty days after the date of opening.

E. An order of sale and decree of foreclosure of the Property in accordance with Wyoming law, where (i) the Plaintiff is to provide such publication and notice as is required pursuant to W.S. § 1-18-101, (ii) the Plaintiff is permitted to be a purchaser at the foreclosure sale and is permitted to “credit bid” the amount owed to it, (iii) when any time for redemption has elapsed, the Sheriff or other officer conducting the sale shall execute a deed to the purchaser of the Property at the sale and that the purchaser be let into possession of the Property on production of said deed;
