NOTICE OF PUBLIC HEARING
The High Meadow Ranch Water District (HMRWD) will conduct a public hearing at 6:00 PM, local time, on January 20, 2022, at the Richard Smythe Wellhouse located at 165 Sauk Trl, Boulder, WY 82923. This meeting is to discuss the Phase III water project. The purpose of this meeting is to allow comments or questions and will cover the complete phase III project. The HMRWD Phase III project includes installing new water distribution lines, PRV’s, service connections, water meters, road rehabilitations and appurtenances. The new water distribution lines will replace old, failing, and deteriorated piping with the system.
At the meeting, The HMRWD along with Jorgensen Associates will present the design of the proposed project and will discuss the estimated cost of the improvements and plan for funding the improvements if there are new attendees or inquiries. A preliminary plan of the improvements, cost estimates and the funding plan can also be reviewed at Jorgensen Associates, 58 S Tyler Ave in Pinedale, WY or by contacting Kolter Booth at 307-367-6548.
Pursuant to Wyoming Stature §41-10-113(a)(xii). The HMRWD intends to use funds borrowed from Wyoming Drinking Water State Revolving Loan Fund (DWSRF) administered by the Wyoming Office of State Lands and Investments. Based on current cost estimates, HMRWD plans to borrow $1,874,000.00 from the Wyoming DWSRF, with said loan being 30-year repayment term at 2.5% interest. Pursuant to Wyoming Statute §41-10-113(a)(xxi), special assessments will be levied on all lots within the High Meadow Ranch Water District to repay the loan. The average rate of assessment per lot owned within the district is estimated to be approximately $79 per year to repay the loan.

OFFICIAL COUNTY COMMISSIONERS’ PROCEEDINGS
December 7, 2021
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse on this date at 9:00 a.m. with Joel Bousman, Tom Noble, Doug Vickrey, Sam White, Dave Stephens, Matt Gaffney, Clayton Melinkovich, Brady Oltman, representing the Pinedale Roundup, and Carrie Long, County Clerk, present.
Chairman Bousman led those present in the Pledge of Allegiance.
The agenda was approved on motion by Commissioner Noble, seconded by Commissioner Vickrey, with the addition of Representative Sommers with an update on redistricting. Motion carried.
Commissioner Vickrey requested a moment of silence in remembrance of Pearl Harbor Day.
The minutes from the previous meeting held on November 16, 2021 were approved and ordered filed on motion by Commissioner White, seconded by Commissioner Vickrey. Motion carried.
Billy Pape, Road & Bridge, updated the Board on activities.
Mike Jackson, Rio Verde Engineering, updated the Board on discussions regarding material source for the skyline drive project.
Jackson also presented a Utility Easement from Sublette County to two owners adjacent to the golf course in order to avoid damage to the parking lot. Commissioner Noble made a motion to approve the Easements, Commissioner Vickrey seconded the motion. Motion carried.
Aaron Seehafer, Rio Verde Engineering, requested direction on whether to use private cultural consultants or work with BLM by utilizing in house consultants on the Calpet erosion project. The Board directed him to work with BLM in their timeframe and with their consultants.
Mary Lankford, Debbie Woyciesjes, Janet Montgomery, and Tim Thompson, met with the Board as representatives of the Centennial Committee. Lankford presented an American Legacy Arms 30/30 commemorative rifle to the Board. The rifle will be displayed in a secure shadow box in the Commissioners’ Chambers. Chairman Bousman thanked the committee members for the donation.
Sam Bixler, representing the Marbleton Food Closet, met with the Board to request the County pay for internet service for the Food Closet. Tony Kelly, with Union Wireless, informed the Board that Union Wireless would supply the Food Closet access to internet at no cost.
Tony Kelly and Brian Woody, Union Wireless, met with the Board with an update on the plan and progress of the installation of fiber in Sublette County. Elaina Zemple, Wyoming Business Council, attended via telephone. Woody assured the Board that Union will not be selling out to AT&T and the business intends to continue as it presently exists. Kelly and Woody informed the Board that Union would be applying for grants in order to complete the project and would be requesting a letter of support from the county in order to move forward.
Matt Gaffney, County Administrator, presented the proposed job description for I.T. Director. Commissioner Noble made a motion to approve the description and to advertise the position locally and nationally for 30 days. Commissioner White seconded the motion. Motion carried.
Commissioner White made a motion to give Chairman Bousman authority to sign a Memorandum of Understanding between the Bureau of Land Management and Sublette County as a cooperating partner regarding the sagebrush focal area withdrawal environmental impact statement. Commissioner Noble seconded the motion. Motion carried.
Justin Latham (Wyoming Department of Agriculture) met with the Board via conference call to discuss the MOU with the state regarding the Sanitarian position. Latham stated he believed the MOU should be approved soon. The Board instructed Gaffney to move forward with the Sanitarian applicant after the MOU is executed.
Mike Crosson, County Attorney, requested approval of a Resolution to approve the appointment of a Special Prosecutor to review and prosecute if deemed warranted a case involving a Sublette County Attorney employee to whom a citation was issued. Commissioner White made a motion to approve the Resolution, Commissioner Stephens seconded the motion. Motion carried.
Clayton Melinkovich, Deputy County Attorney, and Dave Doorn, Hospital District, updated the Board on recent activities.
The Board adjourned for lunch at 11:30 and reconvened at 1:00 p.m. in the Lovatt Room of the Library.
Alan Huston, Planning & Zoning, presented 3 items for consideration by the Board.
The first item: The Partial Vacation and Replat of the Hoback Ranches Subdivision – Conley 2nd Amendment. Commissioner Vickrey made a motion to approve the application from William Conley and Owen Popinchalk requesting a Partial Vacation and Replat of Tract 28 and Tract 15-1 of Sheet 7, of the Hoback Ranches Subdivision allowing a boundary line adjustment to amend the Southerly boundary line of Tract 28, which is owned by the Popinchalks, to extend the property boundary South to the easement line of Rim Road, adding 2.69 acres to Tract 28, creating Tract 32 which would be 12.69 acre in size. The remainder of the W/2 of Tract 15 will then be described as Tract 31 and contain 17.11 acres. Commissioner White seconded the motion. Motion carried.
The second item: Request for a Variance to the Agricultural Zoning Setbacks. Commissioner Noble made a motion to approve an application from Charles Lopeman requesting a 20-foot front setback instead of the required 50-foot setback from the Southerly Property Line to allow for the construction of a detached garage/shop. The property is located at 25 Carter Ave. in Cora. Commissioner Stephens seconded the motion. Motion carried.
The third item: Request for Change in Zoning District Boundary. Commissioner White made a motion to accept the zoning change submitted by Jackson Fork Ranch, LLC proposing a Change of Zoning District Boundary for approximately 56 acres for their ranch (a parcel of land located in the SE/4SW/4 and SW/4SE/4 of Section 33, T37N, R113W., and in Lot 2, SE/4NW/4, and SW/4NE/4 of Sec 2, T.36N, R114W., 6th P.M.) from the current (A-1) Agricultural Zoning District to the proposed (RS-1) Recreational Service Zoning District, for the construction of a small destination resort with approximately 15-20 rooms and guest cabins. Commissioner White included the following 4 conditions as offered in the presentation of the project (sample language provided by counsel for applicant):
• Housing – A building permit for Phase II of the Resort shall be conditioned upon Applicant addressing employee housing to the Sublette County Commissioners approval.
• Removal – In the event the Applicant shall close the Resort for public use and decide not to use it for personal use, Applicant shall demolish the lodge but may continue the use of the cabins under RS-1 zoning, pursue their use as a cluster development or as single-family residences with appropriate density and open space. Any area not needed for such uses shall revert to A-1 zoning.
• Fire Volunteers – Applicant shall maintain a financial incentive program to encourage employees of the Resort to train and become volunteer Fire Fighters with Sublette County Unified Fire.
• Cistern – Applicant shall comply with or exceed all applicable fire regulations including providing a required water supply for fire suppression. Applicant shall make such water supply available to the Sublette County Unified Fire for use off site.
Commissioner White added a 5th condition of no construction between November 15 and April 30 as recommended by Game & Fish in their letter dated November 19, 2021. Commissioner Noble seconded the motion. Motion carried 3 to 2 with Commissioner Vickrey and Commissioner Stephens voting nay.
Commissioner White made a motion to approve the Real Estate Purchase Contract between Sublette County and Children’s Discovery Center for Lot 1 and Lot 2, Discovery Addition to the Town of Pinedale for the purchase price of $42,000.00. Commissioner Stephens seconded the motion, motion carried.
The Memorandum of Understanding between the Wyoming Department of Transportation and Sublette County to provide the Wyoming Statewide Interoperable Communication System (WyoLink) and the Sublette County Interoperable Communication System (SIRS), effective, and timely communications between the two parties in the event of an emergency was approved on motion by Commissioner Noble, seconded by Commissioner White. Motion carried.
Commissioner Noble made a motion to approve the Non-Endowed Scholarship Agreement with the University of Wyoming. Commissioner White seconded the motion. Motion carried.
Payroll, in the amount of $995,751.59 was approved on motion by Commissioner White, seconded by Commissioner Noble. Motion carried.

John Powell was appointed to the open position on the Golf Board on motion by Commissioner Noble, seconded by Commissioner Vickrey. Motion carried.
Commissioners discussed old business including a recent invoice from the Coalition of Local Governments. Chairman Bousman requested that Clayton Melinkovich compose a letter with specific language to finalize the termination of the relationship between Sublette County and the entity upon the county’s contribution toward the invoice balance.
The meeting adjourned at 4:30 p.m.

NOTICE OF FINAL
COMPLETION OF CONTRACT
To all persons, firms, or corporations who have any claim for any work being done, or any material furnished to, Wilson Bros. Inc., PO Box 636, 980 Road 7, Cowley, WY 82420 for the HMR Water System Improvements Project Phase II, Sublette County, Wyoming.
You are hereby notified that the High Meadow Ranch Water District has accepted final completion according to the Contract Documents and rules set forth in the contract between the High Meadow Ranch Water District and the aforesaid Contractor of the work in connection with the HMR Water System Improvements Project Phase II, and that said Contractor is entitled to final settlement thereof.
You are further notified that upon the tenth day of February, 2022, being the 41st day after the first publication of the notice, said High Meadow Ranch Water District will pay Wilson Bros. Inc. the full amount due under said contract; and in the event your claim is not filed with the High Meadow Ranch Water District prior to said tenth day of February, 2022, same shall be waived.
This notice is given pursuant to Section 16-6-116, Wyoming Statutes, 1982.
