TAKE NOTICE that JOHN G. SHEEHAN JR. has filed a Complaint in the District Court, Ninth Judicial District, Sublette County, Wyoming sitting in the Town of Pinedale, to quiet title to:

Lot Ninety-Two (92), Block Two (2) of the Barger Subdivision, Sublette County, Wyoming as set out on that plat map recorded in the Office of the County Clerk of Sublette County;

as fee simple owner of said real property naming you as Defendant, alleging that you claim estates, rights, titles, liens and interests therein which are adverse to those of the Plaintiff, and that Plaintiff is seeking to have his title to said real property forever quieted and a judicial determination that you have no estates, rights, titles, liens or interests therein.

FURTHER, you are notified that you are required to answer Plaintiff’s Complaint on or before 7/10/23 by filing the same with the Clerk of this Court; otherwise, said Complaint shall be taken as true and judgment shall be rendered against you accordingly.

The Board of County Commissioners met in regular session in the Commissioners’ Meeting Room of the Sublette County Courthouse on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Dave Stephens, Mack Bradley, Clayton Melinkovich, Jeness Saxton, Cali O’Hare (via Microsoft Teams) representing the Pinedale Roundup and Carrie Long, County Clerk, present. 

Chairman White led those present in the Pledge of Allegiance.

The agenda was amended to remove Sheriff Lehr’s portion and approved on motion by Commissioner Noble, seconded by Commissioner Vickrey.

The minutes of the previous meeting on 4/18/2023 were approved and ordered filed on motion by Commissioner Vickrey, seconded by Commissioner Stephens. 

Billy Pape, Road & Bridge updated the board on activities. 

Pape requested direction from the board regarding surplus equipment and vehicles from various departments that need to be disposed of.  Commissioner Stephens said he would volunteer his time for an auction.  The board directed that Pape coordinate with Stephens on a suitable date and time.   

Eric Sackett, Rio Verde Engineering, informed the board that the original design of the North Piney project included the airport road (about ½ mile) and asked if the board wanted to have that road included in the project for approximately $300,000 additional funds.  The board was favorable to include the airport road. 

Sackett also advised the board the original proposal for the North Piney project had included traffic control and had driven the cost up.  He asked the board if the road could be closed, and traffic diverted to Mickelson Road while culverts were being installed.  The board was favorable to closing the road for part of the day. 

Andre Irey, Maintenance, updated the board on activities.  He stated the remodel at the Marbleton Senior center has started. 

Irey also advised the board that the water well at the golf course had leaked underground and has been fixed. 

Shad Cooper, Fire Warden, informed the board that Crook County has offered $10,000 for the fire truck that is for sale.  The list price is $12,500.  Commissioner Noble made a motion to accept the offer, Commissioner Bradley seconded the motion.  Motion carried. 

Maike Tan met with the board via Microsoft Teams regarding her position on the Planning & Zoning Board.  She explained she would need to resign from the board but would like to stay on until the end of September.  The BCC was favorable to her request and thanked her for her service. 

Dennis Fornstrom, Planning & Zoning, presented an application from Mary Kay Jensen requesting renewal of a Conditional Use Permit.  It was moved by Commissioner Noble, seconded by Commissioner Stephens to approve the permit allowing for the temporary storage of heavy equipment on property located within Township 31 N. Range 108 W., Sections 7 and 12.  Motion carried with Chairman White abstaining from voting. 

Jeness Saxton, County Administrator, reviewed several items with the board. 

Dave Doorn, Hospital District, updated the board on recent events.  He explained to the board he needed to know how the 25.4 million dollars committed by the county commissioners would be dispersed and requested the money be given to the Hospital District to manage.  He was instructed to make a request to be on the next meeting agenda if action from the board was going to be necessary.

Andrea Jean, Human Resources Director, updated the board on department activities.  She stated she had received feedback from the Employer Group and would update the board with recommendations in a future meeting. 

Jean and Tiffany Monk discussed options for county employee participation in the Medical Air Services Association.  Chairman White requested they put information together for presentation during budget discussions.

Commissioner Bradley made a motion to approve bonds for Craig J. Smith (Treasurer, Recreation Board) and Shannon McCormick (Clerk/Treasurer, Town of Marbleton).  Commissioner Noble seconded the motion.  Motion carried. 

Accounts Payable were approved on motion by Commissioner Noble, seconded by Commissioner Vickrey.  Motion carried.

Department of Environmental Quality, Division of Air Quality PUBLIC NOTICE:  In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Hilcorp Energy Company (CMP001240) to modify and operate the Birch Creek Unit E Battery (F017296) with the addition of truck loading operations for condensate removal, with one smokeless combustion device to control volatile organic compound and hazardous air pollutant emissions associated with the condensate tanks, located in the NW1/4SE1/4 of Section 22, T27N, R113W, approximately two (2) miles north of Calpet, in Sublette County, Wyoming.  A Chapter 6, Section 2(c)(ii) demonstration in accordance with the Division’s Interim Policy has been conducted.  Emission offset requirements, if applicable, have been applied to this permitting action at a ratio of 1.5:1.0 for VOCs and 1.1:1.0 for NOX.  Permitting actions to date have resulted in a decrease in actual VOC emissions of 185.0 tpy and actual NOX emissions of 37.2 tpy. Therefore, Hilcorp Energy Company has met the offset requirements for VOCs and NOx.

The Town Council of the Town of Pinedale met in regular session on Monday, May 8, 2023, in the Lovatt Room of the Sublette County Library.

The meeting was called to order by Mayor Pro Tem, Tyler Swafford, at 5 p.m. Council members present:  Dean Loftus and Scott Kosiba.  Mayor Murdock; absent.  Those in attendance included: Robert Galbreath, representing the Pinedale Roundup; John and Angela Douglas, representing Emblem Aviation, LLC., Max Lockett; Jessup Wyman; Ed Wood, Town Attorney; and Director of Public Works, Abram Pearce. Councilwoman Boyce,  Brian Gray, representing Jorgensen Associates; Suzanne Lagerman, representing Nelson Engineering; and Tesa Manning attended online.

Mayor Pro Tem Swafford led those present in the Pledge of Allegiance.

Motion by Councilman Kosiba to allow Councilwoman Boyce to participate in the meeting remotely.  Seconded by Councilman Loftus.  Motion passed 3-0.

Maybell Ave from Pine Street to Magnolia Street on July 8 and allow them to conduct a street dance until 1 a.m.; Main Street Pinedale Temporary Use and WYDOT Special Event applications for Rendezvous Vendor Fair set-up and take-down parking lane closure, and the Rendezvous Parade closure of Pine Street from mile post 99 to mile post 100, on July 8, 2023.

Motion by Councilman Kosiba to approve the Memorandum of Understanding between the Town of Pinedale and Sublette County for the Pinedale Inflow and Infiltration Reduction and Storm Water Conveyance project.  Seconded by Councilman Loftus.  Motion passed 4-0.

Mr. Pearce notified Council of the invalidation of the Macro Cell Tower Request for Qualifications based on state bidding statutes.

Motion by Councilman Loftus to approve a one-year aviation fuel supply agreement with AvFuel Corporation, effective May 22, 2023.  Seconded by Councilman Kosiba.  Motion passed 4-0.

Motion by Councilman Kosiba to approve the purchase of ODAL light repair parts from Airside Solutions, Inc., in an amount not to exceed $6,000.  Seconded by Councilman Kosiba.  Motion passed 4-0.

Motion by Councilman Kosiba to approve Resolution 2023-04, a resolution adopting the 2023-2028 Wyoming Region 5 Hazard Mitigation Plan.  Seconded by Councilman Loftus.  Motion passed 4-0.

Motion by Councilman Loftus to approve Resolution 2023-05, a Resolution authorizing the submission of an application to the State Loan and Investment Board for a loan through the State Revolving Fund on behalf of the Governing Body for the Town of Pinedale for the purpose of funding the shallow main waterline replacement project.  Seconded by Councilwoman Boyce.  Motion passed 4-0.
