Big Piney man returned here for local felonies

SUBLETTE COUNTY – A Big Piney man in federal custody in Nebraska was returned to face felony drug and burglary charges in Sublette County.

The case against Timothy W. Davis, 55, was bound over to Ninth District Court after appearing in Circuit Court on Tuesday, Oct. 23.

Davis was charged in September with aggravated burglary involving a deadly weapon; two misdemeanor counts of theft of less than $1,000; two felony counts of possession of THC, third or more offense; and two felony counts of possession of meth, third or more offense.

The local case against Davis was stayed pending the outcome of a federal charge against him for being a felon in possession of a firearm. Davis appeared in Cheyenne’s U.S. District Court on Aug. 2, where Judge Alan B. Johnson sentenced him to 100 months in prison to be followed by three years of supervised probation. Davis was also ordered to pay a $500 fine and $100 special assessment, according to the Attorney General’s Office.

Davis was initially indicted March 15 as a felon possessing a firearm and for possessing a stolen firearm; the second charge was dismissed after Davis agreed to plead guilty on May 23. That trial had been set for May 29, according to court records.

On or around Jan. 19, Davis was found in possession of a Zastava rifle and a Remington shotgun during an investigation by the Sublette County Sheriff’s Office and the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Sublette County Attorney Clay Kainer had filed a petition to have Davis returned to Sublette County custody “as we still have an open criminal case against him here.”

Davis had been facing a felony charge of conspiracy with one or more people to commit a controlled substances offense, delivery of meth from September to November 2017.

Sublette County Detective Danielle Cooper said in an affidavit that she and Detective Karson Turner met twice with “a confidential informant” in January at the Marbleton Sheriff’s Office, records show.

The confidential informant alleged that Davis had approached him/her about buying some meth together from a Rock Springs man, the affidavit says. The informant described transactions, travel, texts, payments and conversations that occurred with Davis and the Rock Springs man. The informant also said he/she received and delivered meth as part of the transactions and received free “gift” amounts of meth, it says.

The confidential informant also told the detectives he/she had stopped all drug activities since December 2017 and had not used any since. The detectives also met with a “known but not identified source” of information, who allegedly said Davis had sold him/her meth, the affidavit states.

Davis was charged with that felony on Jan. 22 in Circuit Court where Judge Curt Haws set bond at $100,000 cash only. The judge added “do not possess any firearms” as a release condition after Davis’s preliminary hearing on Feb. 13, when the case was bound over to Ninth District Court. District Judge Marv Tyler had heard Davis’s not guilty plea at his March 8 arraignment, set a trial date and amended the bond.

In the meantime, Davis was taken into custody in Scottsbluff, Neb., where he remained to be sentenced for the firearm possession charge. On June 1, his attorney Scott Sargent filed a motion to vacate the Ninth District Court trial because Davis had pleaded guilty to the federal firearm charge in Cheyenne. Judge Tyler ordered that trial vacated on June 4. n
