PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given that a public hearing is scheduled regarding the Application of Rocky Mountain Power (RMP or the Company) for  authority to modify the avoided cost methodology and reduce the contract term of its Public Utility Regulatory Policies Act (PURPA) Power Purchase Agreements (PPA) with Qualifying Facilities (QFs).  The Office of Consumer Advocate, Rocky Mountain Coalition For Renewable Energy, Renewable Energy Coalition, Northern Laramie Range Alliance, Wyoming Industrial Energy Consumers, VK Clean Energy Partners, LLP and Two Rivers Wind, LLC, have intervened in this matter.  The public hearing is set to commence on Tuesday, July 9, 2019, at 9:00 a.m., in the Commission’s hearing room located at 2515 Warren Avenue, Suite 300, in Cheyenne, Wyoming.

RMP is a public utility, as defined by Wyo. Stat. §37-1-101(a)(vi)(C), providing retail electric public utility service under certificates of public convenience and necessity issued by the Commission. RMP is subject to the Commission’s jurisdiction pursuant to Wyo. Stat. §37-2-112.

On November 2, 2018, the Company submitted an Application together with testimony and exhibits requesting authority to modify the avoided cost methodology and reduce the contract term of its PURPA PPAs with QFs.  Specifically, RMP requests the Commission issue an order: [i] approving a reduction of the maximum contract term of prospective PPAs with QFs under the PURPA of 1978 to seven years; [ii] modifying the Partial Displacement Differential Revenue Requirement methodology the Company uses to set avoided costs under Wyoming Schedule 38; [iii] to use the PDDRR to set rates under Schedule 37; [iv] revising the on-peak and off-peak definitions in Schedule 37; and, [v] modifying both Schedules 37 and 38 to improve the pricing and PPA negotiation process.

According to RMP, the change to QF PPA term length and the avoided cost changes proposed by the Company in this Application are not mutually exclusive. Instead, they operate as a package that, if approved, will help ensure that the Company’s ratepayers do not pay more than the Company’s avoided costs, while still giving QFs a fair opportunity to finance their projects and sell power to the Company.  The Commission’s ability to adjust the avoided cost methodology, and contract terms are the key tools FERC provided Wyoming to ensure that PURPA is implemented in a manner that remains just and reasonable, and in the public interest.

All interested persons are encouraged to attend the public hearing which will be conducted in accordance with the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission Rules and Special Regulations.  Interested persons may appear and be heard, either in person or through counsel, as provided by Commission Rule.

The Board of county Commissioners met in special session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. for the purpose of preparation of the FY20 budget, with David Burnett, Joel Bousman, Mack Rawhouser, Tom Noble, Doug Vickrey, Cat Urbigkit, Mary Lankford, and Carrie Long, County Clerk present.

Chairman Burnett led those present in the Pledge of Allegiance. 

The Board reviewed the Detention, Communications, Law Enforcement, Search and Rescue, and Emergency Management budgets with Sheriff KC Lehr and Assistant Shannon Gehlhausen.

The Board heard requests from the following departments:

Billy Pape, Road and Bridge Supervisor, reported on department activities and updated the Board on the Meadowlark Lane paving project. He stated the Crusher is operational. Nothing new to report from the Landfill.  Commissioner Noble requested an inventory of Road & Bridge equipment.

Eric Marincic, scheduled at 9:30 A.M., did not attend.

The Board moved on to approve Accounts Payable by motion from Commissioner Noble, seconded by Commissioner Vickrey.  Motion carried.

The Museum Board represented by Mark Eatinger and Gary Nealy met with the Board to submit their Budget Request.  Also present was Mary Lankford, former County Clerk, with an intent to clarify information submitted by the Museum Board. According to Eatinger, the Museum Board had requested an additional $28,400 that wasn’t funded when they were under the impression that it would be funded. Lankford confirmed the misunderstanding saying she did not recall any assurances of funding. The meeting was not recorded. Lankford stated she has been working with the Museum Board to help them get their Budget corrected and that they were very close. She requested additional time to help them get solid numbers together.

Brandon Scurlock, Wildlife Coordinator, Wyoming Game & Fish Department and Mike Schmidt, Wyoming Game & Fish Commission, and Jill Randall, Wyoming Game & Fish, updated the Board on the Dry Piney Wildlife Highway Crossing.  Brandon reported the Wyoming Game and Fish Commission recently approved $1.25 million towards wildlife highway crossing improvements across Wyoming. The Dry Piney project in Sublette County is one potential crossing for use of these funds. Two new migration corridors are currently in draft versions that cross Sublette County; the Sublette pronghorn herd and

Wyoming Range mule deer herd migration corridors. The WGFD has conducted several public meetings across Wyoming, including Pinedale. Addition outreach is occurring as well.

Shad Cooper, Fire Warden, and Todd Hurd with Forsgren & Associates, met with the Board with an update on the plans for the proposed fire station in Daniel. The current cost estimate, without engineering fees is $4,678,865.47. Commissioner Noble expressed concern with the estimate. Commissioner Vickrey said he strongly feels the additional fire station is not necessary. Commissioner Rawhouser suggested the Board not end the discussion, Commissioner Bousman suggested further examination into what part of

the project is for Fire and what part is for Road & Bridge.

Cooper along with Assistant, ML Baxley, met with the Board to submit their Budget request.

Upon motion by Commissioner Noble, the Board passed Resolution #19-100361B (Carrie Long, County Clerk, appointed as Public Records Person on 5/7/19). Commissioner Bousman seconded the motion.

Motion carried.

Old Business:  Commissioner Noble stated he had met with representatives from Union and confirmed they do have plans to bring Broadband into Sublette County.  He said they are in the process of building out the plans and will be scheduling meetings with the towns & county. He said there will be a public meeting at the Library and then a ground breaking ceremony the following day.  He stated the County Attorney’s office had drafted a letter to All West releasing them of their responsibilities, Noble made a motion to send the letter to All West. Commissioner Bousman seconded the motion.  Motion carried.

Wendy Bowman was present for public comments with updates on the Rural Health Care Board’s recent activities.

Todd Hurd, representing Forsgren & Associates, advised the Board that Adams Concrete had submitted a bid for the concrete foundations for the White Pine & Kismet towers in the amount of $137,518.35.

Commissioner Noble made a motion to accept the bid with a second from Commissioner Bousman. Motion carried.

He stated he would communicate with Billy Pape and planned on attending the next Commission meeting with the proposed agreement.

Department of Environmental Quality, Division of Air Quality PUBLIC NOTICE:  In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Jonah Energy LLC to modify the Stud Horse Butte 46-13 Central Facility (F023002), with the addition of production and equipment associated with eleven new wells, the Stud Horse Butte 7-13, 18-13, 32-13, 36-13, 46-13, 82-13, 83-13, 93-13, 95-13, 96-13 and 103-13, with three common smokeless combustion devices to control volatile organic compound and hazardous air pollutant emissions associated with the condensate tanks, active produced water tanks, pneumatic pumps and truck loading, located in the NW1/4SE1/4 of Section 13, T29N, R108W, approximately fifteen (15) miles southwest of Big Sandy, in Sublette County, Wyoming.  A Chapter 6, Section 2(c)(ii) demonstration in accordance with the Division’s Interim Policy has been conducted.  Emission offset requirements, if applicable, have been applied to this permitting action at a ratio of 1.5:1.0 for VOCs and 1.1:1.0 for NOx.  Permitting actions to date have resulted in a decrease in actual VOC emissions of 3618.8 tpy and a decrease in actual NOx emissions of 218.5 tpy.  Therefore, Jonah Energy LLC has met the offset requirements for VOCs and NOx.
