INVITATION FOR BIDS
Sealed bids, entitled “Bondurant Cemetery Irrigation System, Bondurant, Wyoming” will be received by Upper Green River Cemetery District, PO Box 1931, Pinedale, WY 82941 until 2:00 P.M. local time on April 26, 2022 in accordance with the plans, specifications and other contract documents.
At said place and time, and promptly thereafter, all proposals that have been duly received will be publicly opened and read aloud. No bid may be withdrawn within a period of sixty (60) days after the scheduled time for the opening of bids.
The scope of the project shall generally include, but not necessarily be limited to:
1. Irrigation system installation and trench restoration.
A pre-bid conference will not be held. However, bidders are encouraged to visit the site prior to submitting a bid. The Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex, or national origin.
Plans and specifications may be examined in the Upper Green River Cemetery District Office or in the Architect's Office. Copies of said documents may be obtained from the Landscape Architect, Steiner Thuesen PLLC, 1925 Grand Avenue #105, Billings, MT 59102, telephone 406-252-5545 or nathan@steinerthuesen.net. Digital copies are provided at no charge. Hard copies can be provided for a non-refundable reproduction charge of $100.00 per set, shipping charges may apply. Project Manager is Nathan Steiner. All bidders must be on the planholders list to submit a bid.
Each bid or proposal must be accompanied by a Certified Check, Cashier's Check, or Bid Bond payable to Upper Green River Cemetery District, in an amount not less than five percent (5%) of the total amount of the bid. Successful bidder(s) shall furnish an approved Performance Bond, Labor and Material Payment Bond, each in the amount of one hundred percent (100%) of the contract amount. Insurance as required shall be obtained by the successful bidder(s) and a certificate of that insurance shall be provided.
The right is reserved to reject any or all proposals received, to waive informalities in the bids, to postpone the award of the contract for a period not to exceed sixty (60) days, and to accept the lowest responsive and responsible bid which is in the best interest of the OWNER. In accordance with the provisions of Wyoming Statute Annotated §16-6-101, et seq., preferences are hereby given to contractors residing in Wyoming and to materials, supplies, agricultural products, equipment, machinery, and provisions produced, manufactured or grown in Wyoming, or supplied by a resident of the state, quality being equal to articles offered by the competitors outside of the state. OFFICIAL COUNTY COMMISSIONERS’ PROCEEDINGS
MARCH 15, 2022
The Board of County Commissioners met in regular session at the Marbleton Town Hall on this date at 9:00 a.m. with Joel Bousman, Tom Noble, Dave Stephens, Doug Vickrey, Clayton Melinkovich, Matt Gaffney, Brady Oltmans of the Pinedale Roundup, and Carrie Long, County Clerk, present. Commissioner White was excused.
Chairman Bousman led those present in the Pledge of Allegiance.
The agenda was approved on motion by Commissioner Noble, seconded by Commissioner Stephens with the removal of Emily Paravicini, Treasurer at 11:00 and addition of the Green River Cemetery District in the same time slot. Motion carried.
The minutes from the previous regular meeting held on March 1 were approved and ordered filed on motion by Commissioner Vickrey, seconded by Commissioner Noble. Motion carried.
Billy Pape, Road & Bridge, updated the Board on recent activities as well as the revised requirements from the Wyoming Department of Transportation regarding crush and pit run for the Wildlife Crossing between Big Piney and Labarge. It was moved by Commissioner Noble, seconded by Commissioner Stephens to amend the original agreement to provide up to 22,000 cubic yards of crush and up to 65,000 cubic yards of pit run. Motion carried.
Mike Jackson, Rio Verde Engineering, presented two bids for the 2022 chip seal project. Included in the bids were amounts for the Town of Pinedale chip seal with shared mobilization costs to be finalized when the project is complete and an amount from the Carmichael HOA to be paid before the project starts if they chose to participate. Commissioner Noble made a motion to accept the bid from H-K Contractors in the amount of $1,898,669.00, including the Town of Pinedale portion. Commissioner Vickrey seconded the motion. Motion carried.
It was moved by Commissioner Noble, seconded by Commissioner Stephens to accept the MOU between Sublette County and the Town of Pinedale for the chip seal project for the summer of 2022.
Mark Pape, Tegeler Insurance, advised the Board the current insurance carrier, Intact, is no long underwriting government entities. He recommended the Board accept a bid in the amount of $385,135.00 from Travelers for the annual renewal of county facility and vehicle insurance. Commissioner Noble made a motion to accept the recommendation, Commissioner Stephens seconded the motion. Motion carried.
Matt Gaffney, County Administration, reviewed allowable uses for the funds received from the American Recovery and Reinvestment Act. Chairman Noble said he would like to see department heads collaborate and give recommendation to the Board.
Paul Stille, Leo Riley & Co., CPAs, reviewed the FY21 Financial Statement and Audit with the Board, noting a significant decrease in tax revenue from the prior fiscal year.
Rich Greenwood, Greenwood Mapping, updated the Board on the aerial photography options and past projects. He requested direction from the Board regarding future projects. The Board advised Greenwood to proceed with getting bids and quotes with input from Laila Illoway, Assessor, regarding the needs of her office.
Jana Bloxham and Carmen Hittle, Green River Cemetery District, met with the Board to discuss a proposal to purchase property owned by Sublette County. The Board suggested the district re-open discussion with BLM with appropriate scope of request.
Clayton Melinkovich, Deputy County Attorney, advised the Board the lease with the Forest Service and the County for the land the Bondurant Fire Department is located will be up for renewal in 2025. Chairman Bousman stated he would follow up with the Forest Service.
Commissioner Noble made a motion to approve a letter of agreement with the Wyoming Behavioral Institute, as presented by Melinkovich, Commissioner Stephens seconded the motion. Motion carried.
Melinkovich, Tonia Huffman and Dave Doorn with the Hospital District, Janna Lee with Public Health, and Dawn Walker with the Sublette Center discussed status of the USDA loan and housing options for Public Health.
Accounts Payable in the amount of $461,619.35 were approved on motion by Commissioner Stephens, seconded by Commissioner Vickrey. Motion carried.

(CMP000768) to modify the Warbonnet 5-4 PAD (F017395) with the addition of production equipment, located in the SW1/4NW1/4 of Section 4, T30N, R108W, approximately ten (10) miles south of Boulder, in Sublette County, Wyoming. Ultra Resources, Inc. has met the demonstration requirements under Chapter 6, Section 2(c)(ii) for this permitting action since current emissions are less than emissions during the baseline period. VOC emissions have decreased 0.1 TPY from the baseline period and NOx emissions have decreased 0.6 TPY from the baseline period. These reductions have been added to Ultra Resources, Inc.’s offset bank to use for future permitting actions.

Department of Environmental Quality, Division of Air Quality PUBLIC NOTICE: In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Ultra Resources, Inc. (CMP000768) to modify the Warbonnet 15-3 PAD (F022458) with the addition of production equipment, located in the SE1/4SE1/4 of Section 3, T30N, R108W, approximately eleven (11) miles south of Boulder, in Sublette County, Wyoming. Ultra Resources, Inc. has met the demonstration requirements under Chapter 6, Section 2(c)(ii) for this permitting action since current emissions are less than emissions during the baseline period. VOC emissions have decreased 0.2 TPY from the baseline period and NOx emissions have decreased 0.4 TPY from the baseline period. These reductions have been added to Ultra Resources, Inc.’s offset bank to use for future permitting actions.
For the duration of the public comment period, the permit application, the agency’s analysis, and the public notice are available for public inspection online at https://openair.wyo.gov, utilizing facility ID F022458 and permit number P0034667 under permits. This material may also be viewed online, at the above URL, utilizing a public computer at the Sublette County Library, Pinedale, Wyoming. The Town Council of the Town of Pinedale met in regular session on Monday, March 28, 2022, in the Lovatt Room of the Sublette County Library.
The meeting was called to order by Mayor Pro Tem, Tyler Swafford at 5 p.m. Council members present: Judi Boyce, Isaac Best and Dean Loftus. Those in attendance included: Sheriff KC Lehr, representing Sublette County Sheriff’s Department; Robert Galbreath, representing the Pinedale Roundup; Joanie Christie, representing Sublette County Chamber of Commerce; Amber Anderson, representing the Pinedale Aquatic Center (PAC); and Town Director of Public Works, Abram Pearce. Luke Schultz, representing Wyoming Game & Fish; and Spencer Hartman attended via teleconference.
Mayor Pro Tem Tyler Swafford led those present in the Pledge of Allegiance.
Motion by Councilwoman Boyce to accept the agenda after amending it to include E-9, Airport Lobby Improvements. Seconded by Councilman Best. Motion passed 4-0.
Motion by Councilwoman Boyce to approve the minutes of the March 14, 2022, regular Town Council meeting as presented. Seconded by Councilman Best. Motion passed 4-0.

Amber Anderson, representing the PAC, presented their annual budget. She called attention to the proposed cost of living increase and the anticipated increase in utilities.
Motion by Councilman Loftus to approve awarding of the bid for the hydrovac trailer from Ditch Witch for a total of $89,144.90 and allow staff to complete its purchase. Seconded by Councilwoman Boyce. Motion passed 4-0.
Motion by Councilwoman Boyce to approve purchase of fertilizer from DBC Irrigation in the amount of $7,574.30. Seconded by Councilman Best. Motion passed 4-0.
Motion by Councilman Best to approve the purchase of signs for Fremont Lake from Fossil Industries not to exceed $4,200. Seconded by Councilwoman Boyce. Motion passed 4-0.
Motion by Councilwoman Boyce to approve the purchase and installation of fencing from Swift Creek Fencing in the amount of $7,935. Seconded by Councilman Loftus. Motion passed 4-0.
Motion by Councilman Best to approve the grant agreement with Wyoming Game and Fish, pending approval from the Wyoming Secretary of State, in the amount of $15,000 for the development of a Pine Creek habitat restoration final design. Seconded by Councilman Loftus. Motion passed 4-0.
Abram Pearce presented a draft Statement of Intent for the Transportation Alternatives Program for potential future grant applications. Council asked for amendments adding a safe pedestrian connection to the ballfields and the school, plus repairs to the existing pathway.
Motion by Councilwoman Boyce to deny Virginia Trotters request to waive late fees. Seconded by Councilman Best. Motion passed 4-0.
Motion by Councilwoman Boyce to approve Democrat, Maxwell Lockett and Republican, Emily Paravicini as the Town of Pinedale Election Canvassing Board for the upcoming Town election on May 3, 2022. Seconded by Councilman Best. Motion passed 4-0.
Motion by Councilman Loftus to approve the proposed airport lobby improvement, stipulating that it is at no cost to the Town. This includes not only the materials and labor to install, but also future efforts to leverage this in future lease discussions upon completion of the upcoming RFP for the FBO lease. Seconded by Councilman Best. Motion passed 4-0.
Motion by Councilwoman Boyce to approve Resolution 2022-02, Realignment and Amendment of the Budget, for fiscal year 2021-2022. Seconded by Councilman Loftus. Motion passed 4-0.
Motion by Councilman Best to approve Resolution 2022-03, setting the location of the 2022 Town election. Seconded by Councilwoman Boyce. Motion passed 4-0.
Motion by Councilman Loftus to approve Ordinance 698, on third read, an Ordinance of the Town of Pinedale, State of Wyoming, annexing adjacent and contiguous land (Pinedale Cemetery Annexation) to the Town of Pinedale, Wyoming, and establishing zoning therefor. Motion by Councilman Best to approve Ordinance 699, on second read, an Ordinance of the Town of Pinedale, State of Wyoming, repealing Ordinance 688 of the Pinedale Municipal Code relating to the cemetery annexation to the Town of Pinedale, Wyoming. Seconded by Councilwoman Boyce. Motion passed 4-0.

ORDINANCE NO. 699
AN ORDINANCE OF THE TOWN OF PINEDALE, WYOMING REPEALING ORDINANCE 688 OF THE PINEDALE MUNICIPAL CODE RELATING TO THE CEMETERY ANNEXATION TO THE TOWN OF PINEDALE, WYOMING.
WHEREAS, Ordinance 688 provided for the annexation of certain real estate into the Town of Pinedale; and,
WHEREAS, the legal description contained in Ordinance 688 was not the correct legal description for the property intended to be annexed; and,
WHEREAS, a new annexation ordinance is moving through the approval process with the correct legal description and it is deemed necessary to repeal Ordinance 688 so as to avoid duplication of ordinances in the Town’s records with this incorrect ordinance.
NOW, THEREFORE BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING, THAT ORDINANCE 688 OF THE PINEDALE MUNICIPAL CODE, IS HEREBY REPEALED.
This Ordinance shall be in full force and effect from and after passage on three readings and publication according to law.
