INVITATION FOR SEALED BIDS

Sale of Surplus Equipment & Property

Town of Marbleton, WY

The Town of Marbleton is seeking sealed bids for the sale and removal of surplus equipment & property.  All bids must be received by 12 p.m. on May 10, 2024 in the Clerk’s Office, 10700 Hwy 189, Marbleton, WY 83113.  Bids received after this date and time will be returned unopened to the bidder.  Bid opening will be held at 2pm at the Marbleton Town Hall on Friday, May 10, 2024.  Bids will be awarded at the Town Council meeting at 5pm on Monday, May 13, 2024. 

Please contact the Town Hall to obtain a bid sheet to be used for this sale.  Bid sheets can also be emailed when requested.

Each submitted bid should be in a sealed envelope marked, Town of Marbleton, Sale of Surplus Property.  If mailed, the bid submission should be in a similarly marked separate sealed envelope to protect against the bid being opened in error. 

Items offered for sale, unless otherwise noted, may be viewed during business hours or upon request at the Marbleton Maintenance Shop at 601 Taylor Avenue in Marbleton.

**The Town reserves the right to reject any and all bids if deemed to be in the best interest of the Town.

**All bids will be evaluated separately.  Collective bids will be rejected.

**All surplus property will be sold “as-is”.  The Town of Marbleton makes no express or implied warranties on the items.

**The winning bidders will be notified and be required to submit full payment prior to removing any property.  Bank checks, credit cards, and cash will be accepted.  When payment has been received a Town official will authorize the release of the purchased property.  Successful bidders must pick up their items within one week of the items release by the Town, or the item and the bid will be forfeited.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, the Commission hereby gives notice of the Application of Rocky Mountain Power (RMP or the Company) for authority to cancel tariff Schedule 197, 2017 Federal Tax Act Adjustment, as more fully described below.

1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.

2. On April 8, 2024, RMP filed its Application, requesting authority to cancel tariff Schedule 197, and remove credits related to the 2017 Tax Cuts and Jobs Act (TCJA) to customers due to the excess deferred income tax being fully amortized, effective July 1, 2024.

3. RMP recorded the difference between the federal income tax liability in effect on December 31, 2017, and January 1, 2018, per Commission Order in Docket Nos. 20000-510-EA-17, 90000-134-XO-17, 20000-536-ER-18, 20000-560-EA-19, and 20000-578-ER-20. This was done with the intention of returning the benefit to customers under Commission specified terms, which included returning TCJA benefits over a period of 3 years. RMP states it has returned the TCJA benefits to customers, and as of July 1, 2024, the Company expects the remaining tax balance to be fully amortized, rendering Schedule 197 unnecessary.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, the Commission hereby gives notice of the Application of Rocky Mountain Power (RMP or the Company) for authority to Establish Final Low-Carbon Energy Portfolio Standards pursuant to the provisions of Wyoming Statute § 37-18-102 and Chapter 3, Section 38 of the Commission’s rules, as more fully described below.

1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility subject to the Commission's jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.

2. On March 29, 2024, RMP filed this Application, requesting authority to establish Final Low-Carbon Portfolio Standards pursuant to Wyoming Statute § 37-18-102, Commission Rule Chapter 3, Section 38, and Docket No. 20000-616-EA-22 (Record No. 17032). It addresses Dave Johnston Unit 4 and Jim Bridger Units 3 and 4. These units are utility owned, coal-fired generation facilities.

3. RMP states it has completed the submission and evaluation phases of the Carbon Capture, Utilization and Storage (CCUS) Request for Proposals (RFP). The RFP was issued in November 2022, and later supplemented with a Request for Information (RFI) in February 2023. The Company received one proposal in the RFP, and seven information packages as a result of the RFI. RMP proposes in this Application that the Commission approve a feasibility study (with expectation of progressing into a pre-front-end engineering and design (FEED) or pre-FEED study) for a solids fuel-fired Allam Fetvedt Cycle (AFC) project located at either the Dave Johnston or Wyodak facility; a FEED study for an amine-based carbon capture retrofit at Jim Bridger Units 3 and 4; and that the Commission decline to require a specific low-carbon portfolio standard at this time.

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules and Regulations, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) requesting authority to increase rates to recover deferred Net Power Costs (NPC) under Tariff Schedule 95; and to increase rates pursuant to Tariff Schedule 93, Renewable Energy Credits (RECs) and Sulfur Dioxide (SO2) emission allowances, as more fully described below:

1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming under certificates of public convenience and necessity issued by the Commission. RMP is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-1-101(a)(vi)(C) and 37-2-112.

2. On April 15, 2024, RMP filed an Application requesting authority to revise rates pursuant to two different rate schedules. The Company proposes to increase its Tariff Schedule 95 Energy Cost Adjustment Mechanism (ECAM) rates by approximately $84.3 million to recover de-ferred NPC. The Company also proposes to increase its Tariff Schedule 93 REC and SO2 Revenue Adjustment Mechanism (RRA) rates by approximately $2.1 million to account for sales of RECs and SO2 emission allowances. The Company requests interim approval of the proposed rates effec-tive for usage on and after July 1, 2024, subject to further review.

3. The following table summarizes the proposed price changes by tariff rate schedule. Within each rate schedule, the percentage change to individual customers may be higher or lower than the average due to rate design, customer load factors, and usage characteristics. The combined effect of the 2024 RRA and ECAM in this Application represents an overall proposed rate increase of approximately $86.4 million or approximately 12.3 percent.

SETTING PUBLIC HEARING

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given that a public hearing is scheduled regarding Questar Gas Company d/b/a Dominion Energy Wyoming (DEW or the Company) and Enbridge Quail Holding, LLC (Enbridge) for approval of the reorganization and sale of Fall West Holdco, LLC (Fall West) to Enbridge. The public hearing is set to commence on Thursday, May 23, 2024, at 9:00 a.m. in the Commission’s hearing room located at 2515 Warren Avenue, Suite 300, in Cheyenne, Wyoming.

1. DEW is currently a wholly owned subsidiary of Dominion Energy Questar Corporation, which itself is a wholly owned subsidiary of parent company, Dominion Energy, Inc., a Virginia corporation engaged in the business of supplying energy services in 16 states including natural gas services in Utah, Wyoming, and Idaho. DEW serves approximately 28,000 customers in southwestern Wyoming, including customers in Rock Springs, Green River, Kemmerer, Diamondville, and Evanston. DEW is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-1-101(a)(vi)(D) and 37-2-112.

2. On September 5, 2023, DEW’s parent company, Dominion Energy, Inc., announced its intention to sell DEW, Wexpro Company, and other related entities to Enbridge, Inc. On September 8, DEW filed a joint Application for the partial reorganization and transfer of ownership of DEW to Fall West under Docket Nos. 30010-217-GA-23 and 30027-1-GA-23. On October 20, 2023, DEW filed a joint Application with Enbridge for approval of the sale and corporate reorganization of Fall West to Enbridge. DEW will remain under the regulatory jurisdiction of the Commission.

3. Wyoming Office of Consumer Advocate (OCA) filed a notice to intervene in this matter on October 20, 2023.

4. The Company states that the reorganization will not adversely affect DEW’s operations and ability to provide the public with safe and reliable utility service. Per the Application, no costs associated with reorganization will be allocated to Wyoming customers and the reorganization will not impact Wyoming customers’ rates.
