NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules and Special Regulations, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) requesting authority to increase its retail electric service rates by approximately $7.1 million per year or 1.1%, to revise the energy cost adjustment mechanism, and to discontinue operations at Cholla Power Plant, Unit 4, as more fully described below:

RMP is a public utility, as defined in Wyo. Stat. §37-1-101(a)(vi)(C), providing retail electric public utility service under Certificates of Public Convenience and Necessity issued by the Commission. RMP is subject to the Commission’s jurisdiction pursuant to Wyo. Stat. § 37-2-112.

On March 4, 2020, RMP submitted an Application requesting the Commission approve the Company’s proposal to implement: [1] an increase in its retail electric utility service rates in Wyoming of $7.1 million per annum or an average overall increase of 1.1 percent, with rates effective on and after January 1, 2021, including approval of proposed rate mitigation proposals; [2] changes to the Energy Cost Adjustment Mechanism to include recovery of  $219.9 million through Schedule 95; and [3] a discontinuation of operations at Unit 4 of the Cholla Power Plant in Arizona, and approve proposed associated regulatory accounting treatment.

RMP is requesting an overall return on equity of approximately 10.2 percent, an overall cost of capital and return on rate base of 7.69 percent and the equity component of the capital structure is 53.52 percent.

The Company states its requested rate increase is primarily driven by: [a] continued capital investments, including the Energy Vision 2020 projects, which RMP states, are required in order for the Company to meet its obligation to serve its customers, and also includes an associated rate of return of 7.69 percent on all its capital investments; and [b] new depreciation rates, using a combination of the rates proposed within the Company’s depreciation study in Commission Docket No. 20000-539-EA-18, and stipulated as part of a settlement in principle reached with parties to the proceeding.

The Company states that due to rate design and individual customer load factors and usage characteristics, the percentage rate change to individual customers within each rate schedule may be higher or lower than the average for the customer class or rate schedule.

NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, the Commission hereby gives notice of the Application of Pinedale Natural Gas, Inc. (Pinedale or the Company) for authority to decrease rates to account for the effects of the Tax Cuts and Jobs Act of 2017 (TCJA).

Pinedale is a public utility as defined by Wyo. Stat. § 37-1-101(a)(vi)(D), subject to the Commission’s jurisdiction pursuant to Wyo. Stat. § 37-2-112.

On February 26, 2020, Pinedale filed an Application for authority to calculate the amounts due to Pinedale customers under the TCJA. Pinedale is proposing to change its imputed federally calculated income tax rate from 28% to 24%, effective January 1, 2018. In addition, the reduction in the federal income tax rate will also result in an excess deferred depreciation tax balance as the Company reflected a 28% federal tax expense in the year the deferred tax was established.

Pinedale states that after an updated revenue requirement and a decision on new rates is determined, assumed to be effective April 1, 2020, the Company will confirm the final amount to be refunded to customers in light of the effective date. At this time, the amount calculated to be refunded to customers under the TCJA should be approximately $38,002.

NOTICE IS HEREBY GIVEN that a regular municipal election will be held in the Wrangler Gym located at 65 North Tyler Ave, Pinedale, Wyoming, on Tuesday the 5th day of May, 2020, for the purpose of electing the following municipal officers of the Town of Pinedale:

One Council Member, to serve a term of two years

Two Council Members, each to serve a term of four years

All candidates must be residents of the Town of Pinedale and a registered voter of the Town of Pinedale and the State of Wyoming as of the closing of the Town Clerk-Treasurer’s office on the day their nomination application / petition is filed with the Town Clerk-Treasurer.

The polls will be open at eight o’clock in the morning and will remain open until seven o’clock in the evening.

Nomination applications will be available from the Town Clerk after Friday, March 21, 2020. Completed nomination applications, together with a filing fee of Twenty-Five Dollars, will be received in the office of the Town Clerk until five o’clock p.m. on Thursday, April 2, 2020, after which time no further nominations will be received.

Pursuant to W.S. 22-25-106, every candidate, whether or not successful, shall file under oath a fully itemized statement of receipts and expenditures at least seven (7) days but not more than fourteen (14) days before the election.  Any contribution received or expenditure made after the statement has been filed, through the day of the election shall be filed as an amendment to the Statement within ten (10) days after the election.  These filings shall be made with the Sublette County Clerk.  The statement shall set forth the full and complete record of contributions including cash, goods or services and actual and promised expenditures including all identifiable expenses as set for in W.S. 22-25-103.  The date of each contribution of $100.00 or more, and expenditure or obligation, the name of the person from whom received or to whom paid and the purpose of each expenditure or obligation shall be listed.  All contributions under $100.00 shall be reported but need not be itemized. Should the accumulation of contributions from a person exceed the $100.00 threshold, all contributions from that person shall be itemized. Receipts, expenditures and obligations itemized in a statement filed by a political party central committee need not be itemized in a candidate’s statement, except by totals, with a reference to said statement.  Failure to file a report as required by W.S. 22-25-106, shall subject a person required to file such report to the civil penalties of W.S. 22-25-108 (f).

Please be advised that W.S. 22-3-102 provides that a person may register to vote not less than fourteen (14) days before an election, at any election specified in W.S. 22-2-101 (a)(i) through (viii) or as provided by W.S. 22-3-117, who satisfies certain qualifications. To vote in the Pinedale Municipal Election on May 5, 2020 a person must be registered to vote or register to vote on or before April 21, 2020 (The last day available to meet the 14 day requirement.), wait to register to vote on the day of the election or otherwise register to vote in compliance with W.S. 22-3-117 (Absentee registration generally.)  A person registering to vote after April 21, 2020 and before the day of the election will not be qualified to vote unless they otherwise qualify under W.S. 22-3-117.

In accordance with the provisions of the Wyoming Environmental Quality Act and Chapter 1, Section 1(f) of the Solid Waste Rules and Regulations, Sublette County has submitted a permit application for a major amendment that includes a revised landfill expansion with an engineered containment system.  The solid waste management facility is called the Marbleton #2 Landfill. 

This facility will provide for the disposal of municipal solid waste and construction and demolition waste which have been generated within Sublette County and the Labarge and Opal regions of Lincoln County.  The 240 acre facility is located approximately 2.5 miles east of Marbleton, Wyoming.  More specifically, this facility is located in Section 22, Township 30 North, Range 111 West, in Sublette County, Wyoming.  The net remaining airspace available for MSW is calculated at 13,138,000 cubic yards and 8,944,000 cubic yards for C&D.  The estimated life of this facility is 474 years for MSW.

The Department of Environmental Quality, Solid and Hazardous Waste Division (DEQ) has reviewed the major permit amendment application and determined that it is generally complete.  The DEQ’s solid waste rules, in Chapter 1, require that the applicant must provide public notice that the application has been determined to be complete and inform the public that there is an opportunity to file comments on the application.  This publication provides notice of that opportunity.  Additional information on the permit application and the DEQ’s completeness review may be obtained at the address below.

Any interested person has the right to file comments on the major permit amendment application and the DEQ’s completeness review. The period for providing comments shall begin on Friday, March 1, 2020 and end on Monday, April 27, 2020. Comments must be received by 5:00 PM on the last day of the notice period.  Comments on this application must be submitted in writing to the Department of Environmental Quality, Luke Esch, Administrator, Solid and Hazardous Waste Division, 200 West 17th Street, Cheyenne, WY 82002.
