CHAPTER 6, SECTION 2 CONSRUCTION/MODIFICATION PERMIT - Department of Environmental Quality, Division of Air Quality PUBLIC NOTICE:  In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by XTO Energy Inc. to operate one (1) 46 hp GasJack GJ230 injection pump engine (ENG001) at various well sites in Lincoln, Sublette and Sweetwater Counties, Wyoming.  A Chapter 6, Section 2(c)(ii) demonstration in accordance with the Division’s Interim Policy has been conducted. Emission offset requirements, if applicable, have been applied to this permitting action at a ratio of 1.5:1.0 for VOCs and 1.1:1.0 for NOx. Permitting actions to date have resulted in a decrease in actual VOC emissions of 6.0 tpy and a decrease in actual NOx emissions of 16.4 tpy. Therefore, XTO Energy has met the offset requirements for VOCs and NOx.

For the duration of the public comment period, the permit application, the agency’s analysis, and the public notice are available for public inspection online at https://openair.wyo.gov, utilizing facility ID F031023 and permit number P0035988 under permits. The Board of County Commissioners met in regular session in the Lovatt Room of the Sublette County Library on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Dave Stephens, Mack Bradley, Clayton Melinkovich, Jeness Saxton, Cali O’Hare (via Zoom) representing the Pinedale Roundup, and Carrie Long, County Clerk, present.

Chairman White led those present in the Pledge of Allegiance.

The agenda was approved on motion by Commissioner Noble, seconded by Commissioner Vickrey.

The minutes of the previous meeting on February 21, 2023 were approved and ordered filed, on motion by Commissioner Bradley, seconded by Commissioner Stephens. 

Billy Pape updated the Board on Road & Bridge activities as well as Waste Management. 

Mike Jackson, Rio Verde Engineering, informed the board the request for bids for the North Paradise overlay has been advertised and should be in later in March.

Commissioner Noble presented a letter from the Wyoming Department of Transportation to the other members of the Board, and the Board collectively agreed to take no action on the contents of the letter. 

Jessica Rice (Treasurer’s office) and Tess Soll (Planning and Zoning) updated the Board on their trip to Washington, DC for the National Association of County Officers meeting. 

Clint Gilchrist, Historic Preservation Board, requested approval from the Board to apply for a grant to nominate the Dunham Place as a national historic site.  Commission Noble made a motion to approve the request, Commissioner Vickrey seconded the motion.  Motion carried. 

Commissioner Noble made a motion to adjourn to Executive Session pursuant to W.S. 16-4-405(a)(iii) Litigation.  Commissioner Vickrey seconded the motion.  Motion carried. 

The Board reconvened open session with no action from the Executive Session.  Commissioner Vickrey made a motion to adjourn to an Executive Session pursuant to W.S. 16-4-405(a)(ii) Personnel.  Commissioner Bradley seconded the motion.  Motion carried.

Andrea Jean, Human Resources, met with the Board to update on activities.  She advised the Board the SHRM certification could take longer than originally expected and asked if they were agreeable to her getting the certification by December 2023.  Chairman White said they were fine with the timeline. 

Jean reviewed possible changes to the Employee Handbook and County Policies.  The Board asked her to put her recommendations in a document for their review. 

Commissioner Noble made a motion to approve county membership, at the Platinum Level, in The Employer Group to assist with HR development and advice.  Commissioner Bradley seconded the motion.  Motion carried. 

Linda Merigliano, Ivan Geroy and Gregory Brooks with the Bridger-Teton National Forest updated the Board on the Forest Plan Revision and discussed County participation in future endeavors. 

Dennis Fornstrom, Planning & Zoning, met with the Board with two items for approval.   Commissioner Noble made a motion to approve an application from Johanna Reilly to create the Reilly Minor Subdivision for a 39.40 acre property described as Sheet 11, Tract 1, of the Hoback Ranches Subdivision which creates two lots; Lot 1 being 28.90 acres in size, and Lot 2 being 10.55 acres in size.  Commissioner Vickrey seconded the motion.  Motion carried. 

Fornstrom presented an application from Jackson Fork Ranch, LLC requesting to amend their existing Conditional Use Permit that allows for the operation of a Guest Ranch from their property located at 607 Upper Hoback.  The Jackson Fork Ranch also requested to expand the Conditional Use Permit to include all of the agriculturally zoned property owned by Jackson Fork Ranch, LLC, and to incorporate their property held by Dead Shot Holdings, LLC, located at 883 Upper Hoback, Bondurant, Wyoming. 

Fornstrom stated the Planning & Zoning Board had approved the application with a vote of 3 to 2 with an additional 19 stipulations.  Morgan Fischer represented the Jackson Fork Ranch on spoke on behalf of the applicant. 

Members of the public requesting denial of the application were; Lisa Krawl, Dan Smitherman, Dan Bailey, Marilyn Filkins, Joy Ufford, Chris Lacinek, Carl Benson, Rosemary Benson, Jan Momchilovich, and Mike Crosson.  There were approximately 40 people in attendance in person and another 38 attending by Zoom. 

After hours of discussion, Commissioner Vickrey stated that after having reviewed and considered the eight criteria for a conditional use permit, he proposed the following: 1.  That the proposed location of the use is not in accordance with the purposes of the resolution and the district in which the site is located and 2. That the proposed location of the use and the conditions under which it would be operated or maintained will be detrimental to the public health and safety or welfare or materially injurious to properties or improvement in the vicinity.  Vickrey made a motion to deny the Conditional Use Permit Amendment application for the Dead Shot and Jackson Fork Ranch. Commissioner Stephens seconded the motion.  Motion carried 3 to 2 with Commissioners Noble and Bradley voting nay. 

A catering permit for Elkhorn Trading for an event occurring on the Little Jenny Ranch on March 18 and 19 was approved on motion by Commissioner Noble, seconded by Commissioner Bradley.

Department of Environmental Quality, Division of Air Quality PUBLIC NOTICE:  In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Wexpro Company (dba Dominion Energy Wexpro) (CMP000811) to modify and operate the Dry Piney Unit 23 (F024359) by updating the equipment list to represent the current as-built configuration, located in the NW1/4SE1/4 of Section 4, T27N, R114W, approximately nine (9) miles northwest of Calpet, in Sublette County, Wyoming.  Wexpro Company (dba Dominion Energy Wexpro) has met the demonstration requirements under Chapter 6, Section 2(c)(ii) for this permitting action since current emissions are less than emissions during the baseline period.  VOC emissions have decreased 7.8 TPY from the baseline period and NOx emissions have decreased 0.8 TPY from the baseline period.  These reductions have been added to Wexpro Company (dba Dominion Energy Wexpro)’s offset bank to use for future permitting actions.

Sealed bids, entitled "Daniel/Mount Olivet Cemetery Planting & Irrigation Improvements, Daniel, Wyoming" will be received by Upper Green River Cemetery District, PO Box 1931, Pinedale, WY 82941 until 2:00 P.M. local time on April 25, 2023 in accordance with the plans, specifications and other contract documents.

At said place and time, and promptly thereafter, all proposals that have been duly received will be publicly opened and read aloud. No bid may be withdrawn within a period of sixty (60) days after the scheduled time for the opening of bids.

The scope of the project shall generally include, but not necessarily be limited to:

1. Site clearing, grading, sod, plantings, and irrigation system installation.

A pre-bid conference will not be held. However, bidders are encouraged to visit the site prior to submitting a bid. The Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex, or national origin.

The Town Council of the Town of Pinedale met in regular session on Monday, February 27, 2023, in the Lovatt Room of the Sublette County Library.

The meeting was called to order by Mayor Matt Murdock at 5 p.m. Council members present:  Tyler Swafford, Dean Loftus, Judi Boyce and Scott Kosiba. Those in attendance included: KC Lehr, Sublette County Sheriff; Shad Cooper, Sublette County Unified Fire Chief; Jim Mitchell, representing Sublette County Emergency Management Agency; Robert Galbreath, representing the Pinedale Roundup; Chauncey Goodrich, representing Wind River Resorts; Brian Gray, representing Jorgensen Associates; Eric Sackett, representing Rio Verde Engineering; Matt Bowers, representing Nelson Engineering; Jason and Melinda Moyes, representing Moyes Family Homes; Michele Costello, representing Clean Wash Laundry; Max Lockett; Dylan Bear; John Scanlon; Andrew Tomich; Roxanne Tomich; Byron Brown; Dave Stephens; Doug Vickrey; Peg Weber; Trudy Fry; Arlinda McLaughlin; Tesa Manning; J. Mayor Murdock led those present in the Pledge of Allegiance.

Motion by Councilman Loftus to approve the agenda as presented.  Seconded by Councilman Swafford. Motion passed 5-0.

Motion by Councilwoman Boyce to approve the minutes of the February 13, 2023, regular Town Council meeting as presented. Seconded by Councilman Loftus. Motion passed 4-0-1; Councilman Kosiba abstained.

Sheriff KC Lehr reported on calls for service for January 2023.

Mayor Murdock opened the public hearing regarding Wind River Resorts at 5:12 p.m.  the Wind River Resorts Preliminary Plat proposal for the Wind River Resorts First Addition to the Town of Pinedale. at 5:12 p.m.  The project was presented by Town staff and the Applicant.  Public comments were received. and  Ddiscussion was held between the Council, staff and the Applicant on the individual variance requests antd the project as a whole.  The individual variance descriptions were referenced in detail in the Staff Report addressing Wind River Resorts First Addition to the Town of Pinedale.

Numerous comments both for and against the variance requests were made by the public.

Motion by Councilwoman Boyce to approve a variance request to §400-48 Continuation to adjoining areas.    Seconded by Councilman Kosiba.  Motion passed 5-0.

Motion by Councilman Swafford to approve a variance request to §400-49 Proper projection.  Seconded by Councilwoman Boyce.  Motion passed 5-0.

Motion by Councilman Swafford to approve a variance request to §400-50 Extension to boundary.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve a variance request to §400-89 Water supply.  Seconded by Councilman Kosiba.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve a variance request to §475-149.18 A. Recreational vehicle site ownership (subdivision process).  Seconded by Councilman Swafford.  Motion passed 5-0.

Motion by Councilman Swafford to approve a variance request to §475-149.19 Location and setbacks.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve the preliminary plat of Wind River Resorts First Addition to the Town of Pinedale with the following conditions: 

1.  Recognition of variances recommended for approval.;

2.  Modification of the proposed perpetual easement to allow for use/access for resort users, guests, etc., as to allow the users to utilize the sidewalks and grounds within the 50-foot ROW without trespassing on private lands and meet the intention of Town Code; that one of two options must be completed by the applicant to be compliant with Town Code:  Option 1.  Modify the Perpetual Easement to the Town of Pinedale to reflect a perpetual easement for utilities and access; Provide an additional easement granting access rights to the other lots of the 50’ area.  This protects the users per the code requirements of a minimum 50’ street width and allows residents to utilize the area legally without trespassing.

Option 2.  Move the property line to preserve a 50’ wide common lot.  The easement granted to the Town of Pinedale through the Perpetual Easement /Agreement will need to be modified to reflect only an easement; this option protects the use of the area by all lot owners through existing documents; the resort still may allow landscaping, etc. to be completed within the area at their discretion. 

3.  Modify the Wind River Resorts Pinedale Declaration of Restrictive Covenants to meet the Town of Pinedale minimum codes including, but not limited to the items described in the review of this report. 

4.  Approval is contingent on full compliance with Wyoming State Statute 15-1-415 with regard to existing water rights and that such provisions, once fully known will be reflected on the Final Plat. 

5.  The developer be required to enter into good faith negotiations with the Ehman Village Road Maintenance Association (EVRMA) in regard to subdivision access to McLaughlin Drive. 

6.  Sidewalk material be consistent throughout the development. 

7.  CCRs meet Town Code and be approved by the Town. 

8.  The developer be in compliance with the notes of significance in the Staff Report.  Seconded by Councilman Swafford.  Motion passed 5-0.

Mayor Murdock closed the public hearing regarding Wind River Resorts at 6:51 p.m.

Mayor Murdock opened the public hearing regarding the Preliminary Plat proposal for the Subdivision of  the Bloomfield Addition, Block 6, Town of Pinedale at 6:52 p.m.  The project was presented by Town staff and the Applicant.  Public comments were received.  Discussion was held between the Council, staff and the Applicant on the individual variance requests antd the project as a whole.  The individual variance descriptions were referenced in detail in the Staff Report addressing Preliminary Plat for the Subdivision of Bloomfield Addition, Block 6, Town of Pinedale.

Motion by Councilman Swafford to approve a variance request to §400-84 Street surfacing.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilman Swafford to approve a variance request to §400-89 Water supply.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve a variance request to §475-89 A. Yards.  Rear setback consideration for parcels adjoining Buckboard Road and Bloomfield Avenue.  Seconded by Councilman Kosiba.  Motion passed 5-0.

Motion by Councilman Swafford to approve a variance request to §475-89 A.  Yards.  Front setbacks on parcels.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve the preliminary plat of the Bloomfield Addition, Block 6, with the following conditions: 

1.  Recognition of variances being recommended for approval from the list above.; 

2.  Approval is contingent on full compliance with Wyoming State Statute 15-1-415 with regards to existing water rights and that such provisions, once fully known, will be reflected on the Final Plat.; 

3.  Approval is contingent upon the findings/recommendations of the Traffic Impact Study should such revisions warrant changes to the intersection of US191 for safety concerns based on WYDOT Traffic Impact Study Handbook.; 

4.  Any minimum Town parking conditions be met.; 

5.  All on street parking be prohibited.; 

6.  Before final plat approval, an effective implementation method to prevent access of vehicles from properties off of Buckboard Road and Bloomfield Avenue.;

7. Assure all Staff Report items are addressed.  Seconded by Councilman Swafford.  Motion passed 5-0.

Mayor Murdock closed the public hearing regarding the Bloomfield Addition, Block 6, at 7:34  p.m.

Motion by Councilman Swafford to approve postponing the public hearing regarding Bloomfield Addition, Block 9, at the request of the applicant.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilman Loftus to approve the consent agenda items as presented. Seconded by Councilwoman Boyce. Motion passed 5-0. Consent agenda items approved were a one-year extension of the janitorial service contract with Clean Wash in the amount of $4,077.32 per month, ending January 31, 2024; revision of the Aktivov LLC Asset Management PSA; purchase of UV bulbs from Xylem Water Solutions USA, Inc., in an amount not to exceed $7,100; State Fire PSA for annual fire extinguisher inspection and services, in an amount not to exceed $3,000.

Mayor Murdock and Town Council recognized Michele Smith, Town Animal Control and Municipal Code Officer for successfully completing the required 20-hour course of study and exam to obtain the National Animal Care & Control Association Animal Control Officer I certification.

Motion by Councilman Swafford to approve the waiver of water and sewer overage fees for all users in the Redstone 2nd Addition in an effort to promote water line bleeding.  Seconded by Councilman Kosiba.  Motion passed 3-0-2; Councilman Loftus and Councilwoman Boyce abstained.

Council reviewed monthly department reports from Municipal Court, Animal Control & Municipal Code Enforcement, Public Works, Water and Wastewater, Planning and Zoning, and the Airport.
