FORMATION OF DANIEL MOSQUITO IMPROVEMENT DISTRICT

On October 3, 2023, a petition was filed with the board of County Commissioners of Sublette County, Wyoming, for the formation of Daniel Mosquito Improvement District, to provide mosquito abatement.

The petition will be heard at a public hearing before the Board of County Commissioners in the Commissioners Meeting Room, Sublette County Courthouse, Pinedale, Wyoming at the hour of 10:45 a.m. on the 21st day of November, 2023.

The petition may be inspected in the Office of the County Clerk, Sublette County, Wyoming, during regular business hours.

The proposed method of financing the improvements or services will be by the levy of a tax upon future residents living within the addition to the existing District.

The Board of County Commissioners met in regular session in the Commissioners’ Meeting Room of the Sublette County Courthouse on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Dave Stephens, Mack Bradley, Jeness Saxton, Clayton Melinkovich, Joy Ufford representing the Pinedale Roundup, and Carrie Long, County Clerk, present. 

Chairman White led those present in the Pledge of Allegiance. 

The agenda was amended on motion by Commissioner Noble to add a request for a special prosecutor by the County Attorney and add a property tax refund discussion by the Treasurer.  Commissioner Bradley seconded the motion.  Motion carried.

The minutes of the previous regular Commissioner meeting held on September 19 were approved and ordered filed on motion by Commissioner Vickrey, seconded by Commissioner Stephens.

Billy Pape, Road & Bridge, updated the Board on activities.  He asked direction from the Board regarding entities that are doing work for the county being allowed to have free dumping for construction debris, specifically, the Hospital District.  He stated he had been directed to allow debris from the demolition of the Public Health building but had questions about additional debris from current construction.  He stated it would also be helpful it if department heads would let him know to expect construction debris for county projects.   The Chairman instructed the County Administrator, Jeness Saxton, to communicate with department heads regarding Pape’s request.  He also directed Pape the contractor with the Hospital District would be required to pay standard dumping fees. 

Monte Bolgiano and Roger Weber, Recreation Board, met with the Board to discuss pedestrian / bike path maintenance.  Also involved in the discussion were Betty Cheeney, Kara Losik, and Abe Pearce.  After discussion, Chairman White directed Bolgiano to come back to the Board of County Commissioners with a written plan of maintenance schedules and responsibilities divided between the towns, county and Rec Board with the county having responsibility of capital work.

Andre Irey, Maintenance, updated the Board on projects and activities.

Jean Hayward presented a Petition of Formation for an Improvement and Service District with a proposed name of Daniel Mosquito Abatement District – pursuant to W.S. 18-12-106 and 107.  Also presented were Letters of Certification by the County Clerk and the County Assessor. The Board accepted the Petition as filed, initiating a notice of hearing to be published in at least three (3) public places and published by two (2) insertions in a newspaper of general circulation with the date of the public hearing to be held on November 21, 2023. 

Hayward also requested financial assistance with the election pursuant to W.S. 22-29-113c.  Commissioner Noble made a motion to assist with the election in an amount not to exceed $500.  Commissioner Vickrey seconded the motion.  Motion carried. 

Kenna Tanner, Search & Rescue, updated the Board on summer rescues and activities. 

Clayton Melinkovich, County Attorney, presented a Resolution for the appointment of a Special Prosecutor.  Commissioner Noble made a motion to approve the Resolution, Commissioner Bradley seconded the motion.  Motion carried. 

Commissioner Bradley made a motion to approve the extension of completion of work between Sublette County and the University of Wyoming Survey & Analysis Center for an economic study until the end of the year.  Commissioner Noble seconded the motion.  Motion carried.   

Andrea Jean, Human Resources, and Grant Golden, Ice Rink, met with the Board regarding staffing issues at the Ice Rink.  Jean stated she had discussed the needs with Golden and recommended he hire two part-time employees for the winter season.  The Board agreed and instructed Golden to proceed with hiring an additional part-time employee.

Janet Montgomery, Clerk of District Court, and KC Lehr, Sheriff, met with the Board to request direction on planning a new Justice Center or remodeling the Courthouse.  Sheriff Lehr stated prior studies have shown the Courthouse is not suitable for expansion.  Commissioner Noble suggested a committee be formed to review the needs of the elected officials and Judges that would be affected by any changes.  Commissioners Stephens and Bradley offered to be on the committee as well.  Chairman White directed County Administrator, Jeness Saxton, to facilitate and organize a meeting. 

Accounts Payable was approved as presented on motion by Commissioner Noble, seconded by Commissioner Vickrey.  Motion carried.

Payroll, in the amount of $1.178,407.95 was approved on motion by Commissioner Vickrey, seconded by Commissioner Bradley.  Motion carried. 

Catering permits for Elkhorn Trading Post, LLC, Boulder Bar & Grill, and Eagle Bar, LLC were approved on motion by Commissioner Noble, seconded by Commissioner Vickrey.  Motion carried. 

Commissioner Bradley made a motion to approve Surety Bonds for Debbie Smith (Treasurer / High Meadow Ranch Property Owners) and Valerie Williams (Treasurer / Big Piney Cemetery District).  Commissioner Noble seconded the motion.  Motion carried. 

Commissioner Noble made a motion to approve Tax Roll Corrections for Ultra Resources, Inc. in the amount of -$311.62 and Southern California Public POW in the amount of -$10,986.04.  Commissioner Bradley seconded the motion.  Motion carried with Chairman White abstaining from voting. 

Dennis Fornstrom, Planning & Zoning, met with the Board to discuss two items. The first item, a request for a variance for rural residential setbacks by Mike Welsh to allow a building structure to come within 10 feet of the rear property line was denied on motion by Commissioner Stephens, seconded by Commissioner Vickrey.  The motion to deny passed 3 to 2 with Commissioners Noble and White voting nay. 

The second item from Fornstrom was a request for a Partial Vacation and Replat of property owned by Robert Morin and Robert Wilstead (Tract 14, Sheet 9 and Tract 16, Sheet 8 of the Hoback Ranches Subdivision).  Commissioner Noble made a motion to approve the application.  Commissioner Bradley seconded the motion.  Motion carried. 

Clayton Melinkovich, Jeness Saxton, and Mike Henn discussed current Public Land issues.  The Board agreed to attend a Governor’s Coordination Meeting on October 12. 

Emily Paravicini, Treasurer, discussed the State Property Tax refund with the Board.  She requested direction from the Board regarding the $40,000 set aside for tax refund by the Board and whether they wanted to increase the amount.  The Board instructed Paravicini to leave the amount at $40,000 and to coordinate with Clerk Long in executing payment to the taxpayers qualifying for a refund. 

The meeting was adjourned at 2:25 p.m.

The Wyoming Public Service Commission (Commission) has approved Pinedale Natural Gas, Inc.’s Application for authority to pass on a wholesale natural gas cost increase of $0.126 per therm and to reduce the emergency Gas Cost Reconciliation (GCR) Surcharge by $0.050 per therm, subject to notice, protest, intervention, possible hearing, refund, change, further investigation, and further order of the Commission.

1. A typical residential gas customer using 113 therms per month for the rate-effective period of October 2023 through March 2024, may expect a monthly gas bill increase of $8.62, or 6.1%, before taxes. Actual bills will vary with usage.

2. The Application is available at the Company’s business office in Pinedale, Wyoming, during regular business hours, or at the Commission’s office or at: https://dms.wyo.gov/external/publicusers.aspx (enter Record No. 17405).

3. Anyone desiring to file an intervention petition, request for a public hearing, or a statement, public comment or protest in this matter must file, in writing, with the Commission on or before November 27, 2023. To all persons, firms, or corporations who have any claim for any work done, or any material furnished to VTI Security, PO Box 860660, Minneapolis, MN 55486 for security upgrades.

You are hereby notified that Sublette County School District # 1, 665 N Tyler Ave., PO Box 549, Pinedale, Wyoming 82941, has accepted substantial completion according to the Contract Documents and rules set forth in the contract between Sublette County School District # 1 and the aforesaid Contractor of the work in connection with the security upgrades and that said Contractor is entitled to final settlement thereof.

You are further notified that upon December12, 2023, being the 41st day after the first publication of the notice, said Sublette County School District # 1 will pay VTI Security, the full amount due under said contract, and in the event your claim is not filed with Sublette County School District # 1 prior to said 17th day of October 2023, same shall be waived.

This notice is given pursuant to Section 16-6-116, Wyoming Statutes.

The Town Council of the Town of Pinedale met in regular session on Monday, October 9, 2023, in the conference room of the Pinedale Town Hall.

The meeting was called to order by Mayor Matt Murdock at 5 p.m. Council members present:  Tyler Swafford, Dean Loftus, Judi Boyce and Scott Kosiba.  Those in attendance included: Dawnita Griffith, representing the Triangle Addition, Angelovic Amendment; Robert Galbreath, representing the Pinedale Roundup; Tressa Barnes and Ryan Schmidt, representing Union Telephone; Dezi Saathoff, representing SAFV Task Force;  Max Lockett; Ed Wood, Town Attorney; Abram Pearce, Director of Public Works; and Chad Mitchell, Planning & Zoning Administrator. Attending online were Tesa Manning; and Maureen Rudnick, Assistant Clerk.

Mayor Murdock led those present in the Pledge of Allegiance.

Motion by Councilman Swafford to accept the agenda as published. Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve the September 25, 2023, regular Town Council meeting minutes.  Seconded by Councilman Kosiba.  Motion passed 4-0-1; Councilman Swafford abstained.

Mayor Murdock declared the Public Hearing regarding the Triangle Addition, Angelovic Amendment, open at 5:02 p.m.  Chad Mitchell gave a brief description of the requested plat amendment. No written comments were received.

Motion by Councilman Swafford to approve the preliminary plat of the Triangle Addition, Angelovic Amendment.  Seconded by Councilman Loftus.  Motion passed 5-0.

Hearing no additional comments or questions, Mayor Murdock closed the public hearing at 5:06 p.m.

Ms. Dezi Saathoff presented the SAFV Task Force Domestic Violence Awareness Month Proclamation for October 2023.

Ryan Schmidt reported on the progress of the Union Telephone broadband buildout.

Motion by Councilman Loftus to approve the consent agenda items as published.  Seconded by Councilwoman Boyce.  Motion passed 5-0.  Consent agenda items approved were the final payment for the Expand E GA Apron Project to HK Contractors, Inc., in the amount of $49,987.81; bid specifications for procurement of a new flatbed diesel snowplow truck; the purchase of salt from Brenntag Pacific, in an amount not to exceed $15,500; purchase of sodium carbonate 10% from Brenntag Pacific, in an amount not to exceed $8,000; and the purchase of 80 street banners from Display Sales, not to exceed $7,500.

Motion by Councilman Swafford to enter Executive Session to discuss real estate at 5:23 p.m.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilman Swafford to exit Executive Session at 5:58 p.m.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilman Swafford to re-enter regular session.  Seconded by Councilman Kosiba.  Motion passed 5-0.

Motion by Councilwoman Boyce to adjourn the meeting. Seconded by Councilman Kosiba. Motion passed 5-0. The meeting adjourned at 6:01 p.m.
