OFFICIAL COUNTY COMMISSIONERS’ PROCEEDINGS
NOVEMBER 16, 2021
The Board of County Commissioners met in regular session at the Marbleton Town Hall on this date at 9:00 a.m. with Joel Bousman, Tom Noble, Doug Vickrey, Dave Stephens, Sam White, Matt Gaffney, Clayton Melinkovich, KC Lehr, Brady Oltman, representing the Pinedale Roundup, and Carrie Long, County Clerk, present.
Chairman Bousman led those present in the Pledge of Allegiance.
The agenda was approved on motion by Commissioner Noble, seconded by Commissioner White with the addition of an Executive Session pursuant to W.S. 16-4-405(a)(ix) and the removal of Union Wireless. Motion carried.
The minutes of the previous regular scheduled meeting held on November 2 were approved and ordered filed on motion by Commissioner White, seconded by Commissioner Noble. Motion carried.
Billy Pape, Road & Bridge, updated the Board on activities.
Mike Jackson, Rio Verde Engineering, updated the Board on Skyline Drive & Fremont Lake Road (Phase II). Discussion involved; locations where the various projects would stop and start, overloaded trucks on newly constructed roads, and locating gravel sources closer to the projects.
Eric Sackett, Rio Verde Engineering, requested approval on a change order for the Cottonwood Ryegrass Phase II for a time extension to October 31, 2022. It was moved by Commissioner Noble, seconded by Commissioner Stephens to approve the change order. Motion carried.
Sackett also presented a change order for the Chip Seal project reducing the project cost by $72,235.22. The order was approved on motion by Commissioner Vickrey, seconded by Commissioner White. Motion carried.
Commissioner White made a motion to move to Executive Session pursuant to W.S. 16-4-405(a)(iii). Commissioner Noble seconded the motion. Motion carried.
The Board reconvened in open session with recommendation that Matt Gaffney, County Administrator, finalize the Memorandum of Understanding with the Department of Agriculture and the County regarding the position of Sanitarian.
It was moved by Commissioner White, seconded by Commissioner Stephens to approve a Resolution extending COVID leave for Sublette County Employees. Motion carried.
Gaffney requested a committee be appointed to collaborate on a job description for the Information Technology position. Chairman Bousman appointed Matt Gaffney, Sheriff KC Lehr, Fire Warden Shad Cooper, County Clerk Carrie Long, Commissioner Noble and Commissioner White.
Todd Hurd, Forsgren Associates, updated the Board on projects:
• Daniel Fire Hall - everything is completed at the Daniel Fire Hall except the sprinkler pumps which are on back order with no known date for arrival.
• Big Piney Library – Sewer line repairs are complete. Inventory is also on back order. RFI’s and Submittals are moving as needed.
• Fair Grounds Roof – waiting for quotes to remove cupolas.
Clayton Melinkovich, Deputy County Attorney, and Tonia Hoffman, Hospital District – updated the Board on Hospital District discussions. Details of the relocation of Public Health to the Allen Agency building were discussed. It was moved by Commissioner Noble, seconded by Commissioner Vickrey the county would be responsible for current utilities to include but not limited to: electric, gas, water, sewer, internet, phone, and snow removal. The Hospital District would be responsible for insurance. Motion carried.
Commissioner White made a motion to move to Executive Session pursuant to W.S. 16-4-405(a)(ix), Commissioner Noble seconded the motion.
The Board reconvened open session.

The Town Council of the Town of Pinedale met in regular session on Monday, November 22, 2021, in the Lovatt Room of the Sublette County Library.
The meeting was called to order by Mayor Matt Murdock at 5 p.m. Council members present: Tyler Swafford, Judi Boyce, Isaac Best and Dean Loftus. Those in attendance included: Sheriff KC Lehr, representing Sublette County Sheriff’s Department; Robert Galbreath, representing the Pinedale Roundup; Joanie Christie, representing Sublette County Chamber of Commerce; Kevin Warren, representing Rendezvous Pointe; Carla Sullivan, representing MESA Therapeutic Horsemanship; Kalie Miles, representing Children’s Discovery Center; Amber Anderson, representing Pinedale Aquatic Center; Monte Bolgiano and Leah Radakovich, representing Main Street Pinedale; Becky Gregory, representing Children’s Learning Center; Tim Ruland, representing Pinedale File Arts Council and Public Art; Robin Clover, representing SAFV Task Force; Teresa Sandner, representing Pinedale Preschool; Sarah Murdock, representing Bridges Out of Poverty; Brian Woody, Matthew Myers and Tressa Barnes, representing Union Telephone; Max Lockett; Town Attorney, Ed Wood; and Director of Public Works, Abram Pearce. Brian Gray, representing Jorgensen Associates; and Town Clerk, Maureen Rudnick, attended via teleconference.
Mayor Murdock led those present in the Pledge of Allegiance.
Motion by Councilman Swafford to accept the agenda as presented. Seconded by Councilman Loftus. Motion passed 5-0.
Motion by Councilwoman Boyce to approve the minutes of the November 8, 2021, regular Town Council meeting as presented. Seconded by Councilman Best. Motion passed 5-0.
During Citizen/Council Concerns, Mayor Murdock and the Town Council thanked Ronnie Tambourine for his service and hard work as Planning and Zoning Administrator.
Sheriff KC Lehr reported on calls for service for October 2021.
A representative of each of the following organizations gave a short report on what they do and how they serve Pinedale residents with contract for services funds from the Town of Pinedale: Chamber of Commerce, $1,250; Rendezvous Pointe, $10,000; MESA Therapeutic Horsemanship, $5,000; Children’s Discovery Center, $8,000; Pinedale Aquatic Center, $10,000; Main Street Pinedale, $6,250; Children’s Learning Center, $4,500; Pinedale Fine Arts Council, $5,000; SAFV $4,312.50; Pinedale Preschool, $2,000; and Bridges Out of Poverty, $2,550.
Motion by Councilwoman Boyce to approve supporting the Pinedale Fine Arts Council Public Art sculpture placement on the corner of South Maybell Avenue and West Pine Street. Seconded by Councilman Swafford. Motion passed 5-0.
Union Telephone presented current statistics for distribution and areas funded for broadband in the community, and cited lack of employees, time and funding as causes in a slow-down of completing installation of services.
Motion by Councilwoman Boyce to approve the water connection request for William Bowen at 72 Fremont Lake Road. Seconded by Councilman Best. Motion passed 5-0.
Council reviewed monthly department reports from Municipal Court, Animal Control & Municipal Code, Projects, Public Works, Water & Wastewater, Planning & Zoning, the Airport and Travel & Tourism.
Motion by Councilman Swafford to approve Ordinance 693, on third read, an Ordinance of the Town of Pinedale, State of Wyoming, amending Chapter 92, Travel and Tourism Commission, of the Pinedale Municipal Code, in its entirety. Seconded by Councilwoman Boyce. Motion passed 5-0.
Motion by Councilman Swafford to approve Ordinance 694, on second read, an Ordinance of the Town of Pinedale, State of Wyoming, amending Chapter 395, Article II, Obstructions, of the Pinedale Municipal Code, in its entirety. Seconded by Councilman Best. Motion passed 5-0.

ORDINANCE - 694
AN ORDINANCE OF THE TOWN OF PINEDALE, STATE OF WYOMING, AMENDING CHAPTER 395, ARTICLE II, OBSTRUCTIONS, OF THE PINEDALE MUNICIPAL CODE IN ITS ENTIRETY.
§ 395-4. Obstructions.
Any person who in any manner encumbers, erects or maintains any fence, places merchandize, seating or tables or otherwise obstructs any highway, street, alley, public easement or sidewalk, without first obtaining permission of the Town Council or as otherwise allowed in § 395-5, is guilty of unlawful obstruction of highways, streets, alleys, public easements, or sidewalks, a misdemeanor. The violation of this section includes, but is not limited to, motor vehicles stopping or parking side by side, so as to hinder the normal and free flow of pedestrian or vehicular traffic. Each day's continuance shall be considered a separate offense.
§ 395-5. Pine Street.
Items may be placed on the sidewalks that abut Pine Street as allowed by the Wyoming Department of Transportation’s Regulations provided that any such obstruction shall at all times leave at least five (4) feet of unobstructed, continuous passage on the remaining sidewalk.
§ 395-6. Fencing of excavations.
Anyone making any excavations in any highway, street, alley or thoroughfare within the corporate limits, control or jurisdiction of the Town shall erect and maintain for the duration of the excavation a clearly visible fence or suitable barrier around the perimeter of such excavation.

RECYCLED ASPHALT PAVEMENT OR ASPHALT MILLINGS
1. The Town is selling approximately 1,407 cubic yards of excess millings to Sublette County at $5 per cubic yard. The Town is supplying no labor or equipment for the removal of the millings from the site. All transportation and/or costs associated with the transportation of the millings will be completed by the purchaser.
