NOTICE OF FORECLOSURE SALE NOTICE IS HEREBY GIVEN that pursuant to WYO. STAT. §§ 34-4-101 through 34-4-113, Peter D. Holdings, llc as assignee ("Mortgagee") of the Mortgage (as defined herein) intends to foreclose an Oil and Gas Leasehold Mortgage and Security Agreement ("Leasehold Mortgage") made by Black Diamond Energy of Delaware, Inc., a Delaware corporation ("Mortgagor") and in favor of S& T Bank with respect to all rights, titles, interests, and estates of mortgagor in and to the Mortgaged Premises, as the same are defined in and more particularly described in the Leasehold Mortgage and Collateral Assignment of Leases and Pipelines (“Collateral Assignment”) dated May 2,2007, and recorded on May 16,2007, in the County Clerk's Office of Sublette County, Wyoming at Book Volume 135 O&G, Page 9, instrument number 327427with a first amendment to Oil and Gas Leasehold Mortgage and Security Agreement-Black Diamond Energy of Delaware, inc dated January 29, 2009; recorded February 6,2009 in Sublette County (Wyoming) Records at Book 139 O & G, page 506, instrument number 341066 assigned by S&T Bank to Mortgagee to Mitchell Resources, LLC on May 19, 2011 which then assigned the S & T Bank Mortgages to Peter D. Holdings, LLC on May 12, 2014 and recorded on October 14, 2014, in the County Clerk's Office of Sublette County, Wyoming at O & G Book Volume 155, Page 318 Document #0374747. The Mortgage will be foreclosed by sale to the highest bidder at a public auction of the equipment and inventory described pursuant to a power of sale contained in the Mortgage. Black Diamond Energy of Delaware Inc.(Mortgagor) has defaulted under said Mortgage. The amount of the Note now due and owing under the Mortgage is $9,927,858.30. The Oil Field Equipment, including pipelines, separators, tanks and contents (Oil Inventory) to be foreclosed are Parcel ID Number 90006824OG Local ID number 09PP06824 in Tax District 900, and can also be found attached to the Mortgage set forth above, and the amendments thereto, on file with the County Clerk's Office of Sublette County, Wyoming. NOTICE-IS –HEREBY-GIVEN, pursuant to Wyoming Statues Section 34-4-109 (2003) that the foreclosure sale of the above Mortgage will take place at 10:00 a.m. on Friday morning @ 10am September 24, 2021 at the Sublette County Courthouse in Pinedale, Wyoming 82941. The property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale and any prospective purchaser should research the status of title before submitting a bid. PROPOSED DISCHARGE OF DREDGED OR FILL MATERIAL TO FREMONT LAKE
The Wyoming Department of Environmental Quality (WDEQ) has received a request from Rio Verde Engineering on behalf of Titan Assets, LLC for State certification of U.S. Army Corps of Engineers (USACE) Nationwide Permits #13 and #39, for discharge of dredged or fill material to Fremont Lake near Pinedale, Wyoming. The purpose of the project is to expand the Lakeside Lodge Marina. Fremont Lake is designated a Class 1 water where point source discharges are prohibited except for storm water and construction related discharges. This certification will require meeting the provisions in Chapter 1, Section 7(b) of the WDEQ Water Quality Rules, which allows these discharges under certain circumstances. Proposed activities include extending the existing breakwater along with constructing a second breakwater using locally sourced boulder with a total fill area of 0.25 acre; dredging 2,850 cubic yards (CY) of lake bottom under the marina; and stabilizing 282-feet of shoreline with 214 CY of locally sourced rock. No wetlands will be impacted.
