The Town Council of the Town of Pinedale met in regular session on Monday, November 28, 2022, in the Lovatt Room of the Sublette County Library.

The meeting was called to order by Mayor Pro Tem Tyler Swafford at 5 p.m. Council members present:  Dean Loftus, Judi Boyce, and Scott Kosiba.  Mayor Matt Murdock was absent. Those in attendance included: Albert Sommers, Wyoming State Representative; KC Lehr, representing Sublette County Sheriff’s Office; Robert Galbreath, representing the Pinedale Roundup; Brian Gray, representing Jorgensen Associates; Renne Reed, representing the Upper Green River Valley Cemetery District; Angela Douglas; Max Lockett; Jessup Wyman; Ed Wood, Town Attorney; and Abram Pearce, Town Director of Public Works.

Mayor Pro Tem Swafford led those present in the Pledge of Allegiance.

Motion by Councilwoman Boyce to amend the agenda to add D-2 Albert Sommers. Seconded by Councilman Loftus. Motion passed 4-0.

Motion by Councilwoman Boyce to approve the minutes of the November 14, 2022, regular Town Council meeting as presented. Seconded by Councilman Swafford. Motion passed 4-0.

Councilman Loftus thanked Pinedale Half Marathon organizers for starting Foundation 23.

Sheriff KC Lehr reported on calls for service for October 2022.

Wyoming State Representative Albert Sommers reported on items of interest that will be coming up in the next legislative session starting January 10, 2023.

Motion by Councilman Loftus to approve the consent agenda items.  Seconded by Councilman Kosiba.  Motion passed 4-0.  Consent agenda items approved were the purchase of 10 water meter pits & parts from Dana Kepner, in the amount of $14,838.30; the purchase of 50 meter pit lids from Nicor, in the amount of $3,400; and the extension of the Ralph Wenz Field FBO agreement until January 30, 2023.

Motion by Councilwoman Boyce to approve the Mayor’s appointment of Angela Douglas to the Pinedale Travel & Tourism Commission.  Seconded by Councilman Kosiba.  Motion passed 4-0.

Motion by Councilman Kosiba to approve the Mayor to sign the plat for the seventh enlargement of the Pinedale Cemetery.  Seconded by Councilwoman Boyce.  Motion passed 4-0.

Council reviewed monthly department reports from Animal Control & Municipal Code, Projects, Public Works, Water & Wastewater, Planning & Zoning, the Airport and Travel & Tourism.

Motion by Councilman Kosiba to adjourn the meeting. Seconded by Councilman Loftus. Motion passed 4-0. The meeting adjourned at 5:37 p.m.

The Board of County Commissioners met in regular session at the Marbleton Town Hall on this date at 9:00 a.m. with Joel Bousman, Tom Noble, Doug Vickrey, Dave Stephens, Sam White, Clayton Melinkovich, Cali O’Hare representing The Pinedale Roundup, and Carrie Long, County Clerk, present. 

Chairman Bousman led those present in the Pledge of Allegiance.

The agenda was approved with the addition of Executive Session (W.S. 16-4-405(a)(iii)) and removing the discussion with Happy Endings regarding feral cats on motion by Commissioner Noble, seconded by Commissioner Stephens. 

The minutes from the previous meeting on 11/1/2022 were approved and ordered filed on motion by Commissioner White, seconded by Commissioner Vickrey.  Motion carried. 

Billy Pape, Road and Bridge, updated the board on activities. 

Rick Johnson, Green River Ranches, discussed bridge options with the board.  He was directed to work with Rio Verde Engineering to identify any road allowing public access to BLM that would benefit from the bridge installation. 

Andre Irey, Maintenance, updated the board on building projects.  He had no updates on maintenance activities but did request raises for some of his employees.  He was directed to put the request on the next agenda with documentation justifying the increase. 

Mike Henn, Soil Conservation, and Rich Stem (via Zoom) discussed the need for a contract forester.  Henn stated he would take the request to his board as well if the board was favorable to the request and to a commitment of an approximate $225,000 budget increase.  Each commissioner stated he was supportive of the proposal. 

Shad Cooper, Fire Warden, updated the board on monthly activities.  He also requested approval from the board to sell one fire apparatus using the online services he has used in the past and sell one command vehicle at the next county auction.  Commissioner White made a motion to approve the sales, Commissioner Noble seconded the motion.  Motion carried. 

Kailey Barlow, Fair Board, updated the board on the fair in July and changes coming for the next fair. 

Dagan Montgomery, UW Extension, updated the board on the vacant position left by Jenn Matosky.  He also invited board members to meet with him individually to discuss their views on his role as Extension Educator and the needs of the county.

Chris Lacinak, Planning and Zoning, requested county email address be issued to the members of the Planning and Zoning board.  After discussion, Chairman Bousman stated he would like to have the Information Technology Director present at the next meeting to discuss implementation of the request.

Clayton Melinkovich, Deputy County Attorney, presented the contract with Teton Youth and Family Services to the board for approval.  Commissioner Noble made a motion to approve the contract, Commissioner Stephens seconded the motion.  Motion carried.   

Melinkovich also requested direction from the board regarding posting the open position in his office that will be created when he takes office.  He was directed by the board to proceed according to the current budget. 

A motion was made by Commissioner White to adjourn to executive session in accordance with W.S. 16-4-405(a)(iii).  The motion was seconded by Commissioner Noble.  Motion carried.

The board reconvened open session with no action taken during executive session. 

Laila Illoway, KC Lehr, Carrie Long and Emily Paravicini (via Zoom) discussed the Human Resource Director job description with the Board.  Commissioner White made a motion to approve the position with a salary range of $75,000 to $95,000.  Commissioner Noble seconded the motion with the stipulation the job only be offered to a qualified applicant.  Commissioner Stephens requested the current job description have flexibility for additions or deductions. Motion carried. 

Chairman Bousman requested Clerk Long put the Administrator position on the next agenda.  He also instructed individual board members to submit a list of possible duties of an administrator to the clerk before the next meeting to create a job description.

Laila Illoway, Assessor, presented a tax roll correction in the amount of -$379.80 for Wyoming Helicopters, Inc. 

During old business, Commissioner White requested the board approve up to $5000 for consulting services for the county’s cooperating agency status of the Sage Grouse Initiative discussions.  Commissioner Noble made a motion to approve the request, seconded by Commissioner Stephens.  Motion carried.

Department of Environmental Quality, Division of Air Quality PUBLIC NOTICE:  In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Jonah Energy LLC (CMP100053) to modify and operate the Yellow Point 1-13 Central Facility (F002475) with the addition of production and equipment associated with nine wells, the Yellow Point 4-24, TOT Unit 9, Elm Federal 1-2-23, 3-2-23, 3-3-23, 23-12, 23-13, 23-14 and 23-22, with two reboiler overheads condensers, two TEG flash tank separators and one common smokeless combustion device to control volatile organic compound and hazardous air pollutant emissions associated with the dehydration units, condensate tanks, active produced water tanks and pneumatic pumps, located in the NE1/4NE1/4 of Section 13, T28N, R109W, approximately twenty-one (21) miles southwest of Big Sandy, in Sublette County, Wyoming.  Jonah Energy LLC has met the demonstration requirements under Chapter 6, Section 2(c)(ii) for this permitting action since current emissions are less than emissions during the baseline period.  VOC emissions have decreased 2.9 TPY from the baseline period and NOx emissions have decreased 2.2 TPY from the baseline period.  These reductions have been added to Jonah Energy LLC’s offset bank to use for future permitting actions.
