ADVERTISEMENT FOR BIDS
Sealed Bids for the construction of the Ralph Wenz Field – Expand E GA Apron Project, will be received, by the Town of Pinedale, at the office of the Airport Manager, at 9357 Highway 191, Pinedale, Wyoming, until 2:00 PM local time on October 22, 2020 at which time the Bids received will be publicly opened and read.
The project will include the design, bidding, and construction of the Expand E GA Apron Project which includes earthwork, grading, P-209 base course, P-401 asphalt, striping, concrete work, removal of the existing fuel farm and installation of a new fuel farm. Bid Package A will consist of the main apron expansion work and Bid Package B will consist of the new fuel farm work. Bids will be evaluated for each Bid Package and awarded to the lowest responsive bidder for each package individually.
No bids will be received after the specified hour and date and may not be withdrawn after the time fixed for opening them. The owner reserves the right to waive irregularities in the bids and reject any and all bids. No bids will be considered in which the Proposal, Specifications or any provisions have been modified.
Bids will be received for up to two prime Contracts (may be one prime contract if one Contractor is low bid for both bid packages). Bids shall be on a unit price basis, as indicated in the Bid Form. The bidder must supply all information required by the bid or proposal forms and specifications.
Each bid must be accompanied either by a certified check, payable to the Town of Pinedale in the amount of five percent (5%) of the bid, or by a Bid Bond in a like amount and executed by an approved surety company. The check or bond will be retained by the Owner as liquidated damages if the successful bidder refuses or fails to enter into contract and performance bond in accord with his bid within fifteen (15) days after date of notification of award.
Minimum wage rates as established by the Secretary of Labor are applicable to the work performed on this project.
The Issuing Office for the Bidding Documents, consisting of Project Manual and Plan Set, is: T-O Engineers, 502 33rd Street, Cody, WY 82414. Prospective Bidders may examine the Bidding Documents at the Issuing Office on Mondays through Thursdays between the hours of 8:00 and 5:00 and Fridays between the hours of 8:00 and 12:00 and may obtain copies of the Bidding Documents from the Issuing Office as described below.
Interested bidders must obtain the Bidding Documents from the T-O Engineers Online Planroom at www.to-engineersplanroom.com. Bidding Documents may be ordered in hard copy format for purchase at cost (nonrefundable). Electronic Bidding Documents in PDF format may be downloaded for no cost. To be placed on the planholders list, bidders must register at www.to-engineersplanroom.com.
Bids may not be withdrawn after the time fixed for submitting them. The Owner reserves the right to waive irregularities in the bids and reject any and all bids.
The Town of Pinedale, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. §§ 2000d to 2000d-4) and the Regulations, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.
The Bidder is hereby notified that this project is subject to FAA Federal Contract Provisions, including, but not limited to: Buy American Preference, Foreign Trade Restriction, Davis Bacon, Affirmative Action, Government-wide Debarment and Suspension, and Government-wide Requirements for Drug-Free Workplace.

PUBLIC NOTICE
The Wyoming Public Service Commission (Commission) has given Pinedale Natural Gas, Inc. (PNG or the Company), authority to pass on to its customers through its Commodity Balancing Account (CBA) an increase in its wholesale natural gas commodity costs of $0.51 per decatherm, effective on and after September 29, 2020.
The proposed wholesale gas pass-on increase is attributable to: [i] a projected wholesale gas cost of $0.335 per therm resulting in an increase of $0.102 per therm; and [ii] a CBA surcharge of $0.001 per therm is a decrease from a surcharge of $0.052. The Company proposes to amortize the projected August 31, 2020, under-collected CBA balance of $2,130, using projected annual 2020 sales of 234,000 Dth.
A typical residential gas customer using 101 therms per month for the rate-effective period of September 29, 2020, through March 29, 2021, may expect a monthly gas bill increase of $5.13 or 6.27%, before taxes. Actual bills will vary with usage.
PNG’s Application is on file at the Commission’s offices in Cheyenne, Wyoming, and in the Company’s Pinedale, Wyoming, business office; and any interested person may inspect the Application during regular business hours.

SEPTEMBER 15, 2020
The Board of County Commissioners met in regular session in the Lovatt Room of the Sublette County Library in Pinedale, Wyoming on this date at 9:00 a.m. with David Burnett, Joel Bousman, Mack Rawhouser, Tom Noble, Doug Vickrey, Matt Gaffney, Mike Crosson, Skylar Wilson, Sam White, Dave Stephens, Holly Dabb representing the Pinedale Roundup, and Carrie Long, County Clerk present.
Chairman Burnett led those present in the Pledge of Allegiance.
It was moved by Commissioner Bousman, seconded by Commissioner Noble to approve the agenda with the addition of discussion of a letter to Mark Bingman. Motion carried.
The minutes of the preceding meeting on September 1 were approved and ordered filed by motion from Commissioner Vickrey, seconded by Commissioner Noble. Motion carried.
Billy Pape, Road & Bridge Superintendent, met with the Board to update on activities. He presented two bids for vehicles, a 2500 Ford 4X4 and a 3500 Ford 4X4 Cab & Chassis with the low bid coming from Frontier Ford in the amount of $82,665.00. It was moved by Commissioner Bousman, seconded by Commissioner Noble to accept the bid from Frontier Ford. Motion carried.
Pape stated he had a request to order a generator for the new construction of the Daniel Fire Hall in the amount $55,000.00. He stated the generator was not included in the original bid for the new fire hall and was understood it would be purchased by the County. Commissioner Noble stated it was discussed by the working group to not include the generator in the bid because if it was ordered by the contractor there would be a 20% markup and the County could order one and avoid the markup by the contractor. He stated it was not formally discussed with the Board. It was moved by Commissioner Noble, seconded by Commissioner Rawhouser to pay for the generator. Motion carried 4 to 1 with Commissioner Vickrey voting nay.
Matt Gaffney, County Administrator, met with the Board to review several items:
1. Dessa Dale with DJ&A discussed timeline and priorities regarding the Federal and State Land Use Plan update.
2. It was moved by Commissioner Bousman, seconded by Commissioner Rawhouser to retain Jessica M. Western, Ph.D. with Big Good Creek Resolutions to act as the Forest Collaborator with County expenditure up to $5000. Motion carried.
3. It was moved by Commissioner Bousman, seconded by Commissioner Rawhouser to approve the letter to Mark Bingham, Acting District Ranger, requesting a temporary exemption for chainsaw use in the Bridger Wilderness. Motion carried.
4. It was moved by Commissioner Noble, seconded by Commissioner Vickrey to approve the ACA Agreement for Blue Cross Blue Shield. Motion carried.
5. It was moved by Commissioner Bousman, seconded by Commissioner Noble to approve the payment and reimbursement request from CARES ACT money to include $20,318 reimbursement for overtime to be paid to Shad Cooper for leading the Incident Command Team during the Coronavirus Crisis from March through June 1, 2020. Motion carried.
6. It was moved by Commissioner Rawhouser, seconded by Commissioner Noble to approve expenditure of budgeted money for Covid-19 to pay for Covid testing for students under 18 years of age. Motion carried.
7. It was moved by Commissioner Bousman, seconded by Commissioner Noble to approve request to the State Lands Investment Board of $1,694,821.51 comprised of various requests from entities in Sublette County for CARES Act funding and to have prior approval for funding from the State Lands Investment Board before spending any money. Motion carried.
Jen Matosky, UW Extension 4-H Educator, updated the Board on 4-H summer activities.

PUBLIC NOTICE
Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) for an order authorizing the Company to record and defer for future recovery depreciable plant and reserve amortizations for depreciation rates, as more fully described below:
RMP is a public utility, as defined in Wyo. Stat. §37-1-101(a)(vi)(C), subject to the Commission’s jurisdiction pursuant to Wyo. Stat. § 37-2-112.
On October 9, 2020, pursuant to Wyo. Stat. § 37-2-112 and 37-2-115, the Company submitted an Application and exhibits requesting the Commission issue an order authorizing the Company to record and defer for future recovery depreciable plant and reserve amortizations for the depreciation rates approved to go into effect on January 1, 2021.
RMP seeks authorization from the Commission to defer, for future amortization, the level of annual depreciation expense related to the stipulation in the 2018 Depreciation Study (Docket Number 20000-539-EA-18) for rates to be in effect on January 1, 2021. The stipulation was submitted by the Company, the Wyoming Office of Consumer Advocate, and Wyoming Industrial Electric Consumers.
The rates from the 2018 Depreciation Study were included in RMP’s 2020 general rate case (Docket Number 20000-578-ER-20) (2020 GRC) whose proposed rate effective date was January 1, 2021, which aligned with the 2018 Depreciation Study stipulation. The 2020 GRC has been delayed and the rate effective date will no longer occur beginning on January 1, 2021, as the Company requested.
The amount to be deferred annually is approximately $23.6 million. The monthly deferral will be $1,967,393. Deferred accounting will assist the Company in the ability to track and recover the depreciation expense as set forth the 2018 Depreciation Study. The Company states that deferred accounting is appropriate in this case because a delay in its 2020 GRC was caused by unforeseeable circumstances and materially impacts the Company.

Jonah Energy LLC has met the demonstration requirements under Chapter 6, Section 2(c)(ii) for this permitting action since current emissions are less than emissions during the baseline period. VOC emissions have decreased 16.1 TPY from the baseline period and NOx emissions have decreased 4.9 TPY from the baseline period. These reductions have been added to Jonah Energy LLC’s offset bank to use for future permitting actions.

The Town Council of the Town of Pinedale met in regular session on Monday, September 28, 2020 in the Lovatt Room of the Sublette County Library.
The meeting was called to order by Mayor Matt Murdock at 5 p.m. Council members present: Tyler Swafford, Judi Boyce, Isaac Best and Dean Loftus. Those in attendance included: Barb and Andy Pfaff; Max Lockett; Larry Proud; Zach Thompson and Jared Grant, representing the Sublette County Trails Association; Andrew and Jennifer Zook; Laurel Barrett; Trudy Fry; Mary Lynn Worl; Bill Jones, representing Jorgensen Associates; Holly Dabb, representing the Pinedale Roundup; Evan Biagi, representing Visionary Broadband; Town Employees, Abram Pearce, Spencer Hartman, and Samantha Harnack; and Town Attorney, Ed Wood.
Mayor Murdock led those present in the Pledge of Allegiance.
Motion by Councilman Swafford to approve the agenda as presented. Seconded by Councilman Loftus. Motion passed 5-0.
Motion by Councilwoman Boyce to approve the minutes of the September 14, 2020 regular Town Council meeting as presented. Seconded by Councilman Best. Motion passed 5-0.
Councilwoman Boyce suggested Zoom meetings be resumed.
Council reviewed the Sublette County Sheriff’s report. Mayor Murdock stated that the First Responders Appreciation Day picnic is scheduled for October 7, 2020 at Boyd Skinner Park and thanked all of our local first responders for their service to our community.
After reading the proclamation, Councilwoman Boyce made a motion to authorize the Mayor to sign the proclamation declaring the month of October as Domestic Violence Awareness month in the Town of Pinedale. Seconded by Councilman Swafford. Motion passed 5-0.
After discussion both for and against allowing the Sublette County Trails Association (SCTA) to develop a portion of Burzlander Park into a bicycle skills course, Mayor Murdock stated the need to answer two separate questions: can the organizations obtain adequate insurance to protect the Town; and is Burzlander Park the best location for the Skills Course? Jared Brandt and Zach Thompson, representing SCTA, agreed to discuss proposed alternate locations as well as meet with Barb Pfaff and Mary Lynn Worl, who oppose the proposed Burzlander Park location to assess its pros and cons.
Abram Pearce, Town Director of Public Works (DPW), reported that the Pine Street Beautification project that was partially funded by Consensus money has been completed. Mayor Murdock thanked the Lions Club, who helped install the final portions of sod.
Motion by Councilman Swafford to approve the Pinedale Travel and Tourism Commission marketing plan for the remainder of fiscal year 2021. Seconded by Councilman Loftus. Motion passed 5-0.
Motion by Councilman Swafford to award the Crack Seal Project to R&D Sweeping in the amount of $25,000 to furnish and apply 7,400 pounds of sealant, subject to the town attorney approving the contract. Seconded by Councilwoman Boyce. Motion passed 5-0.
Motion by Councilwoman Boyce to approve the purchase of UV bulbs for the water treatment plant in the amount of $3,434.40 from Xylem Water Solutions. Seconded by Councilman Best. Motion passed 5-0.
Motion by Councilman Swafford to approve the purchase of a replacement fire hydrant from Dana Kepner in the amount of $3,225.65. Seconded by Councilman Loftus. Motion passed 5-0.
Motion by Councilman Best to approve the purchase of teleconferencing and remote workplace equipment and software from amazon.com not to exceed $16,000 and apply to the State Loan Investment Board for reimbursement with federal COVID-19 Funds. Seconded by Councilman Swafford. Motion passed 5-0.
Motion by Councilman Swafford to approve the application for and use of an Amazon Prime credit card. Seconded by Councilwoman Boyce. Motion passed 5-0.
DPW Pearce reported that he and Town Engineer Matt Bowers are planning a SCADA remote access and security upgrade and preparing an application to the State Loan Investment Board for COVID-19 funds to reimburse the Town for all or part of the project expense.
Motion by Councilman Loftus to cancel the December 28, 2020 regular Town Council meeting. Seconded by Councilman Swafford. Motion passed 5-0.
Motion by Councilman Best to approve the temporary use permit application from Friends of the PAC for an event on October 31, 2020. Seconded by Councilwoman Boyce. Motion passed 5-0.
Motion by Councilman Loftus to approve the commercial/non-residential building permit application by Union Wireless to install a Cell on Wheels located at Pinedale Estates Addition Block 3, Lot 2., expiring on September 28, 2021 at 5:00 p.m. Seconded by Councilman Swafford. Motion passed 5-0.
Mayor Murdock briefed the council on the current staffing plan for Ralph Wenz Field. Grover Laseke has been hired as a permanent part-time Airport Manager subject to all policies stated in the Town of Pinedale Employee Guide, Jack Cain has been hired to be the part-time, on-call snow plow driver subject to all policies stated in the Town of Pinedale Employee Guide, Ken Murphy has been hired as a permanent, part-time snow plow driver and maintenance person subject to all policies stated in the Town of Pinedale Employee Guide. A professional services agreement is being negotiated with Choice Aviation to train airport staff to handle snow efficiently, develop minimum standards for the airport, and consult on projects.
Motion by Councilman Swafford to un-table the request to re-assign the lease of Lot 23 at the Pinedale Airport from Wyoming Helicopters to Nicholas Ingle. Seconded by Councilman Loftus. Motion passed 5-0.

Mayor Murdock cautioned Evan Biagi representing Visionary Communications that a building permit must be obtained for the equipment recently installed on the top of Heritage Quilts.
